N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Thursday, February 26, 1981, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member James Wall Member Bennett Orlowski, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Ruth Oliva, North Fork Environmental Council Arthur and Millicent Gossner, League of Women Voters 7:30 p.m. Public Hearing on the question of the approval of the final map of the subdivision to be known as "Mount Beulah Acres" located at Southold. William H. Price, Jr., Esq. appeared on behalf of the applicant in place of Rudolph Bruer, Esq. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: Going through the file I have from the town engineer a bonding amount in the amount of $20,000 for the proposed road of Cosden Court. From this board is a negative declaration under the State Environmental Quality Review Act. There is correspondence from this board to the Superintendent of Highways, profiles of Cosden Court, further correspondence: to Mr. Bruer, copy of the legal notice, correspondence to the attorney, original recommendations from the engineer, copies of correspondence, preliminary sketch maps, correspondence to this board from the Suffolk County Planning Commission, correspondence from the Department of Health Services. "This Department has no objection to your designation as lead agency. A precursory review of the above referenced subdivision indicates problems may be encountered with obtaining potable water due to high nitrate concentrations and pesticide contamInation. In addition, special consideration will have to be given to the sewage disposal systems due to poor soils in the area." Planning Board -2 .... February 26, 1981 Mr. Raynor: There is more correspondence pertaining to the State Environmental Quality Review Act, receipts from the town clerk's office in the amount of $70 and the application. As is the procedure we will ask if there is anyone present this evening that would like to speak in opposition to this proposed subdivision entitled "Mount Beulah Acres". Hearing none, is there anyone present this evening that would like to speak in favor of this subdivision. William H. Price, Jr., Esq.: I am an attorney from Greenport and of counsel for Rudolph H. Bruer this evening. I am here to answer whatever questions I might. However, I would like to point out in regard to the ~epartment of Health Services statement regarding the nitrate levels that I know that in other subdivisions they have come to the conclusion that it is possible to treat certain nitrate levels with filtraticn systems and should this come in over ten parts per million that a condition will be placed on the map stating that no dwelling shall be occupied prior to the potable water being present. Mr. Raynor: Is there anyone else that would like to speak in favor of the proposed subdivision. Hearing none, is there anyone present that would like to speak either pro or con for informational purposes. Hearing none, is there any member of the board that has any questions. Mr. Orlowski, Mr. Latham, Mr. Mullen, Mr. Wall? Ail answered in the negative. Mr. Raynor: There being no other questions we will deem this hearing closed and thank you for coming down this evening. Robert Bayley minor subdivision. Robert Gillispie III appea~ed on behalf of'Mr. Bayley. He has applied to the Zoning Board of Appeals for approval of access to the subdivision. Mr. Raynor said the policy of the board is to provide a 25 foot wide right-of-way inside the subdivision. Mr. Gillispie stated the area is treed and asked if they would have to clear the 25 fset. The inspector will be sent out after approval of access has been obtained from the Zoning Board of Appeals and he will make his recommendations to the board. Mr. Bayley doesn't have control of the 700 feet going to the property. The Planning Board will wait the decision of the Zoning Board of Appeals. On motion made by Mr. Wall, seconded by Mr. Orlowski, it was RESOLVED to set 8:00 p.m., Tuesday, March 17, 1981 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the m~nor subdivision of Smith/Carter/Blanchard located at Fishers Island. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen Planning Board .... -3- ~ jFebruary 26, 1981 motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED to approve the sketch map of the minor subdivision of Genevieve L. Richards located at Arshamomaque, said map dated April 22, 1980 and amended January 21, 1981. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen 8:00 ).m. Public Hearing on.the question of the approval of the minos subdivision of Nina stevens located at Cutchogue. Richard Cron Esq. appeared. Mr. aynor read the legal notice of hearing and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: Going through the file, there is a resolution from this board setting tonight as the date for the public hearing, a copy of the 1Dgal notice, statement concerning grading, drainage and roads filed by the applicant's attorney. There is a declaration of lead agency status of this board on November 26th, correspondence from the appli.~ant's attorney, short environmental assessment form, correspondence from ~his board to the New York State Department of Environmental Conservation in regard to the State Environmental Quality Review Act and more correspondence to this board. It is the policy of this board to ask if there is anyone that would like to speak in opposition to the proposed subdivision of Nina Stevens. Hearing none, is there anyone present this evening that would like to speak in favor of the subdivision. Richard Cron, Esq.: Just simply, I believe all the requirements of the board have been complied with and that the subdivision being only a minor subdivision with more than sufficient area as required by the zoning ordinance, I would respectfully request that the board approve this as a minor subdivision. Mr. Raynor: Is there anyone else present that would like to speak in favor. Is there anyone present that has any information that should come before this board at this time. Any action will be subject to county recommendations which have not come back yet. For some reason I can't find the building setback line. Mr. Cron: For some reason it would appear it has not been put on it. I think we had it on the major. Mr. Raynor: When it was changed over somehow it wasn't put on. We will need it on. Mr. C~on: It should be no problem. I would support it. Mr. Raynor: Mr. Wall, Mr. Mullen, Mr. Latham, Mr. Orlowski, any questions. Ail answered in the negative. Mr. Raynor: There being no questions we will declare this hearing closed. Planning Board ~y -4- February 26, 1981 Main Street Market parking plan. Provision for off-street parking is the determination of the Planning Board in accordance with Section 110-112 of the Code of the Town of Southold. The Board shall determine what is reasonable and appropriate parking require- ments. Mr. Raynor suggested that the entrance be at the Main Road approximately 25 feet northeast of the corner of the building; that the exist be only at the Main Road approximately 250 feet from the intersection of Young Avenue and the Main Road; all remaining areas along the Main Road be restricted for vehicular access; all truck loading be on Youngs Avenue only with no car traffic from the south- west corner of the building to Youngs Avenue. Mr. Orlowski did not agree with the suggestion stating that this had not worked out at Keyfood in Cutchogue. He suggested there be an alternate plan and was asked by the chairman to bring his suggestions back to the next meeting after an inspection of the property. 8:15 p.m. Public Hearing on the question of the approval of the minor subdivision of Martha Husing located at Laurel. John McNulty, Esq., appeared on behalf of the applicant. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: In the file we have description of the property, correspondence from this board to the applicant's attorney setting tonight for the hearing, copy of the legal notice, correspondence from the applicant's attorney, applicant's attorney's statement with regard to roa~s, drainage and grading, copy of applicant's application, copy of State short environmental assessment form, copies of correspondence from this board to the applicant's attorney approving the sketch plan, correspondence from this board in regard to the grading, correspondence from this board to the New York State Department of Environmental Conservation in regard to the State Environmental Quality Review Act, more correspondenc~ going back from the applicant's attorney with regard to the County Planning Commission's requirements, some sketches. As is the procedure with this board is there anyone present this evening that would like to speak in opposition to the minor subdivision of Martha Husing. Hearing none, is there anyone present this evening that would like to speak in favor of the minor subdivision of Martha Husing. Mr. McNulty: On behalf of the applicant, if the board pleases, this is approximately a 75 acre parcel in Laurel running from the Old Main Road to Peconic Bay Boulevard. Mrs. Husing proposes to sell parcel 2 which contains 2.41 acres. As the board realizes, under the requirements of the Town of Southold she must~obtain approval from this board in order to sell off a parcel and that is the purpose of the application. I will answer any questions if you have any. Mr. Raynor: Is there anyone else present this evening that would l~ke to speak in favor of this minor subdivision. Is there anyone that has any information that should come before this board this evening at this hearin9~. Hearing none, the only thing that comes to mind is because of the proximity of this parcel 2 to freshwater wetlands the applicant should be advised that perhaps a Department Planning Board ~ -5- February 26, 1981 of Environmental Conservation wetlands permit would be necessary. has nothing to do with the subdivision but before you get started you might find the problem. Mr. Orlowski, Mr. Latham, Mr. Mullen, Mr. Wall, do you have any questions. It Mr. Wall: We are dealing with one and two. How come the coordinates do not have to be read off and just distances are on the map? Mr. McNulty: Under the Suffolk regulations according to the document that said you can prepare a map of the larger parcel from the tax map. We went through this thing and to survey it~with courses and distances would cost the applicant around $1,000 and we checked with Van Tuyl and they checked it and a large parcel like this this is acceptable to the County Planning Commission and the cost is nominal. Mr. Raynor: Is there anyone else. Hearing none, I will deem this hearing closed. On motion made by Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED to set 8:15 p.m., Tuesday, March 17, 1981, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Reynold F. Blum and William A. Littel] located at Cutchogue. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED to set 8:45 p.m., Tuesday, March 17, 1981, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Peconic Bay Gardens located at Peconic. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen Fishers Island Development Corporation. Mr. Richard Baker has sent to the Board information on lots which were subdivided on the old deeds but shown as one block on the 1929 Olmsted map. Mr. Wall will request maps from the FIDCO people showing these divisions. Edward Booth cluster subdivision. Mr. Booth will be requested to have a survey made up showing two foot contours so that the board can determine land subject to flooding not to be used as a base for lots in the cluster. Planning Board ..... -7- ?ebruary 26, 1981 8:45 p.m. Public Hearing on the question of the approval of the preliminary map of the subdivision to be known as "Grand View Estates" located at Orient. Harold Reese appeared before the board. Mr. Raynor read the legal notice of hearing and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: Looking through the file we have the recommendations from the tcwn engineer under date of February 20th, correspondence from this board to the applicant stating it is lead agency, further correspondence from this board stating the resolution for this hearing tonight, legal notice of hearing, check from the applicant in the amount of $260 along with the application, more recommendations from the town engineer, correspondence from the Suffolk County Department of Health Services. "Your application has been denied by the General Engineering office because there is an inadequate water supply (less than 40 feet of potable water in the well casing). In addition, test well Number 3 contains nitrates in excess of the present drinking water standards (11.2 mg/1). "A review of your case has been scheduled at the County Center building, Riverhead, in the Suffolk County Department of Health Services Conference Room 2nd floor, North Wing, on January 29, 1981, at 1:30 p.m. "You and interested parties may appear with or without consel and you may produce any information or evidence concerning the above referenced subdivision." There is a resolution giving this application sketch plan approval December 29th. That pretty much completes the file. As is the procedure with this board is there anyone present this evening that would like to speak in opposition to the subdivision of Grand View Estates located at Orient. Hearing none, is there anyone present this evening that would like to speak in favor. Hearing none, is there anyone present this evening that has any information that should come before the board at this time. Mr. Reese: The Highway Department made several recommendations. At a meeting yesterday they made several more recommendations. They were submitted to Mr. Dean this morning and he said he would approve the maps. Secretary: Mr. Dean called the office and said everything was in conformance with what the highway department wanted. Mr. Raynor: I was under the impression that this was settled. Mr. Reese: On the spur road of 60 feet we thought perhaps because the road doesn't go anywhere that just a right-of-way be granted to eliminate a lover's lane for bottles and so forth. Mr. Raynor: We will take that into consideration. Mr. Reese, is there anything else that you have that should come before us. Planning Board <y -6- ~February 26, 1981 On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED to approve sketch map dated August 25, 1.970 and amended December 9, 1980 of the minor subdivision of property of the John Simon Estate located at Peconic subject to the right-of-way being shown 25 feet wide and suitable for all weather conditions, the surface being graded smooth (ruts filled, etc.) and 6 inches of compacted bankrun sand and gravel (gravel to be 20%) placed for a width of 12 feet. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED to recommend to the Southold Town Board bond estimate prepared by Lawrence M. Tuthill, Town Engineer, in the amount of $20,000 for the roads and improvements in the subdivision to be known as "Mount Beulah Acres" located at Southold. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen Edward Booth cluster. Mr. Booth appeared at this time. He was informed that the board would like a survey with two foot elevations to determine .what land would be subject to flooding. There seems to be a problem with some of the p~operty and the board wants to take a better look at it. On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED to set 8:30 p.m., Tuesday, March 17, 1981 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Donald P. Robinson, Dorothy R. Binns and Marion R Mears located at Cutchogue. Vote of the Board: Ayes: Raynor, Wall, Orlowski, Latham, Mullen New highway specifications were hand delivered to the Board office this afternoon by Deputy Superintendent of Highways Raymond Jacobs. A copy was given to each member of the board and Mr. Raynor requested the board to study same and make any recommendations and comments at the next meeting. Harbor Lights, Section IV. The turnaround has been shown on the maps and it was the consensus of the board that the maps were now alright and Mr. Reese can draw up the final maps to be presented to the board for the final hearing. Planning Board -8- February 26, 1981 Mr. Reese: Ail the conditions, to the best of my knowledge, have been complied with. Mr. Raynor: Grand View Estates is a corporation? Mr. Reese: No, a partnership and all the principles are listed. Mr. Raynor: Ronald, Christine and Harold Reese, Jr.? Mr. Reese: Yes. Mr. Raynor: We needed that because it doesn't show on the map and we needed it for the hearing. Any questions, Mr. Orlowski, Mr. Latham, Mr. Mullen, Mr. Wall? Ail answered in the negative. Mr. Raynor: If there is no other business we will deem this hearing closed. George Penny IV minor Subdivision of property of Hahn on Soundview Avenue, Southold. Mr. Johnson appeared with Mr. Penny. Mr. Penny distributed maps to the board members. This is a six acre parcel owned by Mr. Hahn. Mr. Penny has a letter from Mr. Hahn in whic~ Mr. Hahn gives Mr. Penny authority to act in his behalf as regards this subdivision. Mr. Penny will send the letter to the board. This property was split before but is now in Mr. H~hn's possession. Mr. Penny's future plans are to divide each parcel into three parcels. Mr. Raynor said the property would have to be inspected with respect to any type of cross-street that might be needed. The first step is the subdivision into two parcels. Sebastian's Cove. The recommendations of Jack Davis regarding the stone-lined gutter and so forth were reviewed. The stone-lined gutter will require a waiver from the Planning Board and approval of that waiver from the Highway Committee. Because three of the members of the board have not had an opportunity to inspect this site Mr. Raynor decided an inspection should be made. The date decided upon was March 10th at 2 p.m. Shipyard Lane E. M. Kontokosta property. Mr. Raynor feels the marina running so far north poses a problem of salt water intrusion. Mr. Kontokosta said he was willing to revise it to an L-shapeto minimize any effect there may be on the ground water. Mr. Raynor will draft a letter to go to the Zoning Board of Appeals in answer to its request for comments regarding this project. Planning Board .... -9- ~/February 26, 1981 Honeysuckle Hills. Mr. Lark appeared. He has written a letter objecting on behalf of Mr. Gatz to some of the conditions laid out by the Suffolk County Plannin~ Commission which the Planning Board has adopted in its resolution approving the subdivision. Mr. Gatz will come before the board at the April 6th meeting to explain his objection. Mr. Lark said Mr. Gatz wanted to clear out the poison ivy and honeysuckle bushes and MY. Raynor said that would be in the way of maintenance. The new plans for the stairs will be submitted to Mr. Tuthill for his approval. There being no further business to come before the board, Mr. Orlowski made a motion, seconded by Mr. Latham and carried to adjourn.
