A regular meeting of the Southold Town Planning Board was held at
7:30 p.m. Monday, November 9, 1981 at the Town Hall, Main Road,
Southold, New York. Present were:
Chairman Henry Eo Raynor, Jr.

Member William F. Mullen, Jr.
Member Bennett Orlowski, Jr.
Member James Wall
Jon C. Kerbs/Lakowitz - Mr. Jon Kerbs met with the board to discuss
this proposal. It was noted the existing dwellings on this property
were in very poor condition and lack electrical and plumbing fixtures,
doors, etc. The board questioned whether it would be worthwhile to
move the structure from Lot ~2 Go Lot 94 as proposed. Mr. Kerbs stated
his intentions are to meet all the requirements of the Town to improve
it and plans to move this dwelling on wheels. The board noted the
four dwellings are on less than two acres of land and were in agreement
that the Building Department should make an inspection on this property.
Mr. Kerbs informed the board that he had received approval from the
Health Department. The board requested a copy of this report as soon
as possible. A review of the file will be made to determine when a
public hearing could be held.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled minor subdivision of Harold E. Tuthill was
submitted to the Planning Board on August 21, 1981 and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on September 28, 1981
at 7:30 p.m., and
WHEREAS, the requirements of the subdivision regulations of the Town
of Southold have been met by said subdivision Plat and application,

Now, therefore, be it RESOLVED that the application of Harold E. Tuthill
for approval of said subdivision plat prepared by Roderick VanTuyl, P.C.
dated July 9, 1981, be approved and the chairman be authorized to en-
dorse approval on said subdivision plat, with agreement of Suffolk County
Planning recommemdations.

The following was introduced by Mr. Latham, seconded by Mr. Wall and
carried.
Pursuant to Article 8 of the Environmental Conservation Laws
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code fo the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for the
action described below has determined that the project will not have
a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Harold E. Tuthill, is a two lot sub-
division, located at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental"assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
Because there has been no response in the allotted time
from the Suffolk County Department of Health Services it is
assumed that there is no objeciton nor comments by that
agency.
The project will meet all the requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

FIDCO Maps- The'board informed two Fishers Island residents of the
actions taken, at a special meeting held on Fishers Island, to release
building permits on four lots located at Fishers Island, and Chandler
Palmer and King will submit revised maps to the Planning Board reflecting
the additions and corrections.
On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED to include lots ~12 and ~29 inclusive for the approval of
the Building Inspector to issue CO's on the map entitled "Highland
Estates", located at Cutchogue.
Vote of the Board: Ayes: Raynor, Latham, Multen, Orlowski, Wall
Grandview Estates - Mr. Harold Reese appeared before the board to discuss
this subdivision. He stated his objection to the excessive demands on
the bond estimate submitted by Lawrence Tuthill, P.E. Because of the
difficulty in obtaining a bond, he would like to meet with the Town
Board to discuss this after it has been referred to them. He expressed
the high cost resulting from delays on road inspections after the work
has been completed. The board questioned the relation of removing a
building on this property as to whether this should have been included
in the bond estimate. Mr. Tuthill's recommendation for a deep and
shallow well differed from that of the Orient Fire Commissioners as
their letter dated October recommended a fire well on the Park and Play-
ground area -south corner of the recharge basin area, and the other on
Petty's Drive on lot ~17, both of which are in the 10 foot contour lines.
On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the bond estimate for Grandview Estates, dated November 8,
1981, be referred to the Town Board for their determination.

Hillcrest Estates - Mr. Reese submitted a letter from Brown's Hills
residents to the board. The letter suggested an alternative name be
considered for North View Drive as it will cause confusion with their
road named the same. It also rejected, unamiously, the request to use
their private road in case of emergency along with the necessary hook-
up of one of their roads. The Orient fire commissioners letter dated in
October recommended a fire well on lot ~29 and lot #24. It was the
concensus of the board that Mr. Lawrence Tuthill be asked to designate
his recommendations dated October 17, 1981 on the map for the board to
include recommendations on Heath Road, access to Browns Hills Road and
also to mark ~commende~ omissions.
On motion made by Mr. Orlowski, seconded by Mr. Wall, it was
RESOLVED that the subdivision entitled Rodney T. Buckham, located at
Mattituck, be processed as a set-off, 106-13

Mattituck Shopping. Center site plan - After field inspecting, the
con~mittee reported the traffic flow not being adequate and expressed
their concern with the increased summer traffic causing diffuculty
for emergency vehicles. It was the concensus of the board that the
proposed site plan, for the two banks, be amended to conform with
parking requirements and that a covenant be filed with the town. The
alternatives suggested were that, the retail area be reduces or to
change the use of one of the banks. The Building Inspector's report
dated November 9, 1981 was read and discussed regarding this. The
secretary was instructed to inform Mr. Cardinale and enclose a copy
of the Building Inspector's report. It was the concensus of the board
that Mr. Cardinale amend his site plan to conform with parking re-
quirements and file a covenant with the Town.
On motion made by Mr. Latham, seconded by Mr. Mullen, It was
RESOLVED that the Southold Town Planning Board remain in agreement
with Inspector Davis' report for road improvements on the subdivision
entitled" Robert C. Nelson, Jr.", located at Southold.

RESOLVED that the Southold Town Planning Board approve the sketch plan
entitled "Richmond Creek Farms", located at Peconic.

On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board forward-_the proposed
subdivision entitled "Richmond Creek Farms", located at Peconic, to
the Town Board for a determination on this Cluster Development under
the Town zoning.

The board noted the application for a subdivision of Richmond Creek
Farms had expired. The board will start the process of a subdivision
over. A committee was appointed to do a field inspecion on this prop-
erty November 19, 1981 and report their findings to the board at the
November 23rd meeting.
On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board grant an additional
extenSiOns- of two periods of ninety days beyond the 180 day period
'for the signature and filing of the subdivision map entitled ~r3__~.
Schmid, located at Fishers Island.

George K. and Ellen R. Conant minor subdivision - It was the concensus
of the board that the applicant submit new maps as those submitted were
insufficient.
On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the subdivision entitled "Armand Bartos", located at
East Marion, be processed as a set-offr 106-13, with a provision that
access be improved to the Planning Board's specifications, and covenants
and restrictions stating no further subdivisions on this property be
filed with the County Clerk and held in perpetuity.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the ZBA should not entertain an appeal (No. 2914) by
the applicant, Norman C. Boos, until such time as his proposed sub-
division is determined by the Planning Board.

On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the parking
layout on the map entitled D.M.S. Realty (Allan C. Dickerson, Appeal
No. 296) and forward it to the Building Inspector.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the property of Lenore Adamson, Appeal No. 2888 be
granted a set-off~ conforming with the lot lines set in the application.

RESOLVED that the Southold Town Planning Board would process the
subdivision on the property entitled Beatrice A. Geselle, Appeal No.2915,
as a set-off 106-13.

Sea Aire Estates - It was the concensus of the board to have John Davis
inspect this property for a temporary acqess road to lot 910, and re-
port his recommendations to the board, so that the applicant may begin
construction of a new home. The applicant, Mr. John Fillos, stated he
would absorb the cost for such road improvements.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that November 23, 1981 7:30 p.m., Southold Town Hall, Main
Road, Southold, New York be the next time and place for the Southold
Town Planning Board meeting.

RESOLVED to approve the minutes of Autust 12~ 1981 meeting of the

RESOLVED to approve the sketch map, dated July 6, 1981 and amended
October 15, 1981 on the minor subdivision of John Simicich, located
at Mattituck.

On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board declare itself lead
aqency in regard to the State Environmental. Quality Review Act for
the subdivision of property of John Simicichr located at Mattituck.
An initial determination of non-significance has been made.

John Simicich minor subdivision - It was the concensus of the board
that a letter be written to the acting attorney strongly urging a
restrictive convnant on lot ~2, as the proposed lot lends itself very
poor to future configurations to further subdivide and that the applicant
reserve a strip on the easterly border, in the width of 12% feet, for
possible future construction of a Town Highway.
On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was
RESOLVED that the applicants Dominick and Rose DeMaio comply with the
road inspection report ~201 upon which the Building Inspector could
issue a building permit for Lot 9136.

Myrtle Amott - It was the concensus of the board that the applicant
comply with the Building Inspector's report dated November 8, 1981
at which time the Planning Board can make a determination on the pro-
posed tourist home.
On motion m~de by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the applicant, Joseph S. Czartosieski, Appeal No. 2867,
2868, 2869, not be considered, as his proposals do not comply with the
Building Inspector's certification dated October 23, 1981.

On motion made by Mr. Wall, seconded by Mr. Orlowski, it was
RESOLVED that the subdivision entitled Rose Dansker, located at Peconic,
be processed as a set-off 106-13.

The board discussed the possibility of reversing the current procedure
held by the ZBA and Planning Board regarding the subdivision of under-
sized lots as a set-off or subdiviSion process. The tw~ boards will
meet to discuss this idea.

It was noted that the Southold Town Planning Board will meet with the
Town Board to discuss cluster zoning and a road extension November 18,
1981.
Mr. Lawrence Tuthill appeared before the board to ask if there were
any questions regarding his bond estimage on Grandview Estates. He
stated he is in possession of new f~bod plain maps, which have the ad-
dition of wave height, reduction of B a~ea, increased heights of A area.
He stated that he anticipates problems with the A area. Mr. Raynor
asked that copies of the maps be left in the office for the board mem-
bers to review.
On motion made by Mr. Orlowski, seconded by Mr. Raynor, it was
RESOLVED that the Building Inspector be notified that the slx month
time period has elapsed for Main Street Market to comply with site
plan.

Being no further business to come before the board, Mr. Orlowski made
a motion to adjourn seconded by Mr. Wall and carried. Meeting adjourned
9:25 p.m.
