A regular meeting of the Southold Town Planning Board was held
at 7:30 p.m., Monday, March 24, 1980, at the Town Hall, Main Road,
Southold, New York. Present were:
Chairman Henry E. Raynor, Jr.
Member Frederick E. Gordon
Member Bennett 0rlowski, Jr.
Member G. Ritchie Latham, Jr.
Millicent & Arthur Gossner, League of Women Voters
Mike Stahl, Suffolk Times
Henry Lytle, Southold-Peconic Senior Citizens
Prellwitz subdivision. William B. Smith appeared on behalf of Mr.
Prellwitz. Mrs. Anne Knowles attended this portion of the meeting.
Mr. Smith plans for a major subdivision but requested that the roads
not have to be built to town specifications and that the twenty-five
foot area on the water be considered enough for the park and recreation
requirement. This matter will be discussed further before a decision
is made.
Shorecrest. Richard Cron, Esq., appeared. This map was filed in 1971
juStpr~or to the enaevmen~ of the requirement for a~minimum of 40,000
square foot~lots~ The time has expired in which these lots could be
sold at the reduced sqUarefootage. The Board oE Appeals has approved
the lot limes as th~srsubdivision was not placed on the excepted list
by the Town Board. Mr. Raynor will discuss the matter with %he Town
Attorney. ~
8.:00 p.m. Clement W. Booth - Public Hearing on the question of the
approval of the minor subdivision. Rudolph Bruer appeared.
Mr. Gordon read the legal notice of hearing and presented proof of
publication in the L. I. Traveler-Watchman.

Mr. Raynor: In going through the file there is correspondence to the
applicant's attorney regarding the declaration of lead agency regard-
ing the State Environmental Quality Review Act. There is a statement
to the Suffolk Co~uaty Department of Health Services, a copy of the
legal notice and description; there is a copy of the negative declara-
tion from this board in regard to the State Environmental Quality
Review Act and a notice of this hearing this evening. There is a
notice of approval of the sketch plan. There is a letter from the
Suffolk County Department of Health Services. "A precursory review
of the above referenced subdivision indicates conditions are suitable
for individual sewage disposal systems; however, prbblems mayL be
encountered with obtaining potable water due to high nitrate
concentrations." There is a short Environmental Assessment Form
signed by Mr. Bruer representing Mr. Booth. We have a receipt frem
the Town Clerk of the filing fee. There is a statement with regard
to the subdivision grading and the application itself. As is the
policy of the Board we will ask if there is anyone present this evening
that would like to speak in oppesition to the subdivision of Clement
W. Booth. Hearing none, is there anyone that would like to speak in
favor of the subdivision of Clement W. Booth.

Mr. Raynor: There being nothing else, I will declare the hearing
closed.
On motion made by Mr. Lath~m, seconded by Mr. 0rlowski, it was
RESOLVED to disapprove the sketch map of the subdivision of
"High House Woods" owned by Samuel B. Prellwitz because it does not
conform to the subdivision requirements of the Town of Southold.
Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham
Xontokosta - Shipyard Lane project. Mr. Gordon reported that he and
Mr. Latham had made a field inspection of this property and feel that
the area is tremendously low and even lower than shown on preliminary
site plan map. The creation of apartments, motels and roadways and
parking areas is going to create an additional flooding area in the
low spots in their opinion. The Planning Board will request from Mr.

On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to set Monday, May 5, 1980 at 7:30 p.m. at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question o£ the approval of the minor subdivision
of Edith M. Terry located at Southold.
Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to set Monday, May 5, 1980 at 7:45 p.m. at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question of the approval of the minor subdivision
of Susan H. Terry located at Southold.
Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham
The minor subdivision of Lloyd Terry will be tabled until the next
meeting in order for Mr. Latham to make a field inspection which he
was unable to do before this meeting because of inability to reach
the site.
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to approve the sketch map of the minor subdivision of
Cleaves Point~ Section IV subject to the removal of all non-habitable
on lots l, 2 and 3 as designated by the building inspector in letter
of October 12, 1979 as follows:

Lot ~3.
Existing non-habitable building
Three existing non-habitable buildings
Four existing non-habitable buildings

On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED ~O~approve the release of Lot #4 on map of "Dawn
Estates Shopping Center, Inc." also known as Cleaves Point~ Section IV
subject to the following restriction of the Southold Town Board Of
Appeals:

That the existing buildings, and any future proposed structures,
on the subject parcel (known as Lot No. 4) be used only for
storage or for conferences by the proposed purchaser, Crescent
Beach Condominiums, and shall never be used as living quarters
or multiple-family, or single-~y residence(s).
Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham
Laurelwood Estates~ Section 2. Abigail Wickham, attorney, Mr.
Cassimano and two other principles appeared. They have purchased the
property from the Estate of Martin Weglicki. This will have to start
all over again and will have to start in the sketch map stage.
On motion made by Mr. 0rlowski, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the unlisted action of the subdivision of Laurelwood
Estates~ Section 2.
Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham
Sterling Forest. A meeting was held at Mr. Dean's office regarding
this subdivision. Present were Mr. Dean, Mr. Raynor, Mr. Harold
Reese, Roderick Van Tuyl, John W. Davis and Lawrence M. Tuthill.
There is a big clay problem in this area as far as drainage is
concerned. There were alternatives discussed such as a recharge
basin being put in. The question arose as to how beneficial the use
of the park and playground would be. This will be discussed with the
Board when the maps come in. Sand fill drainage would not be adequat8
according to Mr. Davis. The developer will present the board with
another proposal.
On motion made by Mr. 0rlowski, seconded by Mr. Gordon, it was
RESOLVED to approve the preliminary map of the subdivision of
Walter Gatz located at Mattituck with the following conditions:
1. The use of swales be disapproved due to steep grades
which would create severe erosion due to excess velocities
of water in the swales during periods of heavy rain.
That the cuts and fills be balanced.

That the road stationing begin at the center line of
Soundview Avenue.
That there be no change in grade on the cross-section to
the existing surface on Soundview Avenue as indicated on the
profile and that the grade be minimum as possible at this

intersection so traffic will not slide out into Soundview
Avenue during icy conditions.
That the bank on the south side of the proposed road at
the intersectios of Soundview Avenue on Lot #7 be graded
back at the same elevation as Soundview Avenue at that
point so as to give sufficient sight distance for cars
entering Soundview Avenue.
That substantial stairs be provided to the'beach area and
that plans be submitted for review.
That a park and playground area be designated. It is
noted that the existing beach is generally only fifteen to
twenty-five feet wide and that part of such park and play~
ground area be on upland areas that are fairly level.
That the tangents of the vertical curve at Station 4-50 be
increased for a better sight distance.
That the 20 foot passageway leading to the south of the new
road next to the first lot on the left be moved to the west
and be situated between the next to the last lot and the
last lot on the left. A swale iz to be provided in this
passageway as a relief for excess water from the leaching
pools in that area.
That land be set aside for future dedication to the town
from the end of the new road to the western property line.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED to set 8:00 p.m., Monday, May 5, 1980, at the Town Hall,
Main Road, Southold, New York, as the time and place for a public
hearing on the question of the approval of the minor subdivision of
Stanley & Marta Wiepzynski located at Southold.
Vote of the Board: Ayes: Raynor, Orlowski,Latham, Gordon
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board request that the
Town Engineer, Lawrence M. Tuthill, prepare a bond estimate for the
subdivision to be known as "Long Pond Estates~ Section T".
Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham
Mr. Wilsberg has requested that he be allowed to construct the roads
without presenting a bond for same. Mr. Raynor will discuss this
with the Town Attorney and inform Mr. Wilsberg of the outcome.

A letter has been received from the Town Clerk in which she
states that Mr. Dean will be reviewing the progress of road
construction in subdivisions for which the time has expired to do
the work under Town Law. This letter will be sent to the developers
of Highland Road.
In review of the application of Richmond S. Corwin to the Board
of Appeals in which he requests a variance for approval of insufficient
area and width of property at Maple Avenue, Southold, the Planning
Board sees no need for a town highway in the area.
In review of the application of Clement W. Booth to the Board of
Appeals in which he requests a variance for approval of insufficient
area and width of property at Mt. Beulah Avenue and Soundview Avenue
at Southold, the Planning Board sees no need for a town highway at
this particular location.
In review of the application of Richard & Donnalee Relyea to the
Board of Appeals in which they request a variance for approval of
insufficient area and width of property at Mattituck Creek, the
Planning Board sees no need for a town highway at this particular
location.
In review of the application of Julius Zebroski to the Board of
Appea~s in which he requests a variance for approval of insufficient
width of property at Ole Jule Lane, Mattituck, the Planning Board
sees no need for a town highway at these sites.
The Chief of Police has indicated to the Board that the Bay
Constable's boat is in the water and available for the use of the
Board for a field inspection of Robins Island. The Board would like
to request the boat for April 8, 1980 at 1:30 p.m. to leave from the
North Fork Shipyard au New Suffolk. The Conservation Advisory Council
and Counc.ilman Lawrence Murdock will be informed of the date. Mr.
MurdoCk hadmasked to go along on the inspection.
Lawrence M. Tuthill reported on meeting with the Flood Plain
people in Washington, D. C. and presented a co,y of his report.

the meeting. Meeting adjourned at 9:45 p.m.
