MULLEN, Jr. Southold, N.Y. ! 1971 TELEPHONE 765-1938 A regular meeting of the Southold Town Planning Board was held August 30, 1982 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynori Jr. Member G. Ritchie Lat~am, Jr. Member William F. Mutlen, Jr. Member Bennett Orlowski, Jr. Building Administrator, Victor Lessard 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of New York Telephone Company/Kavanaugh, located at Green- port. Mr. Raynor read the legal notice and presented-proof of publica- tion in the Suffolk Times and Long Island Traveler-Watchman. Mr. Raynor: In the file we have correspondence from the Suffolk County Planning Commission: The Planning Commission at its regular meeting on August 4, 1982, reviewed the proposed subdivision plat en- titled, Minor Subdivision, New York Telephone Company, referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to the following five conditions deemed necessary t~ help preserve the traffic safety and carrying capacity of Main Road, a state road: No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Town of Southold Planning Board. Ail stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out into the right-of-way of Main Road. 3. There shall not be any vehicular ingress and egress on Main Road for Lot 2. No driveway or entrance road on Moore's Lane shall be lo- cated within fifty feet of the northerly side of the right- of-way of Main Road. pg. (2) 8/30/82 The above conditions shall be filed as covenants and restrictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. The Commission also offers the following comment on the map for your use and consideration: It is suggested Ghat the approval of this subdivision be made subject to the subdivision's meeting the requirements and standards of the Suffolk County Department of Health Services., and it's signed by Charles Lind. Copy of legal notice, copy of correspondence from this board to Suffolk County Planning Commission, copy of correspondence from this board to the New York State DEC with regard to the State Environmental Quality Review Act, Copy to the Suffolk County Department of Health Services with regard to designation as Lead Agency, correspondence approving the sketch map of New York Telephone Company and this board declaring itself as Lead Agency under the SEQRA Act, correspondence from the applicant's attorney with regard to grading, roads and drainage, short environ- mental assessment form signed by New York Telephone Company, copy of the application and deed, correspondence from the applicant's attorney and copies of the enclosed map. As is the procedure with these Public Hearings we will ask if there is anyone present this evening who would like to speak in opposition to the proposed minor subdivision for the New York Telephone Company, located in Greenport? (Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor subdivision? Hearing none Mr. Sulahian: If I may be heard, I am William A. Sulahian. I am here for Brian Kavanaugh and Mr. David Sohn is here representing the New York Telephone Company, the applicant and we propose this subdiv- ision and we respectfully request that the board do give a favorable consideration to this minor subdivision. Mr. Kavanaugh is the abutting owner and would be the direct beneficiary of this proposed division and the intended use of course would be in conjunction with the present operation with Mr. Kavanaugh's property that presently fronts on Main Road and it would be in conjunction with that that this request is be- zng made for the purpose of acquisition and if there are any questions we would respectfully request that we are here for answering . Mr. Raynor: Fine, thank you Mr. Sutahian. It is my understanding that Mr. Kavanaugh is proposed purchaser of Lot 17 Mr. Sulahman: That is correct sir. Mr. Raynor: Alright, is there anyone else present this evening who would like to speak in favor of this proposed minor subdivision? (Negative) Is there anyone present this evening that has some information to come before this board that may be neither pro nor con but should be of information for this board in making a determination? (Negative) Hearing none, Mr. Mullen do you have any question? (Negative) Mr. Latham? (Negative) Mr. Orlowski? (Negative) Alright, there being no further questions from the board then we will deem this hearing closed and thank everbody for coming down. pg. (3) 8/30/82 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to set 7:30 p.m. October 18, 1982 for a regular meeting of the Southold Town Planning Board at the Town Hall, Main Road, Southold, New York. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to set 7:30 p.m. October 18~ 1982 at the Southold Town Hall, Main Road, Southold, New York for a Public Hearing on the question of the approval of the minor subdivision of Edward & Marie Cartnick, lo- cated at Nassau Point. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the minor sub- division map of Joseph and Edwina Hataier, located at Orient, dated May 12, 1982 and amended July 28, 1982 subject to Planning Board con- sideration of the Suffolk County Planning Commission's recommendations. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski It was the concensus of the Board to field inspect the following pro- posals prior to making a determination: Norman J. (4)~ 8/30/82 7:45 p.m. Public Hearing on the question of the approval of the minor subdivision of Vincent Annabel, located at Cutchogue. Mr. Raynor read the legal notice, noting the metes and bounds were published as two separate parcels, and presented proof of publication in the Suffolk Times and the Long Island Traveler-Watchman. Mr. Raynor: Receipt from the Town Clerk's Office for the filing fee, correspondence from the Suffolk County Planning Commission: The Suffolk County Planning Commission at its regular meeting on August 4, 1982, reviewed the proposed subdivision plat entitled, Minor Subdivision Vincent Annabel, referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to the following five conditions deemed necessary to help preserve the natural and aesthetic attributes of the shoreline of Eugene's Creek.: No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Southold Planning Board. No stormwater runoff resulting from the development of the subdivision or any of the lots shall be discharged directly into the adjacent body of water. No residential structure shall be constructed within 100 feet of the upland edge of the tidal wetlands and the shoreline of Eugene's Creek. No sanitary disposal facility shall be installed or con- structed within 100 feet of the upland edge of the tidal wetlands and the shoreline of Eugene's Creek. The above conditions shall be filed as covenants and re- strictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. The Commission also offers the following comment on the map for your use and consideration: It is suggested that the approval of this subdivision be made subject to the subdivision's meeting the re- quirements and standards of the Suffolk County Department of Health Services, and signed by Charles Lind, Chief Planner Subdivision Review Section. Further review of the file, copy of the legal notice, cor- respondence from this board to the New York State DEC with regard to the State Environmental Quality Review Act, approval of the sketch plan of the map on the 13th day of May by this board, correspondence in this office from the New York State DEC concerning the wetlands permit and further correspondence as this board Studied the change in the lot line with regard to what is designated as lot one and the correspondence from the DEC stated that any changing in the lot line would invalidate any permit that the applicant has achieved at this date. (5) 8/30/82 correspondence to the DEC, copy of the permit, Mr. Annabel, under Article 25, wetlands Permit system, correspondence from this board, excuse me, from the Board of Appeals to this board as well as cor- respondence on decision from the Board of Appeals approving the under- sized width of the lot, correspondence going back to the application~ which refers back to the ordinance in the Town of Southold with re- gard to the 150 feet prior to the Zoning Board of Appeals granting relief, correspondence from this board, to this board from the Suffolk County Department of Health Services with regard to our designation as Lead Agency under SEQRA, and correspondence to the applicant, short environmental assessment form.~ filled out by the applicant on behalf of the Estate of Harry Annabel, copy of the applicant's application, grading, road and drainage structure statement, adjacent owners and deed. That pretty well completes the file. I will ask if there is anyone present this evening who would like to speak in opposition to this proposed two-lot minor subdivision for Vincent Annabel in Cutchogue the floor is now open. Mr. Krukowski: Mr. Chairman, Mr. Raynor: Yes Sir. Mr. Krukowski: I am Ted Krukowski the owner of lot 18 and 19. know, if I could look at the map there, I don't Mr. Raynor: Surely. Mr. Krukowski: There is also another lot involved that has not been mentioned at all and that's 19C. Mr. Raynor: Where about is that located? Mr. Kruk~wski: Alright, I can show you on this if it would help you, maybe in my explanation of it. This is 18, 19 and this is 19C. It is not written in that way but it is on the deeds and 19C not only involves me, but eight other people and the question that I am going to ask is if you were to read this, this is a proposed road or a dedicated road as I was told. Now, does that'hinder the subdivide or is it the dedicated road allowed road allowed to be in the subdivide? I am asking a question because I don't know.. Mr. Raynor: Are you stating that the, what you're indicating as a des- ignated road is in fact fee titled to the Town of Southold? Mr. Krukowski: That I don't know, the only thing that I was told by Mr. Terry, my attorney, was that this is a dedicated road and these people including myself have to have access to this piece of property. Mr. Raynor: Are you stating then that there is an encumbrance on the property? Mr. Krukowski: I beg your pardon? Mr. Raynor: There is an encumbrance on the property? Mr. Krukowski: They, They, we're pg. (6) - 8/30/82 Mr. Raynor: You have a right-of-way over this? Mr. Krukowski: That I don't know. They have a right-of-way across this property. They have a footpatk, the other eight people and in- cluding myself, the ninth. Mr. Raynor: They have this in their deed? Mr. Krukowski: Yes they do. Mr. Raynor: And this was originally brought forward from the Annabel Estate? Mr. Krukowski: That I don't know. Mr. Raynor: Or this is from the map of Fleetwood Cove? Mr. Krukowski: This is from the same map that you mention there and yet this road is not designated on any of these maps. Mr. Raynor: Alright. Mr. Orlowski: Which lots would they be in here? Mr. Krukowski: I beg your pardon? Mr. Orlowski: Which lots would they be in here? Mr. Krukowski: For that lot 19C, just where am I at now? One, two, three. Mr. Orlowski: Mr. Krukowski: seven, eight and myself is the ninth, Mr. Raynor: And they have access to this parcel of property? Mr. Krukowski: Yes they do, yeah. Mr. Raynor: And that's written into their deed? Mr. Krukowski: Yes it is, in all their deeds. Mr. Raynor: Would you supply us with a copy of your deed to the then so we can evaluate it? There is 19C right there. OK 19, that would be one, two, three, four, five, six, Mr. Krukowski: Alright, who do I Mr. Raynor: That's alright, no problem. it to the Office. Mr. Krukowski: office I don't have it with me. Have your attorney forward Ail I am concerned about is that these pg. (7) 8/30/82 Mr. Raynor: If there is an encumbrance, if there is an encumbrance on this property, it should show on a filed map. Mr. Krukowski: I'm not fighting his subdivide. I just don't want theSe people to not be able to get access to their property because it is used. Mr. Raynor: I can not answer your question until we have the documen- tion to come up with something reaso Mr. Krukowski: And who do I . Mr. Raynor: You can address everything to Mrs. Long over here. Mr. Krukowski: Mrs. Long. Mr. Raynor: And we will take a look at it and we will have it researched by the Town Attorney. Thank you for bringing it to our attention. Mr. Krukowski: Thank you very much. I see it is not on the other maps that's why I'm wondering unless I am missing it. Mr. Raynor: Well, we will take a look at it. Mr. Krukowski: Thank you very much. Mr. Mullen: How do you spell your name sir? Mr. Krukowski: K-R-U-K-O-W-S-K-I Mr. Raynor: Alright, is there anyone else this evening who would like to speak in opposition to this proposed minor subdivision? (Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor subdivision? Mr. Annabel: I am sure that Mr. Krukowski is familiar with that deed that says the people at lot 19A have access to that over lot 19 on the easterly portion by footpath only. That's the way that deed is written out. I am very familiar with it myself. Now there has been a survey made and the title company made a search and they found no rights what- so-ever to any road or anything down there. I know for a fact that the town has never been deeded any property there. That is just a paper road. Mr. Raynor: That's a paper street? Mr. Annabel: That's what it is and it has been all this while. Mr. Raynor: In other words Mr. Annabel: Mr. Krukowski has been told this years ago. As a matter of fact before I wanted to sell this, I went to Teddy, and I don't know why he turned me down, but I offered to sell him a piece of property down there so that there wouldn't be any question later on and it went pg. There was a contract drawn up and everything else and there was a deposit put down and Mr. Krukowski turned it down the last minute, so o Mr. Raynor: Mr. Annabel: Mr. Raynor: Well that's a little outside the realm. Yes. Another words your contention is that lot 19C, I believe it was called . Mr. Annabel: Mr. Raynor: wood Cove? Right. has a right of way over the map, the filed map of Fleet- Mr. Annabel: Right. Mr. Raynor: As opposed to your property? Mr. Annabel: And it says by footpath only over the easterly portion of lot 19 and Reny Terry looked at this with me and he says well when they get down to lot 18 what do they do. I said that is not my problem Mr. Terry, you know that. Mr. Raynor: Alright, this board will certainly take a look at it and resolve it at the time of the subdivision decision is made sure. Mr. Annabel: That won't hold up the subdivision will it? Because re- gardless of . . Mr. Raynor: Well the board must act within 45 days, that's the law. Mr. Annabel.: Because regardless . Mr. Raynor: It is cut and dry. Mr. Annabel: Regardless of the outcome'of this whoever owns it, if there is a right-of-way, if there still exists a right-of-way. Mr. Raynor: If there is an existing right-of-way or an existing town road on the property that's indicated tonight under discussion,then it will have to show on the map. If it's not, then it will not have to show on the map. Mr. Annabel: OK Henry~ thanks. Mr. Raynor: Is there anyone else who would like to speak in favor of this proposed minor subdivision? Yes Sir. Mr. Tashkin: I am the purchaser of Mr. Annabel's property. My name is Edward Tashkin. I would just like to request a copy of the deter- mination, if and when that is taken care of. pg. Mr. Raynor stated the property contained many large t somehow survived the 1938 hurricane and stated'the board woul them retained on site. The board also noted no allowance for playground area within this subdivision, Mr.. The applicant stated his agreement to have covenants placed on the property to protect the trees. John Simon Estate - Ms. Abigail Wickham, Esq. was requested to in£orm Mr. William Wickham, attorney for the applicant, to revise the maps to designate lot number one and lot number two for this proposed set-off and to supply the board with a voluntary covenant stating no further subdivision will be made in the future on lot number one. Richard J. Cron - Mr. Richard Cron, Esq. met with the board to discuss this minor subdivision located near East Marion. Mr. Cron s~ated there was no fee title on the designated right-of-way; the right-of-way is to provide access to the utilities and to lots one and fou~. It was the concensus of the board to field inspect this property prior to the next Planning Board meeting. pg. (10) 8/30/82 On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead aqenc¥ with regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Richard J. Cron, located near Greenport. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Adult Condominium Community - Mr. Richard Cron, attorney and interested party, introduced Bill Carroll and Joe Nollan partners in this develop- ment along with Donald Dennis; architect and John Raynor; water and sewerage to the members of the Planning Board. Mr. Cron stated this property has been before the Town Board for a change of zone for the development of Leisure Greens to contain 296 units on the approximately 46 acres of land located behind the Sacred Heat Church in Cutchogue. The present proposal is for approximately 160 units, for the preserva- tion of open space, to be used as a residential community with age re- strictions with a minimum of 55 years old and children 19 years and older. The site would consist of 40 building, 4 units each, with garages located in the rear. Amenities such as tennis courts, swim- ming pool, putting green.are proposed for the area. Mr. Cron stated he had not yet filed his application with the Town Board, but would hope the Planning Board would look in favor of this proposal when it is re- ferred by the Town Board. Mr. Cron also stated the roads would never become town road as they propose a security system for this area. Mr. Raynor stated that he would not be participating in this project as Mr. Carroll is a member of his family. East End Supply Company - Mr. Burden and Mr. Irving Price, Esq. met with the board for a presubmission conference on this site plan. Mr. Corwin informed'Mr. Raynor that there are no covenants or restrictions on this property and it will be supplied by Public Water. The board stated they would eventually require a drainage plan for this site so that stormwater would be retained on the site. Mr. Corwin stated the existing building has already been approved for a special exception many years ago. Mr. Raynor read correspondence from the Superinten- dent of Highways regarding fencing and curbs. It was the concensus of the Planning Board to field inspect this property prior to the next meeting of the Planning Board. pg. (11) 8/30/82 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agsncy in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Moebius Associates, Sec. I~ located at Cutchogue. An initiaI determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the minor subdivision of Moebius Associates~ Section II, located at Cutchogue., dated February 10, 1982 and amended August 3, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED to set 8:00 p.m. September 20, 1982 at the Southold Town Hall, Main Road, $outhold, New York as the time and place for a public hear- ing on the question of the approval of the minor subdivision of Mattituck Holdings Company, located at Laurel. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the access to lot number three on the subdivision map of Baxter Propertiest located at Mattituck, for the issuance of a Building Permit, subject to the applicant complying with the recommendations stated in Inspector Davis' report 9215 regarding improvements on the right-of-way before the issuance of a permanent CO. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Bayview Ventures Ltd. - Mr. David Saland, Mr. Conforti, Esq. and Mr. Howard Young met with the boar to discuss this proposal. The Planning Board requested the following information: 8/30/82 pg. (12) A written request regarding a waiver on the width of roads within this subdivision and copies of the re- vised maps designating road names for forwarding to the Superintendent of Highways and the Highway Com- mittee for their review. A copy of Mr. Young's capacity report for the Plan- ning Board files and referral to the Town Engineer for his review and comments. 3. A full disclosure statement listing all parties that have a financial interest in the proposal. 4. A copy of the test borings results when they have been completed. Because there was no objection stated by thOse in attendance, Mr. Raynor stated the Planning Board would contact the Department of Soil and Water Conservation with regard to the perculation of soil and the sand swales. Mr. Conforti requested the Board to waive completion of an impact statement. Mr. Raynor advised him a determination would be made regarding this the next time a meeting was scheduled. On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve Inspector John DaviS' report 4237 for improvements on the access road within the sub- division known as Louis Ramunni.¢ located at Southotd, and said improve- ments are to comply with those recommendations stated. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Latham, it was RESOLVED to set 7:45 p.m. October 18, 1982 at the Town Hall, Main Road, Southold, New York as the time and place for a public hearing on the question of the approval of the preliminary map of the subdiv- ision known as Homestead Acres~ located at Greenport. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (13) 8/30/S2 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve Inspector John Davis' report ~235 regarding the improvements made on the access road within the subdivision known as Nicholas Fontana~ located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen, Ortowski Mr. Raynor noted that Mrs. Nicholas Fontana advised the Planning Board office August 23, 1982 that the two trees referred to in said report have been removed. Mary Harris - The board made an on site field inspection on this prop- erty prior to the meeting. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve a set-off 106-13 as designated on the subdivision map of Robert Ernest Bidwelt~ located at Cutchogue, dated June 18, 1982 and amended July 12, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Cleaves Point Village (Kontokosta) The Planning Board made an on site field inspection of this property prior to the meeting. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the amendment on the site plan of Cleaves .Point Village., located at East Marion, for the addition of two tennis courts subject to certification from the Building Department. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board recommend to the Build- ing Department the issuance of a partial CO for Cleaves Point Village, located at East Marion, subject to certification from the Building Department. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (14) "- 8/30/82 On motion made by Mr..Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board grant final approval on the site plan known as Irwin Thompson, located at Southold, for the issuance of a final CO. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Port of Egypt - After an on site field inspection it was the concen- sus of the Planning Board that the applicant, Mr. William Lieblein, meet with the board at the meeting of September 20, 1982 to discuss area computations on this site. Eugene & Patricia Mott - Mr. Mo~t advised the Planning Board that he intends to use 3,000 square feet for sales area and 600 square feet for storage and office space for this site. He also stated he has no intention of using the building for auctions; the building would be utilized as an antique shop. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board forward the site plan of Eugene J. & Patricia A. Mott to the Building D. epartment for certification. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Herodotus Damianos located at Southold, was submitted to the Planning Board on April 16, 1982 and, a filing fee in the amount of $100 was paid June 9, 1982, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on June 28, 1982 at 8:00 p.m., and WHEREAS, the requirements of the S~bdivision Regulations of the Town of Southold have been met by said subdivision plat and application, pg. (15) 8/30/82 NOW, therefore, be it RESOLVED that the application of Herodotus Damianos for approval of said subdivision plat prepared by Roderick Van Tuyt, P.C. dated April 20, 1982, be approved and the chairman be authorized to endorse approval subject to receipt of three (3) copies of the final map. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the major subdivision known as Settler's at Oysterponds, located at Orient, dated March 13, 1982 and amended August 26, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski It was the concensus of the Board to refer the map of Settler's at Oysterponds to the Town Board for their determination on the cluster concept. Mrs. Burke questioned ownership of Halyoake Street. The board advised Mrs Burke that if the Town has maintained this street it is owned by the Town by adverse possession. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to set 8:15 p.m.~ September 20~ 1982 at the Town Hall, Main Road, Southold, New York as the time and place for a public hearing on the question of approval of a reduction in bond from $140,000 to $25,000 on the subdivision known as Bayview Farms, located at Orient, Section 277, Article 16 of the Town Law.
