THIS INDENTURE, made the 25'h day of April, Two Thousand Two
BETWEEN
CHARLES RICHARD VANDUZER, residing at Parkway Drive, Southold, New York 1197 I,
party of the first part, and
WILLIAM J. SMITH, III and MARIJO E. SMITH, husband and wife, residing at 950 South
Harbor Road, Southold, New York I 197 I
party of the second part,
WITNESSETH, that the party of the first pati, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain .plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk, and State of New York, known and designated as Lot 3 on a
certain map entitled, "Map of Harvest Estates, Section 1", filed in the Office of the Clerk of
the County of Suffolk on 7/18/69 as Map Number 5337, said lot being bounded and described
as follows:
BEGINNING at a point on the westerly side of Grigonis Path distant 306.48 feet northerly
from the corner formed by the intersection of the northerly side of Jernick Lane with the
westerly side of Grigonis Path;
THENCE South 69 degrees 04 minutes 00 seconds West 140.64 feet;
THENCE North 23 degrees 23 minutes 50 seconds West 142.13 feet;
THENCE North 69 degrees 04 minutes 00 seconds East 146.75 feet to the westerly side of
Grigonis Path;
THENCE along the westerly side of Grigonis Path, South 20 degrees 56 minutes 00 seconds
East 142.00 feet to the point or place of BEGINNING.
TOGETHER with an easement over the streets as shown on said map, if not yet dedicated to
the Town of SOUlhold, and exception the reservation contained in deed dated July 19, 1969 and
recorded in the Suffolk County Clerk's Office in Liber 6589, cp 543.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Charles F. VanDuzer, dated May 29, 1980, and recorded June 3, 1980, in the
Office of the Clerk of the County of Suffolk in Liber 8831, Page 292.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as ifit read "pmiies" whenever the sense of this indenture so
reqll1res.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
