Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Member Bennett Orlowski, Jr. 7:30 p.m. Public Hearing on the _qg~ss~i~nof the approval of the minor subdivision of Harold E. Tuthill, located in Southold. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: In reviewing this file, w~ have a receipt from the Town Clerk's office for the filing fee of Harold Tuthill in the amount of $50.00, copies of the legal notice, cQpies of the recommendations sent over to this board by the Suffolk County Planning Commission, read as follows: 1. No lot shall be subdivided or any lot line changed in any manner at any future date unless a~th0rized by the Southold Town Planning Board. 2. If Lot 1 is to used for residential use vehicular access to the lot shall be restricted to Boisseau Avenue. 3. If Lot 1 is used for commercial use vehicular access to the lot shall be located no closer than 50 feet to the westerly end of the curve that connects the southeasterly side of Middle Roa4 with the westerly side of Boisseau Avenue. 4. Any driveway for Lot 1 located on Boisseau Avenue shall be located in the southerly part of the lot near the southerly lot line. 5. All driveways that are created shall i~.have a turnaround provision, such as a T-shaped shunt, so that vehicles leavinq the site will not have to back out into the traffic stream on either road. Ail stormwater runoff resulting from the development and improvement of this property shall be retained on site by adequate drainage structures so that it will not flow out into Middle Road or into the intersection of Middle Road and Boisseau Avenue. 7. As is the procedure with this type of hearing, we will ask this evening if there is anyone present who would like to speak in opposition to this proposed subdivision? Hearing none, Is there anyone present this evening who would like to speak in favor of this proposed subdivision? Mr. if.Tuthill: Mr. Raynor, I would just like to state the fact, as I told you, there is no anticipated change of use. It is just going to be left as it is. My father is selling it to me just for my protection. There is no. We are not asking for any change of use or anything, at this time, some day later in the future, possibly something will be done with it, but there's no planned use at this point of anything being done with it, other~'~han gardening~as~t is now. Mr. Raynor: O.K. Thank you Mr. Tuthill. Is there anyone else present this evening who would l'ike to speak in favor of this proposed sub- division? Hearing none, Is there anyone present this evening that has some information pertaining to this property that should come be- fore this board at this time? Hearing none, Mr. Mullen, Mr. Latham, Mr. Orlowski, any questions? (Negative) Being no further questions, we will deem this hearing closed Thank you for coming down. ' (3) 9/~ ~ /81 Grandview Estates It was the concensus of the board to forward Mr. Tuthill's recommendations to Supe~nt~3~ Highways, Raymond Dean for his comments. It was noted that Mr. Dean had previously approved the road layout as stated in his letter of June 50, 1981. Norman C. Boos - Mr. Stephen Griffing, Esq. appeared on behalf of his client. The board requested that Mr. Griffinq submit to the office, prior to October 12, all information regarding this sub- division, including ZBA approval in 1972, DEC septic system approval, and Health~Department approval because the area in question is less than 40,000 square feet and is ½ marina. Bucci Corners - Has received ZBA approval subject to the Southold Town Planning Board approval and County Planning referral. Mr. William Smith expressed disapproval on the drawn out procedure of separating this property. He suggested that the Town Board, Planning Board, and the Town Attorney have a meeting to resolve this problem, as two to four months is an unnecessary delay just to separate two buildings for the sale of one. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold TOwn Planning Board declare itself lead agency._under the State Environmental Quality Review Act on the m~nor subdivision entitled Bucci Corners, located in Southold. An initial determination of non-significance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Jon Kerbs Lakowitz minor subdivision - Mr. Kerbs appeared before the board stating that Mr. Royal R. Reynolds did not seem to think there would be a problem with the water on this property. Mr. Raynor requested that Mr. Kerbs furnish the board with a copy of the results on the water study. Mr. Mullen and Mr. Orlowski were appointed to do a field inspection and report their findings to the board at the October 19 meeting. Mr. Kerbs informed the board that time was a critical factor, as the owner of the property is in bad health. Pietrodangelo's off-street parkinq - On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept the Inspector's report on the Pietrodangelo's Floral Shop off-street parking with agreement of the installation of a catch basin, if necessary, during the one year review. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski L~ng Island Nurseries - It was the concensus of the board that Mr. Benjamin Kasper schelule an appointment to meet with the board at the October 19 meeting to discuss the Suffolk County Planning recom- mendations disapproving this minor subdivision. (4) ~'~28/81 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board Approve the minor subdivision entitleA Marie Cassid¥, located in Arshamamaque, sub- ject to mov~nq the lot lines and turnaround due to wetland area. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orl'owski The following was introduced by Mr. Orlowski, seconded by Mr. Latham: Pursuant to Article 8 of the Environmental COnservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Sedtion 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Marie Cassidy is a four lot subdivision located in Arshamamaque. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands. The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. DESCRIPTION OF ACTION The minor subdivision of Robert C. Nelson, is a two lot subd±vzsion located at Bayview, Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as p~anned. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the ZBA referral of Southold Marine Center Holding Corp. be processed as a new subdivision. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski The Cove - It was the concensus to the board that the clients schedule an appointment to meet with the board at the October 19, 1981 meeting to discuss the Building Inspector's report. Mattituck Shopping Center - It was the concensus of the board that Mr. Cardinelli schedule an appointment to meet with the board at the October 19, 1981 meeting to discuss the Building Inspector's report. Mattituck Inlet Advisory Committe~ the committee is going to revise their letter, asking this board to expand the idea for any natural resource.~inventory and water shed program the county has done. The attorney,s agree_%hat this cannot be confiscated. It must be applicable to the entire township, not just the commercial properties at the mouth of Mattituck Creek. The committe has sent recommendation to the Town Board stating that as negotiations to purchase the tank farm property of Martin Carey have been stagnated, that the Town Board go on record as going through the process of condemnation. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that October 19~ 1981 7:30 p.m. will be the next meeting of the Southold Town Planning Board at Southold Town Hall. Vote of the Board:~ Ayes: Raynor, Latham, Mullen, Orlowski Smith~, Carter~ Blanchard It was the concensus of the board that an inquiry!~ be made, in the form of a letter, as to the purpose for the change of name from Richard A. Howard and Dorthsa E. Howard to Richard A. Howard and Martha Howard. (8) 9/28/81 On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board override the Suffolk County Planning recommendation number ten on the minor subdivision entitled Nina Stevens, located in Cutchogue. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board comply with the Suffolk County Planning Commission comments number three and number four, on the minor subdivision entitled Nina Stevens located in Cutchogue. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the chairman be authorized to endorse his signature approving the final map on the minor subdivision entitled Nina Stevens, located in Cu.tchogue, subject to the receipt of filing fee. Because there has been no response in the allotted time from the Suffolk County Department of Health Services it is assumed that there is no objection nor comments by that agency. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Mrs. Susan Long, Secretary, Southold Town Planning Board, Main Road, Southold, New York 11971 Edward Speeches - The field inspection committee reported their findings to the Board in regard to this property. It was noted that a portion of this property may not be s~itable for building because of questionable marsh area~ It was the concensus of the board that Mr. Bruer, acting~attorney, schedule an appointment to meet with the board at the October 19, 1981 meeting, and request that a builable line be put around the marsh area and that be deleted from the base of construction for the cluster. The board also recom- mended that a letter be forwarded to the Town Board for Cluster Development under the Town Zoning. Fishers Island Maps - The maps are to be studied by this board for their approval, at a later meeting, for the release of building permits on Fishers Island. Ruth Oliver inquired about the progress of Brecknock Hall, and the question on any proposal due to the sale of Orient Point property. She also expressed her concern for preserving farm land. The Brecknock Hall proposal is still in the process of changing the num- ber and location of units~. The Orient Point property has been pur- chased, with no information pertaining to its plan, in our office. Being no further business coming bef0~aethis board, Mr. Orlowski, made a ~otion, seconded by Mr. Latham, and carried to adjourn the meeting.
