Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Member Bennett Orlowski, Jr. Member James Wall Building Administrator, Victor Lessard 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of Joseph & Edwina Hataier, located at Orient. Raynor read legal notic of hearing. Mr. Raynor: This minor in review of the file we are in receipt of the Town Clerk's notice on July 8, receipt of the filing fee in the amount of $100. The legal notice was published in the Suffolk Weekly Times for one week commencing on the 22nd of July 1982 and it is signed by Troy Gustavson and noterized by Helen De Voe as well as pub- lication of Long Island Traveler-Watchman one week on the 22nd of July signed by Pat Wood, noterized by Clement Thompson. Copy of legal notice, copy of the resolution by this board declaring itself le~d agency under the State EnvirOnmental Quality Review Act, Resolu- tion of ~thelPlanning Board approving sketch plan~, correspondence from this board to the N~w York State ~nvironmental Control With regard to State EnvirOnmental Quality Revie~ Act, copy of correspondence from this board to the Suffolk County ~lanning Commission with regard to the application, Short Environmental Assessment Form filled out by Josep~ E. Hataier as owner. Prio~ copies of the maps, metes and bounds description, declaration on drainage, road, and grading, appli- cation for the approval of plot. That pretty much completes the file. As is the procedure of this board we will ask if there is anyone present this evening who would like to speak in opposition to the pro- posed minor subdivision of Joseph & Edwina Hataier? (Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor subdivision? (Negative) Hearing none, is there anyone present who has some information per- taining to this subdiVision which should come before this board at this time? (Negative) Alright, there being no further comments or questions with regard to this public hearing we will declare the public hearing of Joseph and Edwina Hataier closed and thank you for comzng down. Mr. Raynor informed the board and guests that the 7:45 p.m. Public Hearing for the approval of James Manos had been withdrawn by the applicant's attorney. New maps will be submitted to the Planning Board. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to set 7:30 p.m., Monday, September 20, 1982 at the Town Hall, Main Road, Southold, New York as the time and place for the regular meetinq of the Southold Town Planning Board. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Mr. Orlowski and Mr. Wall arrived at the meeting at 7:35 p.m. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board accept John Davis' report ~232 regarding the improvements of the access road on the subdivision map of James W. Dawson, located at Bayview Southold and such improvements to comPlY with those recommendations stated in said report. Vote of the Board: Ayes: Raynor, Latham, Multen, Orlowski, Wall pg. (3) 8/2/82 The following was introduced by Mr. Mullen, seconded by Mr. Latham and carried: Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described b~iow has determined that the project will not have a significant effect on the environment. ~ DESCRIPTION OF ACTION The minor subdivision of Stanley & Louise Gould is a three-lot subdivision located at Nassau Point. The pro3ect has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Because there has been no response in the allotted time from the Suffolk County Department of Health Services it is assumed that there is no objection nor comments by that agency. DESCRIPTION OF ACTION The minor subdivision of Sal & Benny Caiota Jr~ is a two-lot subdivision located at Greenport. The project has been determined not to have a significant effect on the environment for the~following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Because there has been no response in the allotted time from the Suffolk County Department of Health Services it is assumed that there is no objection nor comments by that agency. -The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. (6) 8/2/82 Allerton Cushman - The Chairman read correspondence from Stephen O'Neil, President of Fishers Island Development Corporation stating they would not have any objection to the proposed subdivision con- taining 10.6 acre lot and the building on the new six acre lot. Correspondence also stated restrictive covenants in the original FIDCO deed would apply to the new lot and would include not more than one house to be built on the lot and its location, design, etc. would be subject to the approval of FIDCO. Mr. Wall was asked to supply the board with a letter from the applicants stating no further subdivision would be made on this property. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Allerton Cushman, located at Fishers Island. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the minor subdivision of Allerton Cushman, located at Fishers Island, dated March 11, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall John Strong Property (formerly known as Mehlman minor subdivision - The Chairman opened a discussion on this property as requested in correspondence received from the present landowner, Mr. John Strong, dated July 12, 1982. The letter notes the owners request for the Planning Board to amend the right-of-way to a 25' width as opposed to the 50' right-of-way initiated by the Planning Board in 1973. The board received a copy of a master map of the area and made an on site field inspection prior to the meeting. It was the concensus of the board that the subdivision will remain as is. Mr. Strong asked the Chairman if all board members received copies of his letter. Mr. Raynor noted correspondence was received in the office July 13 and copies had been distributed to all board members. Baxter Properties - The board reviewed the proposed tree layout and landscaping plan for plot ~3 as submitted by Robert Wendell. It was the concensus of the board that enforcement of those conditions, pg. (7) 8/2/82 specifically number five and six, as recommended by the Suffolk County Planning Commission and the Planning Board's resolution for approval, dated April 27, 1981. Such conditions state no grading, clearing and cutting of vegetation within 50 feet of the top edge of the bluff. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the location of the leachinq basins designated on the subdivision map of Peconic Bay Cover located at Peconic, which were recommended by the Superintendent of Highways. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Kontokosta Site Plan - The applicant wishes to amend his present site plan by adding tennis courts on the property and requests partial approval for the issuance of a CO. It was the concensus of the board to field inspect this property prior to making a determination. Port of Egypt - The board reviewed the proposed site for a storage building on this property. It was the concensus of the board to make a field inspection on this property prior to making a determination, preferably lunch hour when the board can observe the parking and the ingress and egress of traffic. Charles M. & Kathyrn B. Nelson - The board field inspected this prop- erty prior to the meeting. It was the concensus of the board not to grant the three lots as proposed and to recommend that the property be subdivided~.into two lots containing approximately ½ acre each. The secretary was instructed to send such information to the Board of Appeals and the attorney for the applicant. pg. (8) -' 8/2/82 Hill Crest Estates - Mr. Harold Reese, Sr. and Mr. Roderick Van Tuyl met with the board to discuss what the board would require to be amended on the preliminary map regarding the informantion received from the Suffolk County Planning Commission and Lawrence Tuthill. The board recommended the following: The intersection of Sound View Drive and Hill Crest Road to be changed to reflect Suffolk County Planning recommendation number two. This applies to recommendations one and two. Keep the road extension to the south of lot ~12. This applies to recommendation number three. Each lot to have the required setback of 100 feet. This applies to recommendation number four. Planning Board does not recommend a change in Hill Crest Drive. This applies to recommendation number five. The bend in the road on Hill Crest Drive is to remain as is. This is referred to in recommendation number six. Grand View Estates - The Chairman informed Mr. Harold Reese, Sr. that after repeated efforts to obtain the road construction plans none have been received by the Planning Board office nor the Town Engineer. Mr. Van Tuyl advised Mr. Reese that they would be forwarded to the Planning Board within a couple of days. Mr. Raynor also stated that the road construction within this subdivision was in progress and a stop work order would be placed on the property. Mr. Reese advised the board that he had stopped the work himself that day. Mr. Raynor stated that the inspection fee, which should be 4% of the passbook amount, had not been received by the Town Clerk and he should contact the Town Clerk for specific information regarding this filing. Mr. Reese stated he was never informed of the inspection fee. Edward N. Cartnick - The board field inspected this property prior to the meeting. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Baord declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Edward N. & Marie M. Cartnick, located at Nassau Point. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall pg. (9) ~'J 8/2/82 On motion made by Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED that the Southold ~own Planning Board approve the sketch map of the minor subdivision of Edward N. & Marie M. Cartnick, located at Nassau Point, dated June 25~ 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Angel Shore Estates - Mr. Richard Cron, Esq. met with the board to discuss Lawrence Tuthill's report dated July 12, 1982. Mr. Cron and the board proceeded to discuss each recommendation and its effect on the proposal as submitted. IMr. James Mullins asked the board if he would be allowed to addresslthel board with regard to the subdivision. Mr. Raynor advised Mr. Mulllns that it was not a public hearing but if he had some pertinent information regarding this proposal he should inform the board. Mr. Mullins stated that the Engineer made his re- port based on an Inspection made in the dark of the night, walking into the property a short distance, noting marsh area, and with the aid of Mr. Mullin's flashlight marked an area on the map to be used for the drainage area. Mr. Mullins stated this was poor representation of Southold Town. Mr. Raynor asked Mr. Mullins for his address and stated the board would investigate this report. Another couple was in the audiance; the woman stated that there are only eight residences in the area and when someone parks their car and turns out the lights you can't help but investigate. She stated the surveyor was there 9:00. Mr. Mullins then stated that the gentleman gave his name as Larry Tuthill, Engineer SurVeyor for Southold Town. As a result of the testimony given, it was the concensus of the board to investigate the accuracy of the report before discussing it further. Mr. Raynor apoligized to Mr. Cron for the delay in proceeding further with the proposal. Mr. Cron stated in lieu of the information given, he under- stood the board's position. A woman in the audiance asked Mr. Raynor if he would like her copy of the map showing the salt water marsh in the area. Mr. Raynor stated the Conservation Advisory Council and the Trustees had a copy and it would not be necessary. Mary Harris - Mr. Cron Esq,. discussed this proposal with the board. He has requested the board to proceed with a set-off. The board stated they would like to field inspect this property prior to making a determination. The remaining large parcel was noted as possibly being used for grapes. pg. (10) ~-~ 8/2/82 North Fork Bank & Trust Co. - Ms. Abigail Wickham, Esq. presented to the board a proposed sketch of an alternate site for the bank to be located at the southeast corner of the existing block building; this location would require a curb cut for egress only. This lo- cation is one of the three the board suggested at a previous meeting as it will have less impact on the traffic flow in the area. The board advised Ms. Wickham to proceed with such plans and requested that she forward correspondence from Alan Cardinale stating his ap- proval in the reduction of the parking spaces in the area. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board rescind their motion of A~ril 26~ 1982 regarding the declaration of lead agency in regard to the State Environmental Quality Review Act in the matter of the Major Subdivision of property of Settlers at Oysterponds~ located at Orient, which states an initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the Major Subdivision of Settler's at Oysterponds, located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Frederick E. Bossert - The board made a field inspection on this prop- erty prior to the meeting. On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Frederick E. Bossert, located at Mattituck. An initial/ determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Prior to taking further action, the board requests the maps to meet those requirements stated in Article IV, Section A106-40. pg. (11) 8/2/82 Country Club Estates - Mr. Raynor stated correspondence has been sent to the Town Attorney for his determination on the Covenants and Restrictions that have been filed for the Major Subdivion of the same name, specifically lot ~32. Nalbantian - The board field inspected this property prior to the ~eeting. On motion made by Mr. Mullen, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the Major Subdivision of Edward and Charles Nalbantian, located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Prior to the board taking further action, they request the attorney for the applicant to meet with them to discuss the future plans for the large trees that are presently on the property and the addition of a drainage area and a park and playground area within this subdiv- ision. On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board recommend approval on the application of Nicholas Schick for a change of zone from "A" Residential and Agricultural District to "M-i" General Multiple Residence District on certain property at Orient, New York. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, secOnded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the subdiv- ision map of Herodotus Damianos, located at Southold subject to the following conditions: Clarification of the approved subdivision map of Henry Jennings Estate filed in the Planning Board Office. pg. (12) 8/2/82 Consideration of the Inspector's recommendations for road construction and such construction meeting Planning Board approval. 3. Consideration of the Suffolk County Planning recom- mendations. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The Board discussed the proposed contract from Raymond, Parish, Pine & Weiner for the Southotd Town Master Plan and Zoning Update. Mr. Raynor informed the members that through conversation with the Chief of Police, the transportation study outlined in Phase III may not be necessary. Mr. Raynor stated he would like to see an option included in the con- tract that should preliminary findings on the water study fall short in the board's estimation, that negotiations can be made for a separate and single water study. Mr. Mullen stated he would like to see Economic Development included along with Administrative Development. He also stated Pre-fab homes should be included. Also discussed was the b~ov c~.re~to be distributed to the residents; all board members were in agreement with this. Mr. Orlowski stated he would follow the Argri- cultural study carefully. Mr. Wall stated the residents of Fishers Island are concerned about the water problem and asked the board to be prepared to discuss this at their meeting on Fishers Island, August 18, 1982. Ressler from Glover - Abigail Wickham, Esq. met with the board and stated the access road designated on the map was described as pre- scriptive (continued use over a period of years may give legal right to use it) road and was determined to be one rod in width. Ms. Wickkam stated there would be no problem with the County as this property is part of Farmland Phase I. She stated she would send a copy of the letter stating such when she receives it. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve a set-off 106-13 as designated on the map of Richard Ressler & Kirk Ressler, dated April 30, 1982 and amended July 16, 1982, containing 5.778 acres. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall PG. (13) 8/2/82 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to set 1:30 p.m., August 18, 1982, at the Fishers Island High School, Fishers Island, New York, as the time and place for a public hearing on the question of the approval of the minor subdiv- ision of Annette Zabohonski, located at Fishers Island. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Abstained: James Wall (interested party) On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the minutes of the June 15, 1982 meetinq. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the $outhold Town Planning Board approve the minutes of the June 28~ 1982 meeting.
