TELEPHONE 765- 1938 A regular meeting of the Southold Town .Planning Board was held at 1:45 p.m., Monday, March 10, 1980, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member Frederick E. Gordon Member James Wall Member Bennett Orlowski, Jr. Member G. Ritchie Latham, Jr. Frank Bear, North Fork Environmental Council Paul Demery, L. I. Traveler-Watchman (2-2:30) Mike Stahl, Suffolk Times (2-2:30) 1:45 p.m. Public Hearing on the question of the approval of the minor subdivision of Briarcliff Sod, Inc. located at Peconic. Present were Frank Cichanowicz III and Gary Flanner 01sen, Esq. Mr. Raynor read the legal notice of hearing and presented proof of publication in the L. I. Traveler-Watchman. Mr. Raynor: In the file we have a copy of the legal notice, a copy of the resolution setting a date for the hearing, correspondence to the applicant's attorney from the Board. I have a~negative declaration in compliance with the State Environmental Quality ReviewAct and recommendations from the County. There are recommendations from the Suffolk County Department of Health Services saying the conditions are adequate for sewage disposal facilities but there may be trouble getting potable water due to the high nitrate concentrations in the area. There is correspondence from this board to the County and State with regard to SEORA and correspondence in the file on lead agency. We have a short Environmental Assessment Form along with the standard letter flor the County Planning Commission on roads and dralinage, the application and receipt of the fee in the amount of $20 from the Town Clerk. There is correspondence in the file from the Southold Town Board of Appeals and correspondence from the attorney initiating the action. As is the custome with a public hearing, is there anyone present this afternoon that would like to speak in opposition to the subdivision Briarcliff Sod, Inc. Hearing none, is there anyone present that would like to speak in favor? Planning Board ~i -2- Mar ~ 10, 1980 Mr. 01sen: I am the attorney for the applicant. This matter was before the Zoning Board of Appeals at its meeting of December 6, 1979 and a variance was granted to cut the farmhouse and garage out. The reason it was done that way is due to the fact that to give any more area on the road would interfere with telephone poles, existing curb and a catch basin. The applicant intends to use the existing barns on the large parcel. The house piece was designed for easy access to go over existing driveways to the barns. We are here to answer ~any questions you might have. Mr. Raynor: Is there anyone else present this afternoon that would like to speak in favor of the proposed subdivision? Is there any- one present that has any information that should come before this board with regard to this subdivision? Do any members of the Board have any questions? (There was a negative response.) Hearing none, we will deem this hearing closed and thank you for coming down. Mr. Orlowski moved for the adoption of the following. Mr. Gordon seconded the motion and it was carried. WHEREAS, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Briarcliff Sod~ Inc., was submitted to the Planning Board on November 29, 1979 and an application fee of $20 was paid on November 29, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on March 10, 1980 at 1:45 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of Briarcliff Sod, Inc. for approval of said subdivision plat prepared by Young and Young and dated August 23, 1979 and amended October 10, 1979, be approved and the chairman be authorized to endorse approval on said subdivision plat. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to reaffirm approval of the site plan ef Sea Breeze Village, ~riginal approval dated October 10, 1978 and approval of revision dated July 23, 1979, and authorize the chairman to sign same in order for it to be filed in the Suffolk County Clerk's Office. Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski Abstain: Latham Mr. Latham abstained due to the fact that he represents the bank in this matter. Planning Board ~.~ Ii -3- Mai~~ 10, 1980 0n motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED to set 7:30 p.m., Monday, April 7, 1980 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of James Dean #188 located at Cutchogue. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlo~ski, Latham 0n~motion made by Mr. Wall, seconded by Mr. 0rlowski, it was RESOLVED to set 8:00 p.m., Monday, April 7, 1980 at the Town Hall, Main Road, Southold, New York, as the time and~place for a public hearing on the matter of the amendments to the Rules and Regulations governing the Subdivision of Land in the Town of Southold, said amendments being as follows: I. By amending Article II, Section A106-22, Subdivision A.(2) of said Regulations to read as follows: (2) All applications for plat approval for minor subdiviuions shall be accompanied by a fee of fifty ($50.00) dollars, or twenty-five ($25.00) dollars per lot whichever is greater. II. By amending Article II, Section A106-25 of said Regulations by adding a new subdivision thereto to be subdivision F to read as follows: Fe Safeguards during construction. In order to prevent flooding, erosion or any other dangerous or hazardous condition from occurring during the progress and completion of required improvements, the Planning Board may require the developer, or his contractor, to take such action, including the construction and/or installation of temporary facilities, as the construction inspector may recommend. III. By amending Article III, Section A106-33, Subdivision B of said Regulations to read as follows: Be Improvements. Streets shall be graded and improved with pavements, curbs and gutters, sidewalks, drainage facilities, water mains, sewers, streetlights and street signs, street trees and fire hydrants and/or firewells. Firewells shall have an eight inch casing and a twenty foot stainless steel screen and shall have a pumping capacity of three hundred fifty (350) gallans per minute. There shall be a depth of water of at least forty (40) feet. The number and location of fire hydrants and/or firewells shall be determined by the Planning Board. In making such dtermination, the Planning Board may seek the recommendation of the Planning Board ~ -4- Ma~j 10, 1980 Commissioners of the Fire District in which the proposed subdivision is located. Notwithstanding the foregoing, upon request, the Planning Board, upon written approval of the Superintendent of Highways and the Town Board Highway Committee, may waive subject to appropriate conditions, such improvements as it considers may. be omitted without jeopardy to the public health, safety and general welfare. Pedestrian easements shall be improved as required by the Planning Board. Such grading and improvements shall be approved as to design and specifications by the Town Superintendent of High- ways and the Town Board Highway Committee. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham Shipyard Lane~ Kontokosta matter. Manny Kontokosta and Richard Lark, Esq., appeared. The letter from the Building Inspector regarding the site plan was read. There was a question as to why no parking was required for the coffee shop. Mr. Lark explained that the approval from the Zoning Board of Appeals stated that the coffee shop was to be exclusively for the motel and apartment occupants and not permitted for use by the general public. Mr. Raynor asked how they felt about the building inspector's comment about more parking being required. They have allowed one for each guest and one for each employee. There are no standards for apartments. The closest they could find was the rooming house requirements which show One for each guest room. Therefore, they are proposing twenty~eight for twenty-eight apartments. They felt one car per unit would be sufficient. Any additional visitors could be accommodated along the road. These are one-bedroom units~ The Board will take these comments into consideration and confer with the building inspector. It will be necessary that Suffolk County Real Property numbers be placed on the plan. Mr. Raynor would like any land subject to flooding shown on the plan. Mr. Kontokosta sand all units will be at finished elevation of eight feet. Mr. Raynor requested that Mr.~Latham and Mr. Gordon make an inspection to see if there is a flooding problem in the area. Mr. Raynor requested outdoor signs to be shown and a refined landscaping plan as far as the Censervation easement and what may be subject to flooding. Mr. Kontokosta said that drainage basins would collect runoff from the paved areas with the balance to be picked up by the unsurfaced sandy areas. A copy of the plan will be sent to John W. Davis, Planning Board Inspector, for his review of drainage. Mr. Lark asked what the Board wanted screened and Mr. Raynor answered he wanted some type of low shrub on the southeast corner and the easterly "in" access road to screen it from the units themselves. Mr. Kontokosta will submit his entire landscaping plan when it is available. The committee will report back to the Board at the next meeting and Mr. Kontokosta will be made aware of any changes. Thornton Smith major subdivision ~t Mattituck. Mr. Smith and Richard Lark, Esq., appeared. The Board discussed Mr. Smith's cluster plan dated January 23, 1980. Mr. Smith said Mr. Kujawski was not interested in £arming the open area proposed and he felt it would be Planning Board 5- Ma a 10, 1980 incompatible with the residential area. He has no use for the open area. There was discussion regarding the road ending at lot 47 with 48 and 49 having a common driveway on Sound Avenue. Mr. Smith is now contemplating bringing the subdivision in in sections. Mr. Raynor requested that he send in a proposal. Edith M. Terry minor subdivision SusanH. Terry minor subdivision Raymond Terry aud Richard Lark, Esq., appeRred. This is property which was willed to both Edith and Susan Terry. It has been recommended that the property be separated because of a lien by Social Services on the property of Susan Terry who is in the nursing home. A letter was presented from the Southold School District indicating that they have no plans currently to dispose of any portion of the southernmost Oaklawn Avenue property abutting the Terry Estate. It was purchased for future playground and facilities improvement. On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board declare itself lead agency for the unlisted action of the minor subdivision of Edith M. Terry located at Southold. Terry located at Southold. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Wall, Latham On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to approve the sketch map of the minor subdivision of property of Edith M. Terry located at Southold subject to monuments being set at the corners of the property and placed on the final map. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Wall, Latham On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was RESOLVED to approve the sketch map of the minor subdivision of property of Susan H. Terry located at Southold subject to monuments being set at the corners of the property and placed on the final map. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Wall, Latham Lloyd Terry minor subdivision. Richard Cron, Esq., represented Mr. Terry in this matter. Mr. Lathamwill make an inspection of the property and report back to the board at the next meeting. Planning Board .~1 -6- Ma/~ ~ lC, 1980 Prellwitz subdivision. William B. Smith appeared. Mr. Orlowski reported that an inspection has been made of the property and it is felt thatMr. Prellwitz should keep to a four-lot minor subdivision with twenty-five foot roadway. Mr. Raynor told Mr. Smith to come back to the Board when Mr. Prellwitz decides what he wants to do. On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to accept the report or. Lawrence M. Tuthill and Raymond C. Dean dated February 6, 1980, with r~gard to the subdivision known as "Mill Lane Building and Contracting Corporation" located at Mattituck. · Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlewski, Latham On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to approve the preliminary map of the subdivision known as "Mill Lane Building and Contracting Corporation" located at Mattituck subject to the following: That there be a recharge basin in the rear of Lot No. l0 with a catch basin~on the southwest side of the same lot on Mill Lane with piping to the recharge basin. 2. Contour lines be shown beyond the property lines as required. Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski, Latham Motion was made by Mr. Gordon, seconded by Mr. 0rlowski tha~ Pursuant to Article 8 of the Envi~anmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The ma~or subdivision of "Mill Lane Building and Contracting Cp~Moration" located at Mattituck is a ten-lot residential subdivision of 15.438 acres. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Planning Board -7- Ms'~h 10, 1980 Because it is more than 300 feet from tidal wetlands, it is not under the jurisdiction of the New York State Department of Environmental Conservation. The Suffolk County Department of Health Services had indicated no objection to the designation of lead agency and upon submission, will make a review of the proposed water supply and sewage disposal facilities for the subdivision. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land Regulations and the Southold Town Board has approved the cluster concept subdivision. On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was RESOLVED to recommend to the Southold Town Board denial of the application of Wayne Assgciates for a change of zone from A Residential to M-1 General Multiple-Residence for property located at Southold because it is not in oonformity with the development map of the Town of Southold. Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead ageney for the unlisted action of the minor subdivision of property of Stanley & Marta Wiepz.ynski located at Southold. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Wall, Latham On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to approve sketch map dated December 6, 1979, of property of Stanley & Marta Wiepzynski located at Southold subject to correct of the key map in that it appears that Jennings Road is not located properly. Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski, Latham Planning Board ~t -8- Ms~h 10, 1980 On motion made by Mr. Gordon, seconded by Mr. Lath~m, it was RESOLVED to rescind the resolution of the PlYing Board dated December 17, 1979, which reads as follows: "RESOLVED to disapprove the sketch map of t~e minor subdivision of property to be known as Cleaves Point~ Section IV, for the follow- ing reasons: Lot I has an existing non-habitable building with insufficient side and front yards. Lot 2 has three'existing non-habitable buildings one of which has an insufficient front yard and two of which have insufficient side yards. Lot 3 has four existing non-habitable buildings, one of which has insufficient front yard and two of which have insufficient side yards. Lot 4 has insufficient area and an existing non-habitable building with insufficient front, rear and side yards. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham An inspection will be made of the property by Mr. Gordon and Mr. Latham to determine which buildings should be removed before any further action is taken by the Board. Mr. 0rlowski made a motion, secinded by Mr. Wall and carried to approve the minutes of the regular meeting of February ll, 1980 subject to a change on page 7 to read that the hearing will be held March l0 rather than March ll. Mr. 0rlowski made a motion, seconded by Mr. Gordon and carried to approve the minutes of the regular meeting of February 25, 1980 subject to change on page 5 that should read Whitcom Investment Company rather than Whitcom Realty Company. On motion made by Mr. Gordon, seconded by Mr. 0rlewski, it was RESOLVED to accept Report ~125 of John W. Davis, Planning Board Inspector, in regard to the subdivision "Southold Gardens at Southold" and recommend to the Southold Town Board release of the performance bond for said subdivision. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham %%% On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was Planning Board ~ -9- M~h 10, 1980 RESOLVED to report to the Zoning Board of Appeals on its request for an over-view of the property of Helen &Anita McNulty that it is the opinion of the Southold Town Planning Board that this property should come in for a subdivision of the 3.2 acres under current zoning standards as there is sufficient property in all probability for three lots. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Wall, Latham On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to report to the Zoning Board of Appeals on its request for an over-~iew of the property of Sophie Raynor that it is the opinion of the Southold Town Planning Board that an approval of insufficient width and area of the two proposed lots on County Road 27 is inconsistent with the zoning pattern in the area and with the developmeht plan for the Town of Southold. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham, Wall On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED to report to the Zoning Board of Appeals on its request for an over-view of the property of Roy C. Schoenhaar that, although there does not appear to be a necessity for a highway nor drainage facilities, the areas and widths of all lots do not comply with the Code of the Town of Southold. Vote of the Board: Wes: Razor, 0rlowski, Gordon, Wall, Latham On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to report to the Zoning Board of Appeals on its request for an over-view of the property of Eleanor Ruch, known as lots l, ~,17,18 andl9 on filed subdivision map of "Shorecrest at ArshamomaG.ue" that the Planning Board finds no objection. Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to report to the Zoning Board of Appeals on its request for an over-view of the property of Joseph Clifford Cornell, known as lots 6, 7, 8 and 9 on filed subdivision map of "Shorecrest at Arshamomaque" that the Planning Board finds no objection.
