WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
e$nsideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns ofthe party of the second part forever,
AI.L THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being in the Village of Greenport, Town of Southold, County of Suflblk and Sate of
New York, bounded and described as follows:
South by Front Street, 90 feet;
East by lands formerly of P.W. Clifford, 141 feet;
North by lands formerly of Cook, 39 feet 9 inches; and
West by land now or formerly of Evelyn Jaeger, 149 feet 6 inches;
Said dimensions being more or less.
BI':.ING AND INTENDED TO BE thc same premises conveyed' to thc party of thc first part by
deed dated June 11, 1987. and recorded in the Suftblk County Clerk's Office on June 26, 1987,
in Liber 10351, Page 157.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to thc party ofthe first part.
THE PAR'fY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of thc first part's
descendants, in any degree, whether presently living or bom hereat~er, in such proportions and
amounts, without reg',u'd to equality, outright or in trust, as the party of thc first part may direct
and appoint during their lit~etime by a properly written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appointment. 'l~e party of the
first part may not appoint themselves, their estates, their creditors or thc creditors of their estate,
under any circumstances.
THIS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained in a certain prior deed in respect to the above-described premises dated
December 4, 2003, reeorded in the Suffolk County Clerk's Office on January 26, 2004, in
Liber 12297, Page 363~ and it is further stated that the party of the first part continues to
reserve a special power of appointment as hereinabove set forth.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting thc above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO IIAVE AND TO HOLD thc premises herein granted unto thc party of the second
part. the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encun~bered in any way whatever, except as
aforesaid.
AND the part)' of the first part. in compliance with Section 13 of'the Lien Law, covenants that
the party oftbe first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be. applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of thc improvement
before using any part of the total of the same for any other purpose.
Thc word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
