Fee paid $15~00~ The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: The application is accompanied by a survey indicating that the applicant is the owner of a lot on Long Island So~ud on which the easterly dimension is approximately 657 feet$ the westerly side has 480' on one dimension plus 275' on another dimension. MRo GEORGE ~-ERS: The corporatio~ name is Skiny Dip Pool Cc., Inc. I thirzk the application pretSy well states the situation. Actually the only place to put the pool is on the west side of the lot. It could not be ~ut in the rear yard. TP~ CHAIRN~&N: The property was surveyed in 1933~ At that time there ~s erosion ~nd I w~nder how much has ooc~red since then~ It wms originally .887 acres to the line at So~d View Avenue. There is ~ mstonishi~ ~me~t of less here, ~bout one quarter acre. MP~. AP~ERS: I honestly don't know what they are doing to control it. THE C~.IR~V~: The ~rea to the east of the house is quite 1OWe MR. AHLERS: Yes, and there are wells and cesspool lines. THE CHAIR2~N: Is there anyone present who wishes to speak against this application? The findings of the Board are that the pool will be at least 300 feet from Sound View Avenue and at least 95 feet, plus or minus, from the westerly bo~u~dary of the property. The proposal is to add this garage on to dwelling toward Deep Hole Drive. The garage would still be $~ feet from Deep Hole Drive. REEVE: I am the applicant~ I would like te show you a s~rvey which I have drawn. (The Board and Mr. Reeve discussed the location of the garage as shown en ~{r~ Reove'$ s14~vey)~ THE CHAIRMAN: He obviously has difficulty locating a garage en t~t property° How long ago was that property divided? MR. HO~ARDTER~Y, Building Inspector: It was about five or six years age. Mr. Hawkins owned the two buildings,~on the two lots Mr. Gilde~sleeve laid out years ago. THE CHAIR)~N: Is there anyone present who wishes to speak against this application? There was no responses) After investigatie~ and inspection the B~ard finds that applicant requests permission to construct addition to dwelling (garage) with less than required sideyard, and will change setback on premises located on Deep Hole Drive~ Mattituck, New York. The findings of the Board are that the depth of the lot is substantial and that the garage will be located a distance of 80 plus feet from Deep Hole Drive. The Board agrees with the reasoning of the applicant. GEORGE APILERS: If you look at the site play. you will see that it ~uld be impractical to put the pool in the rear yard~ You would have wall to wall pool. ZIEGLER: I am making applicatiem because we tried to sell it as one unit and can net do so but there have been offers from local realtors ~ud outsiders asking to buy the present dwellings. However, we cantt sell them under the present conditions. MR. H0%fARD TERRY, Building Inspector: They had a change of zeno before they built cn the property° T~ CHAIRMAN: These dwellings are presently occupied seasonally and the proposal is to sell each one of these separately including your ew~house. ~. ZIEGLER: There are four buildingse Each ~t is 16' x 20'o THE C~aIRMAN: Do you propose to sell each whole building ~o ZIEGLER: They could be opened up and made into a r~nch housee The double is 24' ~ 48'~ two bedrooms, kitchen, living room and bath in each unit° Each unit has one kitchen and one bath, independent pump, heat, all year round construction. They ~e fully independent~ THE CHAiR2L~: How do you prodoss te divide the property? MR. ZIEGLER: ~e have laid a plan out~ ~e'are up on a hill~ (~ Ziegler showed plante the Board). THE CH~MA~N: The proposal is to split this into three lots. ~nat is the acreage? MR. ZIEGLER: A little less than three acres. We have 350~ on Bay Avenue. THE CHA_IR~aN: Tour house wot~ld be sold to a single individual~ They would all be sold to single individuals. Do you have buyers for this type of subdivisio~ of the property? MR, ZIEGLER: Yes~ $outhold Town Board of Appeals 1973 THE CHAIR~AN: The thing we would be concerned about would be the square footage of each of the -units, We have a requirement cf 850 sq, ft~ per dwelling unit. You would be a little under the requirement if they were goir~g to be used for year round dwellings, Fd~. Z!EGLER: In one instance a woman rents cottages down the street from us and she would be interested to purchase this, using it for the summer and hoping to !u~ve tenants in the winter, THE C~R~': ~ould she convert this into one ~it? FL~, ZIEGLER: Nc, She wants to use it as it is. THE CHAIR~LAN: We would, in effect~ be increasing the density. You have only rented during the $~er tourist trade, ~e would be ~mltiplyi~g the density from seasonal E. ZIEGLER: She is only interested in one ~nit but is trying to get someone to go in with her to buy this FLORENCE ZIEGLER: I can't see that there w~uld be any Tou could c~ll this cluster zoning. There is open THE CHAXRMAN: ~hen they talk about an acre ~ a half being minimumper ~nit in the Town of $outheld, I thi~kI would want to think about this a little longer before m~king a decision. MRS. ZIEGLER: ~hat about the La Grange property across the street? ~ne back unit is rented all year round, THE CHAIRM~N: ~e can't correct mistakes cf the past. MRS, EIEGLER: They were sold from summer rentals to all year round re~tals on a 50 foot lot. THE CHAIR~: ~e yeu h~ve a situation that existed prior te z~ning we can't control except as to how he divides it, which is why you are here tonight~ HR. ZIEGLER: ~e made application to ~ve the buildings spread out over the land which the Town Board would not give MRS. Fee paid The Chairman opened the hearing by reading the application~ for a variance, legal notice of hearing~ affidavits attesting to its publication in the official newspapers, a~d notice to the applic~nto THE CPLAIR~N: The sketch ih~rnished with the application indicates that the applicant ow~$ a build~ on the Main Read in ~ttituok~ at the corner of Sigsby Road, and proposes to enclose the side yard on Sigsby Road with a chain link fence~ also across the rear yard and coming back to the southwest corner of the building. THE C~IRMA~N: Is there anyone present who wishes te speak for this application? ~. $. LLOTD DICEERSON: I don't w~nt to put up m fence but that seems to be the only solution to do aw~y with vandalism and thievery. ~e ,have been having this tro~ble for seven er eight years and it's getting worse. $outheld Tow~ Board ef ~-ppeals -9- 1973 TP~ CHAIRMAN: Just how bad is it? MR, DiCKERSON: They steal the wheels and lights off beats and the wheels and lights off trailer$~ Kids threw ice cream a~o~nd so it takes a m~n tw~ or three hours to get it cleaned up, ~indshields are broken and upholstery torn. Each 7ee~ it is getting worse and we have to do sometb~ng~ ES. DICKER$0N: We had the po!ice twice in one week after we reported so much being stolen, TP~ CHAIRMAN: D~ you p!a~ te have a barbed wire lean-to arr~r4~ement? MR. DICKER-SoN: Ne, If someone w~nted to get in, they would get in whether we had barbed wire or nots At least a chain link fence w~ll keep the children out~ MR, HULSE: Do you plan on having a gate? MR. DiCKERSON: Yes~ one at the front entrance, a~d one on Sigsby Road, THE CPL&IRMAN: The sidewalk is about a foot outside your line. Could you bring a truck in this gate. MR, DICKERS0N: Yes, we could get a truck in either one of the gates. T~ CHAIRM~N: It seems to me that a 6 foot fence would be appropriate. ! am afraid a ~ foot fence would just be an invitation. I'm not even sure a 6 foot fence will do the job. THE CHAIR2~N: Is there anyone present who wishes to speak against this application? There was ne response.)
