Mullen, Jr. TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Monday June 1, 1981, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member Bennett Orlowski, Jr. Member G. Ritchie Latham, Jr. Member James Wall Member William F. Mullen, Jr. Ruth Oliva, President, North Fork Environmental Council Millicent Gossner, League of Women Voters 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of Vincent. G.~arnaschell~ located at Arshamomaque. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Times. Mr. Raynor: In reviewing the file, copy of the deed, notice of this meeting, letter from the Suffolk County Department of Health Services it is requested we have reviewed the reference property for water supply and sewage disposal conditions and notice this area has a high history of poor soils, clay and unlimited water supply. Satisfactory test wells and test holes would normally be required prior to approval. Signed by Royal R. Reynolds. Public Health En- gineering, General Engineering Services. Copy of legal notice, short environmental assessment forms signed by the applicant Vincent Guarnaschelti. Correspondence in this board to New York State DEC with the regard to the State Environmental Quality Review Act, car- rying this board as lead agency. Correspondence of reapplication, copy of the applicants approval for the plot, statement pertaining -.~to grading going to the Suffolk County Planning Commission regarding roads, grading; and drainage. Copy of the existing tax map. This is a two (2) lot minor subdivision, containing approximately 14.0 acres per each lot. As is the policy of this board, we will ask this evening, is anyone present who would like to speak in opposition to the propoSed minor subdivision of Vincent Guarnaschelli. Mrs. Copin: And Vincent Guarnaschelli is taking this part and his son-in-law that part, I would assume? Mr. Raynor: I have no idea. Mrs. Copin: You have no idea? Mr. Latham: That has not been ruled. Mrs. Cassidy: These fourteen (14) acres are broken up into two minor subdivisions? Mr. Raynor: Two (2) lots. Mrs. Cassidy: Two (2) lots? Mr. Raynor: Within one (1) minor subdivision. Mrs. Cassidy: One (1) minor subdivision. Mrs. Copin: Do you know where the minor subdivision will come in? Mr. Raynor: Mrs. Cassidy: sion. That's the whole parcel. Mrs. Cassid~: Surely, Andrew and Marie Cassidy, and we have property adjoining Mr. Guarnaschelli also. Mr. Raynor: Property to the east. Mrs. Cassidy: Yes. Mr. Raynor: Alright, is there anyone present this evening who has a specific objection to this subdivision? Hearing none, is there anyone present this evening who would like to speak in favor of this proposed subdivision? Hearing none, is there anyone present this evening that has some information to come before this board at this time concerning this subdivision? Hearing none, Mr. Mullen, questions, Mr. Wall, Mr. Latham, Mr. Orlowski? (all negative). Alright, there being no further questions, we'will deem this hearing closed. Marie Cassid¥ minor subdivision. The proposal of .this subdivision is being reactivated. Mr. Raynor would like Mr. Mullen and Mr. Latham to make a field inspection of this property and report back to the board before the board takes action. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was Resolved that the Southold Town Planning Board declare itself lead agency in the matter of the minor subdivision of Marie Cassidy located at Arshamomaque under the State Environmental Quality Review Act. An initial determination of non-significance has been made. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen Highland Roads. Mr. Raynor had a meeting with the field inspector on May 29, 1981 and also Mr. Raynor and Mr. Mullen did a field in- spection on the the property. It was determined that there had been further improvements made and Mr. Davis will supply the board with recommendations in a report form as to whether the board should lift its band on building permits. Mr. Mullen also brought up the fact of looking into the adequacy of the security bond. 7:45 p.m. Public Hearing on the question of the approval of the minor subdivision of the Estate of Henry Jennings located at Southold. Mr. Orlowski made a motion, seconded by Mr. Mullen and carried to dispense with the reading of the metes and bounds description. Mr. Raynor presented proof of publication in the Suffolk Times. Mr. Raynor: In reviewing the file I find the filing fee in the amount of $50 with receipt from the Town Clerk s Office. Corre- Planning Board -4- June 1, 1981 spondence from the Suffolk County Department of Health Services re- garding the SEQRA, correspondence to the Suffolk County Planning Commission, copy of the legal notice, metes and bounds description, correspondence from the applicants attorney, sketch plan approval for this subdivision on March 26, 1980, I would assume it is March 1981, also declaration of lead agency status with Southold Town Planning Board, application for approval of plot, short environmental assessment form. This completes the file. This is a tract of prop- erty that's being divided into two. The tract of property consists of fifty-nine and one-half (59½) acres, one plot being thirteen acres to the north, the second plot being fourty-six acres to the south. As is the procedure of public hearings, I will ask is there anyone present this evening who would like to speak in opposition to this proposed minor subdivision of the Henry Jennin~s Estate? Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor subdivision of the Henry Jennin~s Estate? Rudolph Bruer: ©n_behalf of the estate, I would just like to re- irradiate what I spoke to you gentlemen earlier on the site plan approval. The purpose, I represent the estate whose selling it subject to the division of the property, we've been advised by the proposed purchaser, a Dry. Damianos, that it would be used for grape growing purposes and the purpose of the splitting of it is that the larger piece is going to be used as a farm. Respectively, we ask the board to allow the division of the property, thank you. Mr. Raynor: Is there anyone else present this evening who would like to speak in favor of this proposed subdivision? Is there anyone present this evening that has some information that may be neither pro nor con but should come before this board at this time? Hearing none, is there any member of the board that has any questions? Mr. Orlowski, Mr. Latham, Mr. Wall, Mr. Mullen? Ail answered in the negative. Mr. Raynor: There being no further questions we will deem this hearing closed and thank you for coming down this evening. Milton Mehlman minor subdivision. John Strong appeard before the board to discuss with them his request that the right-of-way be changed from 50 feet to 25 feet. The board feels that 50 feet for the right-of-way is needed if not at this time but for the future. Mr. Raynor opened the hearing. - Mr. Raynor: The reason for the recess of the public hearing was a result of the board's determination that part of the existing proP- erty ran both in the A use and C commercial use creating an under~ sized lot which was orginally shown as lot three (3). Since then~ the applicant has amended his application for section 1. Showing] the A residential area only in section 1. On a motion made by Mr. Wall, seconded by Mr. Mullen, it was RESOLVED to approve the Section 1, Fishers Island Utility Co. proposed minor subject to consideration to the Suffolk County Planning Commission. Vote of the Board: Ayes: Raynor, Orlowski, Wall, Mullen, Latham On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED subject to the Superintendent of Highways getting a Town Board and Planning Board approval of waiver during construction of Hon~y~]e H~]]~ for use of this type top coating. The board would approve this roadway should it have a width of no less than twenty+eight (28) feet. Vote of the Board: Ayes: Raynor, Orlowski, Mullen, Latham, Wall On motion made by Mr. Wall, seconded by Mr. Mullen, it was RESOLVED to set 8:30 p.m., Monday, June 22, 1981 at the Town Hall, Main Road, Southold, New York as the time and place for a public hearing on the question of the approval of the minor sub- division of Nicholas Fontana located at Mattituck. Vote of the Board: Ayes: Raynor, Orlowski, Mullen, Latham, Wall On motion made by Mr. Orlowski, seconded by Mr. M~llen, it was RESOLVED to approve the site plan for a setofffof a two-family dwelling on the property of Peconic Corporation. Vote 0f the Board: Ayes: Raynor, Orlowski, Mullen, Wall, Latham Emanuel M. Kontokosta. With the exclusion of the marina on the pro- posed application of Emanuel M. Kontokosta for special exception, the Planning Board concurs with the findings of the Southold Town Zoneing Board of Appeals with regard to the environmental assessment form filed with them by the applicant. On motion made by Mr. Wall, seconded by Mr. Mullen, it was RESOLVED to approve the site plan of the Church of the Open Door. Vote of the Board: Ayes: Raynor, Orlowski, Wall, Mullen, Latham Planning Board -9- June 1, 1981 On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED to approve on Harbor Lights, Section IV, subject to the boards resolution of May 11, 1981 and receipt of letter of Superintendent. of Highways approving the road layout as finally submitted. Vote of the Board: Ayes: Raynor, Orlowski, Mullen, Wall, Latham On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED to deny without prejudice the waivers and proposals of the developers of Bayside Farms. Vote of the Board: Ayes: Raynor, Orlowski, Mullen, Wall, Latham On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED to approve the parking plan for Fishers Island Beach Club. Vote of the Board: Ayes: Raynor, Orlowski, Mullen, Wall, Latham Driftwood Cove. Letter being sent to Building Inspector. Until we receive reply no determination can be made in regard to the parking of Driftwoo~ Cove. Thompson. A letter being sent to the Building Inspectors Office stating that the board needs to know what is applicants future intent and also what are the dimensions of the parking area. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED to approve the minutes of May 11, 1981. Votepof the Board: Ayes: Raynor, Orlowski, Mullen, Wall, Latham Highland Roads. Decision to authorize the building inspector to issue permits in order that action may be taken. Planning Board ~_~ -10- June 1, 1981 Mr. Raynor stated that the board members should keep in mind the fact that, should Penny and Johnson have a division of the wa~s, it should be approved that there should be fifteen (15) feet on each side of the right-of-way. There being no'further business to come before the board, Mr. Orlowski made a motion, seconded by Mr. Mullen and carried to adjourn.
