BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated July 19, 2002,
and recorded in the Suffolk County Clerk's Office on July 24, 2002, In Liber 12199 at Page 326.
TOGETHER with all righI, title and interest, if sny, of the party of the first part In and to any streels and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtensnces and all the estate and rights
of the party of the first part in and to said premises: TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants thattha party of the first part has not done Dr suffered anything whereby the
said premises have been encumbered In any way whatever, except as aforesaid.
AND the party of the first part, in compliance with SectIon 13 of the Lien Law, covenants that the party of the first part will
receive the consideraUon for this conveyance and will hold the right to receive such consideraUon as a trust fund to be
applied first for the purpose of paying the cost of the improvement and win apply the same first to the payment of the
cost of the Improvement before using any part of the total of the same for any other purpose. The word "party" shall be
construed as if II read "partlas" when ever the sensa of this indenture so requires.

SCHEDULE "An
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in Mattituek, in the Town of Southold, County of Suffolk
and State of New York, more particularly bounded and described as follows:
BEGINNING at a point on the ordinary high water mark of Deep Hole Creek at the
northeasterly comer ofland conveyed by the party of the first part to Brenda K. Helies (plot
D): running thence easterly along said high water mark 80 feet, more or less, to land
conveyed by the party of the first part to Grace L. Dnun, et.aI., as Trustees (Plot F); thence
along said land South 28 0 40'. East 165 feet, more or less, to ordinary high water mark of
Peconic Bay: thence westerly along said high water mark 102 feet, more or less, to said land
conveyed by the party of the first part to Brenda K. Helies (Plot D); thence along said land,
North 20040'; West 150 feet, more or less, to the point or place of BEGINNING.
TOGETHER with a right of way over the existing traveled road to Bungalow Lane and
subject to a right of way of others over said existing traveled road as it crosses the premises
conveyed hereunder, as per an Agreement dated the 18110 day of November, 1976, and
recorded in the Office of the Clerk of the County ofSulTolk on May 13, 1977 in Liber 8235
of conveyances at page 397, which Agreement has been amended in accordance with an
agr~ementto be recorded in the Office of the Clerk ofthe County of Suffolk.
TOGETHER with thll right to lay and maintain a pipe in the bed oCthe traveled roadway for
the purpose of supplying domestic water from Bungalow Lane to the subject premises.
SUBJECf TO the rights of Ann Colligan to possess, oe~upy and control all of the
described real property during her lifetime. Effective on the death of Ann Colligan, the
party of the second part shall take title to the real property in fee simple absolute.
BEING AND INTENDED to be the same premises conveyed to the party of the olirst part by
deed dated July 19,2002, and recorded at the SulTolk County Clerk's Office on July 24, 2002
in Liber 12199 of conveyances at Page 326.
