Jr. Southold, N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Monday, January 7, 1980, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Vice-Chairman Frederick E. Gordon Member Bennett Orlowski, Jr. Member G. Ritchie Latham, Jr. Mike Stahl, Suffolk Times Millicent & Arthur Gossner, League of Women Voters Absent was: Member James Wall Wa.yne Associates change of zone referral from the Town Board, Present were John Gillies, co-partner and attorney for the applicant; Pat Gemma, principal and architect; Mr. Medora, aSsistant to Mr.~G~m~ Wayne Associates is under contract to purchase the prop ~ from RObert .and Aldona Norkus subject to continued use Inn and improvement of: the property to the rear with fourteen uni on 6.2 acres. The density is approximately 2.2 units per acre. proposal will require no variances. They are amenable to any reasonable modifications that the Planning Board would consider feasible. Mr. Raynor appointed Mr. 0rlowski and Mr. Latham as a committee to make a field inspection of the property. Mr. Raynor asked if the developers would consider a restrictive covenant on the combined properties of the General Wayne Inn and the'land proposed for the change of zone regarding the density. The developer will'be required to improve Orchard Lane and the paper roads could be abandoned. In answer to who the principals are of Kew Realty, Mr. Gillies set for the names of Frederick W. Koehler, Eugene Koehler and William Tyree. Planning Board ~ -2- Ja~ ~ary 7, 1980 8:00 p.m. Public Hearing on the question of the approval of the minor subdivision of property of Thomas and Karen Uhlinger. Gary Olsen, Esq., and Thomas Uhlinger appeared. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Times. Mr. Raynor: In the file we have the short Environmental Assessment Form signed by Mr. 01sen representing the owner; There is a statement that no grading, other than foundation excavation for a residential building is proposed; no new roads are proposed and no changes will be made in the grades of the existing roads; no new drainage structures or alteration of existing structures are proposed. I have here the application for the approval of the plat and the description of the property. There is a check to the town and six copies of the proposed plan. In the file under dateof December 6th the board approved the sketch map of the subdivision. The only thing we are missing and the only action on the part of the board is a response from the Suffolk County Department of Health for the State Environmental Quality Review Act. Is there anyone present that would like to speak in opposition to the subdivision of Thomas and Karen Uhlinger. Hearing none, is there anyone present that would like to speak in favor of the minor subdivision of Thomas and Karen Uhlinger. Gary Olsen: I am the attorney for the applicants. This is not a very complicated matter. The total property is 2.0 acres and the Uhlingers want to divide it into two pieces each having an acre. The Planning Board gave approval to the sketch plan at its meeting of December and the final map conforms to the sketch map. If you have any questions we would be happy to answer them. Mr. Raynor: Is there anyone else that would like to speak in favor of this subdivision. Is there anyone present that would have some information in regard to this subdivision~ Mr. Latham, Mr. 0rlowski and Mr. Gordon, do you have any questions. Mr. Gordon: I would just like to mention one thing. When you appear before the building inspector on lot 2 he is going to question where the right-of-way is going to continue for 150 feet. There should be a dotted line to go 125 feet and back 25 feet. Mr. 01sen: We could have Van Tuyl put a dotted line in. The fee title of the right-of-way will be in parcel one. That is why the maps were changed, at your request. Mr. Raynor: You could go that route or just put the line in. It would be easier to dot in the line along the boundary line to the southeast. Anyone else have any information with regard to this subdivision. Hearing none, we will declare this hearing closed. Walter and Maril.ynGatz cluster subdivision. Richard Lark, Esq., and Mr. and Mrs. Gatz appeared. Mr. Lark requested a copy of the reports of John W. Davis, Planning Board Inspector, and Lawrence M. Tuthill, Planning Board engineer. The Planning Board will not recommend swales in this subdivision. Planning Board ~.~j -3- J~ary 7, 1980 The recharge basin will have to be located. Change roads to fifty foot width, i Lots 6 and 7 shouldhave driveways on new road. Common driveways should be provided for IT and 18,and 14 and 15. On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was RESOLVED to approve the lot layout of preliminary subdivision map of Walter Gatz at Mattituck as revised Nove,ber 8, 1979. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham on motion made by Mr. Gordon, seCOnded by Mr. Latham, it was RESOLVED that Southold Town Planning Board declare itself lead agency for the unlisted action of the subdivision of Walter Gatz as per the state Environmental Quality Review Act. Vote of the Board: Ayes: Raynor, GordOn, Orlowski, Latham Murphy-Raeburn minor subdivision. Present were Abigail Wickham, attorney for Baxter Properties, Inc.; George Stankevich, attorney for Murphy and Raeburn; Mr. and Mrs. Hanauer, prospective purchasers of the Murphy-Raeburn property; Lew and Debra Edson. The minor subdivision has been.approved subject to the County Planning Commission's condition~ and a dotted line be shown 150 feet into lot 3 for the right-of-way. The maps have not yet been received. The following information is to be transmitted to the Board of Appeals. It is the consensus of the Southold Town Planning Board that the Murph-Raeburn minor subdivision of property use the Baxter twenty foot strip for a distance of approximately 200 feet to go past the barns and house. At this juncture the right-of-way for the Murphy- Raeburn subdivision will continue on its own indicated sixteen feet not in common use with the Baxter Properties, Inc. subdivision. This recommendation is contingent upon written consent of Baxter Properties, Inc. Joseph Shipule. Public Hearing on the question of the approval of the minor subdivision of property of Joseph Shipule located at North Bayview, Southold. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Times. Mr. Raynor: We have in the file a description of the property and a check in the amount of $20 and application for approval ofplat. On the 14th of November, Southold Town Planning Board declared itself lead agency and has received a short Environmental Assessment Form. We will open this hearing and see if there is anyone present that has any objection to this subdivision. Is there anyone present that is in favor of the proposed minor subdivision. On motion made by Mr. Gordon, seconded by Mr. 0rlowski, Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Joseph Shipule is a two-lot residential subdivision of 2.520 acres located at Bayview at Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitte~ which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because it is more than 300 feet from tidal wetlands, it is not under the jurisdiction of the New York State Department of Environmental Conservation. The Suffolk County Department of Health Services has indicated that a precursory review of the project indicates that conditions are adequate for individual water supply and sewage disposal facilities. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land regulations. Further information can be obtained by contacting Ms. Muriel Tolman, Secretary, Southold Town Planning Board, Main Road, Southold, New York 11971. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham Mr. Orlowski moved for the adoption ~ the following. Mr. Latham seconded the motion and it was carried. WHEREAS, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Joseph Shipule was submitted to the Planning Board on November 9, 1979, and an application fee of $20 was paid on November 9, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on January 7, 1980 at 8:30 p.m., and Planning Board ~ .... -5- J~dary 7, 1980 WHEREAS, the.requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of~Joseph Shipule for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C., and dated Nevember l, 1979, be approved and the chairman be authorized to endorse approval on said subdivision Plat. This approval is based onthe condition of locating the drive- way on the northeasterly portion of thelot designated as number 2. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham On October 29, 1979, a resolution was passed to approve the site plan of Knights~of Columbus Council Hall, Marian Council #3852 subject to eight conditions. The Planning Board did not objectto the issuance of a building permit with the understanding that the principles will present an amended site plan within 60 days. The time has lapsed and the plans have not been submitted. Mr. Richard Cron, attorney for the applicant, is to be so informed. Macari. Howard Young and Robert Celic appeared. This map is to be sent to John W. Davis, Planning Board Inspector; Lawrence M. Tuthill, Planning Board Engineer; and Supt. of Highways Raymond C. Dean for comments. It is also to be routed to the Suffolk County Planning Commission. Mr. Young will send six more copies of the map. On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the site plan of Salvatore Loria and Philip Loria for proposed addition to connect two existing buildings, said plan 'dated January 3, 1980. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Mr. Latham moved for the adoption of the following. Mr. 0rlowski seconded the motion and it was carried. WHEREAS, the minor subdivision of property of Briarcliff Sod~ Inc. has had a public hearing by the Southold Town Zoning Board of Appeals on December 6, 1979 and has been granted a variance by that board, and WHEREAS, this waiver of the Subdivision Regulations is deemed to be in the public interest as a second public hearing is a duplication of effort in this matter, Planning Board _ -6- J~_~uary 7, 1980 Now, therefore, be it RESOLVED that pursuant to Article V Section A106-50 of Subdivision of Land of the Code of the Town of Southold that the application of B~iarcliff Sod, Inc. for a minor subdivision of property at Peconic be granted a waiver of Article II Section A106-22 of Subdivision Of Land of the Code of the Town of Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because it is more than 300 feet from tidal wetlands, it is not under the jurisdiction of the New York State Department of Environmental Conservation. The Suffolk County Department of Health Services has indicated that a precursory review indicates that conditions are adequate for sewage disposal facilities although problems may be encountered with obtaining potable water due to high nitrate concentrations in the area. The house on lot I is existing and the remainder of the area will be in sod farming. The project will meet all requirements of the Code of the Town"of Southold Subdivision of Land Regulations. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency for the State Environmental Quality Review Act for the unlisted action of the minor subdivision of property of Clement W. Booth located at Mount Beulah Avenue, Southold, map dated December 17-~979~ Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Lawrence M. Tuthill presented a memorandum to the Planning Board requesting that his fees for subdivision bond preparation and plan review be increased to $150 for the first ten acres and $5. for each additional acre. This fee is to include the various plan review and site inspections prior to approval. The Board will take Mr. Tuthill's request under advisement. Planning Board -8- O.~ary 7, 1980 On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the site plan of Ports of Seafood~ Inc. dated June 21, 1979 with inked-in addition that is proposed together with parking plan of Port of Egypt Enterprises, Inc. dated December 20, 1979 with letter of explanation from William H. Lieblein of Port of Egypt Marizie, Inc. said letter dated January 2, 1980. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the site plan of plan number M-4596 of Donald J. Brown, R.A., for property of Michelle Becker located on the northeast corner of Pike Street and Love Lane, Mattituck, subject to the following: 1. Outdoor lighting schedule. 2. Location of outdoor signs. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Latham, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in the unlisted action according to State Environmental Quality Review Act of the subdivision of property of "Mill Lane Building & Contracting Corporation" located at Mattituck. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to set 8:15 p.m., Tuesday, January 29, 1980 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the preliminary map ofthe subdivision of property to be known as "Mill Lane Building & Contracting Corporation". Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham The following letter was received from John Wickham under date of December 21, 1979 and read into the minutes. Mr. Henry Raynor, Chairman Southold Town Planning Board Southold, New York 11971 Dear Henry: Planning Board ~. -9- ~ ~uary 7, 1980 Suffolk County is closing title next week on the final contract for development rights on this farm. As I have told you in the past, I am interested in investing some of this money in other property and now have what amounts to an option to acquire a minor interest in Sebastian's Cove at Mattituck. This property fulfills my requirement of waterfront - since I sold waterfront development rights - and is small enough for me to handle. After the County pays, and after the first of the year, I expect to acquire something like a thirty-five per cent interest in this property. /s/ John Wickham cc: George Toumanoff Richard Lark, Esq. A map was presented for a minor subdivision of property°for Lange. Mr. Raynor requested that Mr. Gordon and Mr. Latham make an inspection~of the property and report back at the next meeting. On motion made by Mr~. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the site plan of Charles and Connie Lou Bocklet, map dated June 4, 1979, pursuant to Section 100-30 of Article III of the Code of the Town of Southold, for second dwelling/residence on single parcel of land. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Mr. Raynor Dresented a map in which he had designated the property on which development rights have been purchased by the County of Suffolk, property presently in the Southold Town Agricultural District and property on which bids have been made for the County to purchase under the Farmland Preservation Program. This information will be used to determine layout of roads in the Town of Southold.- There being no further business to come before the Board, Mr. Lathammade a motion, seconded by Mr. Orlowski and carried to adjourn the meeting.
