THIS DEED, made as of the 28th day of February, 2000,
between ELEANOR DIACHUN, residing at (no #) Peconic Bay
Boulevard, Laurel, New York 11948 and ROSE DIACHUN, residing at
875 School House Road, Cutchogue, New York 11935, Grantors, and
ELEANOR DIACHUN, residing at (no #) peconic Bay Boulevard,
Laurel, New York 11948, Grantee,

WITNESSETH, that the Grantors are parties in a Partition
Action filed in the Supreme Court, State of New York, County of
Suffolk, Index No. 99-14237, entitled, "Rose Diachun, Plaintiff
against Eleanor Diachun, Defendant", and pursuant to a Judgment
of Partition entered at an I.A.S. Term, Part XXXVIII, of the
Supreme Court of the State of New York, County of Suffolk on the
23rd day of February, 2000, the Grantors do hereby grant and
convey unto the Grantee, the heirs, successors or assigns of the
Grantee,
ALL that certain plot, piece or parcel of land, situate,
lying and being at Laurel, Town of Southold, County of Suffolk
and State of New York, and bounded and described as follows:
BEGINNING at a point on the southerly side of the premises
about to be described, which said point is distant the following
five (5) courses and distances from a concrete monument on the
northerly side of Peconic Bay Boulevard marking the southeast
corner of land of Anne Marie McVeigh and the southwest corner of
land of Eleanor Diachun: (1) running thence along the easterly
side of land of McVeigh North 250 40' 05" West, a distance of
200.00 feet to the northeast corner of land of McVeigh; thence
through lands of Eleanor Diachun and Rose Diachun: (2) North 760
44' 08" West, a distance of 58.86 feet; (3) thence North 190 45'
15" West, a distance of 141.32 feet; (4) thence North 440 51' 02"
West, a distance of 55.41 feet; and (5) thence North 330 49' 06"

running thence from said point of beginning along land being
conveyed herein South 690 59' 40" West, a distance of 66.73 feet
to the easterly side of Brushes Creek; thence along the easterly
side of Brushes Creek as it winds and turns the following three
(3) courses and distances: (1) North 710 33' 18" We,st, a
distance of 124.34 feet; (2) thence South 410 25' 25" West, a
distance of 68.44 feet; and (3) thence North 380 59' 21" West, a
distance of 90.32 feet to other land of Eleanor Diachun; thence
along said land and land of Half Hollow Nursery Realty Corp.
North 690 59' 40" East, a distance of 775.96 feet to a concrete
monument; thence still along land of Half Hollow Nursery Realty
Corp. South 200 00' 20" East, a distance of 130.00 feet to other
land of Rose Diachun; thence aloi{g said land South 690 59' 40"
West, a distance of 522.37 feet to the point or place of
BEGINNING. Containing 2.09 acres, more or less.
TOGETHER WITH a right-of-way for ingress and egress from the
above described premises to Peconic Bay Boulevard, which right-
of-way is bounded and described as follows:

above described premises, which right-of-way is bounded and
described as follows:
BEGINNING at a point on the southerly side of the premises
about to be described, which said point is distant the following
five (5) courses and distances from a concrete monument on the

corner of land of Anne Marie McVeigh and the southwest corner of

described premises the following two courses and distances:
(1) South 240 28' 58" East, a distance of 122.40 feet; and
(2) thence South 330 49' 06" East, a distance of 8.21 feet to
other land of Rose Diachun; thence along said land South 690 59'
40" West, a distance of 51. 49 feet to the point or place of
BEGINNING.
ALL as shown on the attached survey by John C. Ehlers Land
Surveyor, surveyed 12-07-99 and amended Jan. 24, 2000 (SCTM
'#1000-127-3-P/O 9; SCTM #1000-127-3-10; and SCTM #1000-127-8-
17.3) .
TO HAVE AND TO HOLD the premises hereunto granted unto the
Grantee, the heirs or Successors and assigns of the 'Grantee
forever.
