or the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.

ALL that certain plot, piece and parcel of land, situate, lying and being at Mattituck, in the
Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point situate on the easterly line of a 12 foot right of way at the
northwesterly corner of land now or formerly of William J. Tufano, which said point is located the
following two (2) courses and distances from the monument set at the southwesterly terminus of a
50 foot right of way set forth in Liber 8575 cp 209 known as "Kreh Road":
1. North 25 degrees 13 minutes East 60.00 feet;
2. North 39 degrees 49 minutes 20 seconds West 20.81 feet to the true point or place
of beginning.
THENCE North 39 degrees 49 minutes 20 seconds West 63.00 feet to dredged canal from
James Creek;
THENCE along a tie line which runs thru the waters of the dredged canal from James Creek
North 67 degrees 40 minutes 40 seconds East 68.10 feet to lands now or formerly of Strongs Marine
Inc.;
THENCE South 39 degrees 49 minutes 20 seconds East along said lands now or formerly
of Strongs Marine Inc. 40.00 feet to lands now or formerly of William J. Tufano;
THENCE South 47 degrees 57 minutes 20 seconds West 65 feet to the easterly side of the
12 foot right of way, the true point or place of BEGINNING.
