Jr. TP DD Southold, N.Y. 11971 TELEPHONE 765-1938 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Tuesday, January 29, 1980, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member James Wall ~Member Bennett 0rlowski, Jr. Member G. Ritchie Latham, Jr. Millicent Gossner, League of Women Voters Tim Gould, Suffolk Times (7:30 - 8:15 p.m.) Absent was: Frederiok E. Gordon (ill) FIDC0 Minor Subdivision referral from the Board of Appeals #184. Richard Lark, Esq., appeared. This is the division of a piece out of ten acres. FIDC0 owns the building across the street whioh may be a supermarket some day and the space will be needed here for parking. An upholstery shop will locate here. It is B-1 zoned. The Board of Appeals wants some kind of imput from the Planning Board. FIDCO Minor Subdivision referral from the Board of Appeals #185. Richard Lark, Esq., appeared. FIDCO wants todivide up the area to make four lots with an existing duplex on each. It is B-1 zoned and the Board of Appeals wants recommendations. Cooke-Emerson #186 minor subdivision. Richard Lark, Esq., appeared. The building inspector has given a permit and a certificate of occupancy for the house. Mrs. Cooke wants to own lot i and Mrs. Emerson wants to own lot 2. They will present a covenant for the property to the north that it will be brought in as a major subdivision at the time it is developed. Walter Gatz cluster subdivision. Walter Gatz and Richard Lark, Esq., appeared. Also present was Howard Young. A gentleman by the name of ,~Rh3z{,, was in the audience and was apprently a friend of Mr. Gatz. He requested an opportunity to present his own calculations as an engineer. Mr. Raynor invited him to do so. The Lawrence M. Tuthill Memorandum of January 7, 1980 was reviewed. Recommendations 1. That the use of swales be disapproved due to steep grades, which would create severe erosion due to excess velocities of water in the swales during periods of heavy rain. (This recommendation will be held until there is more information.) ® That the cuts and fills be balanced. (Mr. Young said Mr. Tuthill's recommendation'means that he is asking them to fill on the top of the hill.) That the road stationing begin at the center line of Sound View Avenue. (Mr. Young said the road stationing does begin there.) That there be no change in grade on the cross-section to ~ne existing surface on Sound View Avenue as indicated on the profile and that the grade be minimum as possible at this intersection so as traffic will not ~lide out into Sound View Avenue during icy conditions. (Mr. Raynor said Mr. Tuthill wants a flat intersection but doesn't say how far back. Mr. Young said it can be alleviated but not by filling.) That the bank on the south side of the proposed road at the intersection of Sound View Avenue on Lot ~7 be graded back at the same elevation Sound View Avenue at that point so as to give sufficient sight distance for cars entering Sound View Avenue. (Mr. Young agreed with this recommendation.) That substantial stairs be provided to the beach area and that plans be submitted for review. (Mr~R~y~.or said the County Planning Commission will ask f or a common access down the bluff. Mr. Gatz said there was about a twenty-five foot drop at the end of the right-of-way. Mr. Raynor said they will have to show that a stair well is not necessary or show where one is needed.) That a park and playground area be designated. It is noted that the existing beach is generally 0nly 15 feet to 25 feet wide. And that part of such park and playground area be on upland areas that are fairly level. (Mr. Raynor feels it is up to the Board and not the Engineer to make this decision.) That the tangents of the vertical curve at Station 4-50 be increased for a better sight distance. (Mr. Young stated that is no problem.) Suggestions 1. Since this area is being clustered that a firewelI be required in the vicinity of the proposedroad and Sound View Avenu~.~ (There is a firewell on the corner.) That a review of the possibility of erosion control along the banks and the beach for their preservation and that of the adjacent properties. It is noted that~there are already several bulkheads at the toe of the bank in this section of the Sound. (Erosion control will be included in the conditions of the Suffolk County Planning Commission.) It is noted that there is a noticable bend in the shore line that is shown on the location map, but nOt on the survey. (No one present could establishwhat was meant by this.) It is noted that the contour lines are notcarried beyond the property lines as required. (The regulations say it should go 200 feet beyond the property lines but Mr. Raynor feels that the board is well aware of this property. Mr. young will write the Board with any suggestions he has ~,.l~.~.._.o_~.~ v~t will write with his observations and comments. *** Fred Kaelin, Jr. and Joseph Hannabury appeared with a request as to what will happen with the bond for "Highland Estates". At times the roads are impassable and promises are made by the developer but the work is not done. Mr. Kaelin and Mr. Hannabury want the Town to call the bond and complete the work. Mr. Raynor assured the gentlemen that action will be taken bythe Planning Board on this matter at an early date. 8:15 p.m. Public Hearingon the question of the approval of the preliminary map of the subdivision to be known as "Mill Lane Building ~ Contracting Corporation" located On Mill Lane at Matt£tUCk. 'Mr. ~Ohn simicich, principle, and Mr, Lark, his attorney, appeared. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk ~Times. Mr. Raynor: In the file we have a check in the amount of $130. We have the following letter under date ofjanuary 24, 1980 from the SuffOlk County Department of Health SerVices. Dear Mr. Raynor: We are in receipt of your letter dated January 19, 1980. This Department has no objection to your designation as lead agency. Upon submission, a review of the proposed water supply and sewage disposal facilities for the above referenced subdivision will be conducted. /s/ Royal R. Reynolds, P.E. Mr. Raynor: There is correspondence between this Board andthe attorney. There is on file with our Board in compliance with the State Environmental Quality Review Act a short Environmental Assessment Form signed by Mr. Cuddy, representing Mr. Simicich. There is an application for approval. There is the following letter under date of December 5th. Dear .Mr. Cuddy: The following action was taken by the Southeld Town Planning Board at a regular meeting held December 3, 1979. RESOLVED that the Southold Town Planning Board approve the sketch map of subdivision to be known as "Mill Lane Building & Contracting Corporation" located at Mattituck, of which John Simicich is the sole principle, said map dated November 8, 1979. Henry E. Raynor, Jrt, Chairman We have more descriptions of the property. There is correspondence with regard to 2he Department of Health as far as what we read already. We have a letter from the office of the Town Clerk. Gentlemen: At a regular meeting of the Southold Town Board held on April ll, 1978, a resolution was adopted approving the cluster concept on the property of John Simicich located on the easterly side of Mill Road, Mattituck. /s/ Judith To Terry, Town Clerk There is more correspondence from the attorney involved and maps. As is the policy of this board with public hearings on subdivisions we will ask if there is anyone present this ev$fiing that has any objection to the proposed subdivision of "Mill Lane Building & Constracting Corporation". William Ruland: The Only concern I have if that I feel that it is in direct conflict withArticle 25 SectionAA of the Agriculture and Markets Law concerning agricultural districts. However, I do recognize the right that-:an individual has to do what he wants with his own property but I assume there are going to be houses and they are moving into a highly agricultural area and I can see conflict~ already. I don't know if there is an answer but I think in order for everyone to be able to live together there should be deed restrictions as to presently existing uses of the surrounding area. As population increases in areas of agriculture objections to the operations surrounding it arise. I think that it should be somehow understood before it takes place since that area is a vast open space. Mr. Raynor: The Board. will review that section. Is there anyone else present that has a specific objection to this proposed subdivision. John Sidor:~ I would like to know what he is going to do with all the water that comes through. There are three lots that will be flooded every spring. ~I don't think they realize how much water comes through there. I have lived there fifty years and know. All the back farms' water drains through. There is no way of stopping it. It all drains into the creek. Mr. Raynor: to the west. You have objection to the water flowing from the east Mr. Sidor: Right. When the snow starts melting you have a regular river through there. The first three lots I don't see how a house can be put in there without water in the cellar. If yo~ look at the map and see the elevations you can see the water drains from way back. I don't think a catch basin in the back will hold that water. Mr. Orlowski: Will you show me here on the map. Mr. Sidor: If you are going to put a home here the water will come through there. That is every spring and even in the fall when we have that big rain. Maybe the basin would hold that, but not in the spring. Mr. Raynor: Is there anyone else present this evening that has some specific objection to the proposed subdivision. Hearing none, is there anyone present this evening that would like to speak in favor. Charles Cuddy, Esq.: I would like to ask Mr. Ruland where his property is. Mr. Ruland: Route 2~ and Mill Lane. Mr. Cuddy: Mr. Ruland: boundary. Mr. Cuddy: In other words, you are south of this property. That is correct. Less than half a mile from the It would have to be measured. You are not contiguous to this piece of property. It would appear to me that we have been here for over a year and a half processing this. We have done pretty much what the Board has asked us by reducing the number of lots and relocating the park and recreation area. In answer to Mr. Ruland I think I should point out that when we first brought this in it was pointed out this was farmland and we have open space based on the fact ~hat it is farmland. This is why we have clustered, to maintain open space. I think in your objection you should realize we are con~ sidering the farmland. It was done because Mr. Wickham asked us to do just exactly what you are asking us. I would submit to the Board and, if necessary, we will have further study. The surveyor and engineer don't feel the problem exists. If it doe we want to do something about it. I would ask that the Board approve the subdivision. I con't think of any reason you would not want clustering. We have reduced the number of lots and ~ increased the frontage on the lots. On behalf of Mr. Simicich, I ask that it be approved. Mr. Raynor: Is there anyone else that would like to speak in favor of this proposed application. Hearing'none, is there any- one present this evening that has some information that may be neither pro nor con that is pertinent and the Board couldget some information pertaining to this particular parcel of property. Mr. Ruland: I would further like to comment that I am sure while there is no statutory restriction against it that that parcel is wholly located withinan existing agricultural district which was formed probably since the owner purchased the property. However, the property does lie within it. Though it has no bearing, it is still within it. Mr. Raynor: If you think there is some type of legal conflict I would be glad to review it with the town attorney and get a written opinion. Mr. Ruland: I can't say one way or another. I den't know. In many areas cluster use is expedient when all else fails. I would favor it because of the recharge areas that you are saving. It certainly has great benefits. Mr. Cuddy: I think I should reply to that. I would point out that the reason we are clustering is because the Board asked us to cluster it after we presented a grid which was a 40,000 square foot subdivision. Mr. Raynor: Is there any further comment from anyone present this evening, Mr. Latham, Mr. Orlowski, Mr. Wall? (A%l answered in the negative.) I think two important points were raised and I think it's encumbant on the Board to find out if it is a conflict to the Agricultural Law. Miss Tolman, will you write a letter to the town attorney for an opinion. I think where drainage has been raised it is encumbant on the Board to send a copy of the minutes to the town engineer and have a written report and reply for this board to review prior to making a decision. There being nothing else, I will declare this hearing adjourned and thank you for coming down and caring enough about your neighborhood. Mattituck Library presubmission. Steve Tsontakis, President of the Library Arthur Tillman, and a contingent of people from the library were present. The Library proposes an addition to its present building. There is a problem providing parking. At present, the overflow parks in the church parking lot. There would be a problem getting an agreement from the Diocese of Rockville Centre. The inadequate side yard will be a matter for the Zoning Board of Appeals. They will also require a special exception to construct and a variance from the parking requirement. Mr. Raynor would like to get the opinion of the town attorney in regard to a waiver of the parking requirement. One of the officers of the library commented that the expense of aparking lot would preclude the addition. Robins Island. The Board does not want to act on the sketch map for the development of Robins Island until such time as a field inspection can be arranged for the Planning Board and members of the Conservation Advisory Council. Mr. Esseks will be contacted to make arrangements. On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to set 9:00 p.m., Monday, February 25, 1980, at the Town Hall, Main Road, Southold, New York, as the time and place' for a public hearing on the question of the approval of the preliminary map of the subdivision of "Macari" located at Mattituck. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham On motion made by Mr. Latham, seconded by Mr. 0rlowski, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in accordance with the State Environmental Quality Review Act for the unlisted action of the subdivision of the property of "Macari" located at Mattituck. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was RESOLVED that .the subdivision or setting off of two parcels of property owned by Mrs. Cooke and Mrs. Emerson to Mrs. Cooke and Mrs. Emerson be considered as a casual sale in the family. This action is subject to the filing of a covenant that the remainder of the ten acre parcel be submitted as a major subdivision. Vote of the Board: ,Ayes: Raynor, Wall, 0rlowski, Latham The Chairman directed that the map of Walter Gatz be forwarded to the Soil & Water Conservation District of the U. S. Department of Agriculture at Riverhead for their opinion on the swaling of roads in this subdivision. Mr. Tuthill is to be requested to attend the hearing on the llth of February to explain his recommendations and suggestions inregard to this subdivision. On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED to set 8:30 p.m., Monday, February 25, 1980 at the Town Hall, Main Road, South. Id, New York, as the time and place for a public hearing on the question of the appreval of the minor subdivision of Whitcom Investment Corporation located at Orient. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham The Chairman directed that the map of "Mill Lane Building and Contracting Corporation" be sent to Town Engineer Tuthill and Planning Board Inspector Davis for their comments and recommendations on drainage. On motion made byMr. 0rlowski, seconded by Mr. Latham, it was RESOLVED that the following recommendations of Planning Board Inspector John W. Davis be incorporated into the map of Bayview Woods m~0rporation located at South.id: 1. Road "A" should have an additional small Type B recharge basin for relief. There is insufficient pooling on Road "C" and in order to take up the excess runoff it.should be connected to the ponding area. There are no soil tests and soil test wells and one should be in the recharge basin location. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED to accept the recommendations and comments of John W. Davis, Planning Board Inspector, in Report No. ll2 dated January 10, 1980 regarding the minor subdivision of George L. Penny IV. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham Mr. 0rlowski moved for the adoption of the following. Mr. Wall seconded the motion and it was carried. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor'subdivision of George L. Penny IV is a three-lot residential subdivision of 3.901 acres located atSouthold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The Department of Environmental Conservation indicates that since.the property is further tha~ 300 feet from tidal wetlands and further than 100 feet from the nearest rreshwater wetland over 12.4 acres, it is beyond New York State Department of Environmental Conservation jurisdiction. The Suffolk County Department of Health Services has indicated that an adequate, potable water supply should be available and provided the sewage systems are kept over 100 feet from wetlands and surface waters, there is notproblem anticipated. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land Regulations. WHERE&S, a formal application for the approval of a sub- division plat, entitled Minor Subdivision of George L. Penny IV was submitted to the Planning Board on October 16, 1979 and an application fee of $30 was paid on October 16, 1979, and WHEREAS, a public hearing wasoheld on the said subdivision application and Plat at the Town H&ll in Southold, New York, on December 3, 1979 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of George L. Penny IV for approval of said subdivizion plat prepared by Roderick Van Tuyl, P.C., and dated December 26, 1979, be approved and the chairman be authorized to endorse approval on said subdivision plat. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham Maidstone Development, Inc. change of zone. Abigail Wickham is the attorney representing the applicant. This is a proposal to change from Agricultural-Residential to General Multiple Residence a parcel of 5.2 acres located on L. I. Sound and County Road 27.~ There is public water available and sewage would be by septic tanks. Mr. Raynor appointed Mr. Latham and Mr. Gordon as a committee to make a field inspection of the site and report back to the Board at the next meeting as to whether this is the proper use of the property. On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was RESOLVED to approve the report of John W. Davis, Planning Board Inspector, Report No. 93 in regard to the construction of improvements in the subdivision known as "Pebble Beach Farms" and recommend to the Southold Town Board release of the bond for said improvements. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham The matter of Rhodos Pavilion was tabled until Mr. Gordon has an opportunity to discuss the matter with the building inspector. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED to refer to the Southold Town Conservation Advisory Council for an analysis of the property in regard to building area the minor subdivision of William A. Osterholm located at Arshamomaque. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham The proposal of George M. Agnew for a marina-residential complex north of Champlin Place in Greenport will be referred to Superintendent of Utilities of the Village of Greenport James I. Monsell. There is a question in the mind of the board concerning this type of project with regard to the fresh water supply and the board would like Mr. Monsell's comments on it. On motion made byMr. Latham, seconded byMr. Orlowski, it was RESOLVED to approve the existing parking and screening at the property of William Heins located on the corner of Oyster Ponds Lane and Main Road, Orient, subject to a one-year review because of the undetermined use of the addition to the building. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham 0n motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to approve the sketch map of Clement W. Booth, Minor Subdivision #183, map dated December 17, 1979, subject to receipt of covenant that the remainder of the adjoining property will be presented as a major subdivision with provision for an east-west road. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham Another set of maps have been received from the Van Tuyl office with regard to the subdivision of "Long Pond Estates". They will be submitted to the Planning Board Inspector, John W. Davis, to determine if they conform with his recommendations. On motion made by Mr. 0rlowski, seconded by Mr. Wall, it was RESOLVED to forward the map of the property of "Long Pond Estates" to the Town Board Highway Committee which consists of Councilmen Nickles and Sullivan, for its consideration for swale drainage construction on the roads in the subdivision. Vote of the Board: Ayes: Ray-nor, Wall, 0rlowski, Latham Mr. 0rlowski moved for the adoption of the following. The Suffolk County Department of Health Services has indicated that a precursory review indicates conditions are suitable for individual~sewage disposal systems and water supply facilities. The project will meet all requirements of the Code of th~ Town of Southold Subdivision of Land Regulations. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham Mr. Lathammoved for the adoption of the following. Mr. 0rlowski seconded the motion and it was carried. WHEREAS, a formal application for the approval of a subdivision Plat, entitled Minor Subdivision of ~Thomas & Karen Uhlinger was submitted to the Planning Board on November 30, 1979 and an application fee of $20 was paid on November 30, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on January 7, 1980 at 8:00 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of Thomas &.Karen Uhlinger for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C., and dated January 8, 1980, be approved and the chairman be authorized to endorse approval on said subdivision plat. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham Motion was made by Mr. Latham, seconded by M~. 0rlowski and carried to approve the minutes of the meeting of January 7, 1980, with the following amendment. On page 6 add E to A106-22 regarding the action of Briarcliff Sod, Inc. Motion was made by Mr. 0rlowski, seconded by Mr. Latham and carried to approve the minutes of the meeting of December 17, 1979, with an amendment to include the following resolution in the minutes. On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of E. M. Kontokosta was submitted to the Planning Board on October ll, 1979, and an application fee of $30 was paid on October ll, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on November 14, 1979 at 8:00 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, Now, therefore, be it RESOLVED, that the application of E. M. Kontokosta for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. and dated September 25, 1979 be approved subject to the following modifications, and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as listed below. Modification of said Plat to show the following oonditions of the Suffolk County Planning Commission: ~ ® e No residential structure shall be located within 100 feet of the mean high water line. No sanitary disposal facility shall be constructed or installed within 100 feet of the mean high water line. A conservation buffer or easement having a minimum width of at least 50 feet shall be established along the shoreline. No stormwater runoff resulting from the development and improvement of the subdivision and any of the lots shall be discharged directly into Gardiner's Bay. 5. No lot shall be subdivided in the future without the ~pprOval of the Planning Board. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham The Board was confused as to exactly what the Commission meant by the third condition; a letter will be written to them asking for clarification. On motion made by Mr. Wall, seconded by Mr. Orlowski, it was RESOLVED to delete the following from the resolution dated January 7, 1980 regarding the minor subdivision of Joseph Shipule located at Southold. "This approval is based on the condition of~ looa~ing the driveway on the northeasterly portion of the lot designated as number 2.'~ Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham The secretary was directed by the Board to write a letter to the building inspector requesting that he iSsue_a stop work. order on the construction of the Enights of Columbus meeting hall because the condition for requesting that the~uilding permit be issued was that a revised site plan would be submitted within two months~ It has now been three months and there has been no submission. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham A letter was read from Werner Adel regarding the possible abandonment of the interior of his subdivision known as "Greenbriar Acres." This letter will be referred to the Town Attorney for his a--~e. On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED to accept Report No ll4 of JohnW. Davis, Planning Board Inspector, said report dated January 14, 1980 regarding SeaBreeze Village at Greenport. Vote of the Board: Ayes: Raynor, Wall, 0rlowski, Latham The report will be forwarded to the building inspector and to Mr. Kontokosta.
