Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Member Bennett Orlowski, Jr. Building Administrator Victor Lassard 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of Pudge Corp. located at $outhold. Mr. Raynor read legal notice and presented proof of publication in the Suffolk Weekly Times. Mr. Raynor: In review of the file, we have a receipt from the Town Clerk's Office in the amount of the filling fee of $100. We have from the Suffolk County Planning Commission the following: The Suffolk County Planning Commission at its regular meeting on June 2, 1982, reviewed the proposed subdivision plat entitled "Minor Subdiv- ision - Pudge Corp.", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to the following seven conditions deemed necessary to help preserve the traffic safety and carrying capacity of Middle Road, a county road: No lot shall be subdivided o~ its lot lines changed in any manner at any future date unless authorized by the Southold Town Planning Board. 2. Ail driveways on Middle Road shall make an angle of at least 70v and preferably 90° with the county road if the driveway is to serve as both entrance and exit. No driveway or entrance road on Middle Road and Horton's Lane shall be located within fifty feet of the ends of the property line at the intersection having the course of S. 79- 37' E. and a distance of 34.78 feet. pg. (2) 6/28/82 4 e Each lot having frontage on Middle Road shall have a turnaround provision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. Ail stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out into the right- of-way of Middle Road. Since the commercial development of this parcel can have an adverse impact upon the county road a coordinate access and parking plan shall be developed for this site. This plan shall be binding upon future lot owners to in- sure proper access to each lot and between lots so that vehicles will not have to reenter the county road to go from one lot to the other. In lieu of the parking plan an easement shall be required so that when the parking areas are designed in the future each lot will be inter- connected. The above conditions shall be filed as covenants and re- strictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. The Commission also offers the following comment on the map for your use and consideration: It is suggested that approval of this subdivision be made sub- ject to the subdivision's meeting the requirements and standards of the Suffolk County Department of Health Services. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board declare itself .~ead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Joseph and Edwina Hataier~ located at Orient. An initial determination of nonsignificance has been made. (4) 6/28/82 7:45 p~mo Public Hearing on the question of the approval of the minor subdivision of Stanley & Louise Gould, located at Nassau Point. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board dispense with the readinq of the legal notice on the minor subdivision of Stanley & Louise Gould, located at Nassau Point. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor: Alright this proposed subdivision is located at Nassau Point and I will review the file. We have in receipt in the amount of $75 for the filing fee from the office of the Town Clerk. We have a letter from the Suffolk County Department of Planning; the above captioned subdivision, they have no comments on and it is reviewed for local determination. There's a copy of the legal notice, copy of the metes and bounds description, correspondence from our board to Suffolk County, resolution for approval of the sketch map dated April 22, 1982, declaration of Lead Agency by this board which was done on April 12, 1982, correspondence from this board to the New York State DEC with regard to the State Environmental Quality Review Act and they had up until the 4th of June to respond. Mr. Raynor: Counsel, are you aware that we're still lacking the entire tract maps for SubmissiOn for the county? Mr. Cron: Yes, those will be prepared. Mr. Raynor: OK, whatever determination would come out, based on our timetable, I would estimate that a decision would have to be subject to the considerations of Suffolk County Planning. pg. (11) 6/28/82 Baxter Properties - Richard Cron, Esq., appeared on behalf of his client, Mr. Stanley Wernick, who is under contract to purchase lot number four has requested the Planning Board to waive .item number eight of the Suffolk County Planning Commission with regard to re- stricting a single access to the beach for lots three and four, due to the tremendous risk of liability and the uncertainity of future property owners. Mr. Raynor polled the board; each member had no objection to such request. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board override Suffolk County Planning recommendation number eight on the minor subdivision of Baxter Properties, located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski George Boehle - It was the concensus of the Planning Board to field inspect this property prior to taking any action. William & Patricia Blake - It was the concensus of the board to field inspect this property before taking any action. Charles P. John Meisner - It was the consensus of the board to field inspect this property before taking any action. 8:15 p.m. Public Hearing on the question of the approval of the minor subdivision of Sal & Benny Caiola, located at Greenport. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to dispense with the reading of the legal notice on the minor subdivision of Sal & Benny Caiola, located at Greenport. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (12) 6/28/82 Mr. Raynor: This proposed' minor is located at McCann Lane in Greenport and is a two-lot minor. In review of the file, we have correspondence from the Suffolk County Department of.Planning: Under the subject of others the map of proposed ma3or subdivision of property is required before this referral can be reviewed by the Suffolk County Planning Commission, signed by Charles G. Lind. Correspondence from this board to Suffolk County Planning, metes and bounds description by Roderick VanTuyl, legal notice of hearing, notice from this board to the Suffolk County Planning Commission, resolution from this board declaring itself as the Lead Agency and giving until June 4th for response. That letter went out to the New York State DEC which would have overlappi~ 3urisdiction, no response. That pretty well completes the file except to note that there is no filing fee attached to this file as well as the grading, drainage, road construction statement that is unsigned. As is the procedure with this board we will ask if there is anyone present this evening who would like to speak in opposition to this proposed two-lot minor of Sal & Benny Caiola, Jr.? (negative) Hearing none, Is there anyone present this evening who would like to speak in favor of this proposed minor? David Kapell: David Kapell, agent for Sal Caiola and Benny Caiola. I would like to speak on behalf of the applicants in favor of this application. I do not want to waste a lot of your time, we've been over it. It's a straight forward two-lot subdivision involving ten acres of of approximately a 28 acre site. The two lots would take up the waterfront most end of this piece of property and allow each lot approximately 275 feet of waterfront. In addition we Will provide a 100 feet of beach that will be made available to owners of property within a major subdivision which is also before this board. We feel it's a good application for the town in that we are going to take ten acres on the most sensitive area of this particular piece of property and use it for two lots where'the surrounding properties are divided pretty much into half acre lots, so we will be preserving some open space here. That's about it, if there are. any questions, I will be glad to answer them. With regards to the grading statement, I will be glad to sign that and correct that deficiency. Number two, as I do believe I did pay the filing fee on this particular one, I didn't pay it on the major. Mr. Raynor: Alright, make note, the Town Clerk hasn't given us a receipt and we will get a duplicate of that in the file and not try to stick you twice. Mr. Kapell: Thank you. (13) 6/28/82 Mr. Raynor: We are also delinquent in receipt of the maps for the entire tract for submission to the county. Mr. Kapell: Those I've also filed. Mr. Raynor: Those you"ve filed, alright we'll need those for forward- ing. Anyone else present this evening who' would like to speak in favor of this proposed minor subdivision? (negative) Is there any- one present this evening who has some information concerning this proposed minor that should come before this board at this time? Mrs. Oliva? Ruth 01iva: Could I just ask a question, are there going to be any covenants restricting any further subdivision of this minor? Mr. Raynor: The answer to your question is yes, we haven't quite gotten to it. It's sitting here. Mr. Kapell: I think that was mentioned Mr. Raynor: We've discussed it. It's in the minutes already, but . Is there anyone else that has some information pertaining to this subdivision? (negative) Mr. Orlowski? (negative) Mr. Latham? Mr. Latham: Just a question on this right-of-way, is that just a foot path or for vehicles. Mr. Kapell: That's right, no . footpath. Mr. Raynor: Mr. Mullen?~ (negative) OK, the C&R's with regard to the two oversized lots , we have not received but they should be put in a suitable form for filing with the Suffolk County Planning. Mr. Kapell: The covenants and restrictions for the lots oversized? Mr. Raynor: That's right. Mr. Kapetl: Very good. Mr. Latham: How about stairwaYs? Mr. Raynor: Let's see what the County is going to recommend. We're going to hear about it I am sure sooner or later. Mr. Latham: That's pretty steep there. Mr. Raynor: Any other questions? There being none then, we declare this hearing closed. Mr. Raynor instructed the secretary to check the file for an overall tract map for the major subdivision, and have Mr. Kapell sign the no grading statement. pg. (14) 6/28/82 Sal Caiola Condominium project - The ~oard advised Mr. David Kapell, agent that this proposal will be held in abeyance until such time as the Zoning Board of Appeals is in receipt of information regarding the Environmental Impact Statement. Kontokosta Change of Zone - Mr. Kapell and Mr. Kontokosta met with the board to discuss this proposal. After a field inspection, it was the concensus of the'board that the applicant amend his application or to withdraw the present one and start new. The board stated that the proposed M'Zone was to large and would not sustain the yeild. It was suggested that the northerly 18 acres be used for this purpose with the remainder reserved for open space predicated on the fact that it will be serviced by municiple water and sewerage. The board stated no objections to the B-Light Business Zone. Mr. Kontokosta asked if the board would consider the concept, of possibly creating two acre zoning on the portion that does not have the M-zone on it or possibly coming back to the board with the undeveloped property as a major sub- division. The board also suggested the landscaped buffer zone to be extended from the eastern B-zoned property. Before any action is taken Mr. Kontokosta will study that which the planning board 'has suggested. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the access to lots 139 - 136, inclusive, located at Cedar Beach Park~ and said access is to be maintained at or above their present state described in John Davis' report ~225, dated June 14, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Angel Shore Estates - Mr. Richard Cron, Esq. met with the board to discuss the status of this proposal. Mr. Cron was informed that this has been sent to the Town Engineer for his computations on the re- charge area because of the topography on this property. Mr. Cron stated he would like to be present at the next meeting of the Planning Board to discuss Mr. Tuthitl's report. (15) 6/28/82 Cove Beach Associates - Mr. Richard Cron, Esq. met with the board to discuss this proposal and stated that prior to further discussion he would submit covenants and restrictions for the drainage area to be referred to the Town Attorney for his legal opinion. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Bayview ventures Ltd. - David Saland, Thomas Gill and Mr. Young met with the board to discuss this proposal. A report regarding the maple trees on this property was submitted to thy board. The board asked that the property be staked for the board ko field .inspect. Mr. Raynor asked if the town would be supplied with ihformation stating these roads would remain private. Mr. Saland said this would be done. A right-of-way would be provided to the drainage area. The board noted revisions on the map as requested by the board. Another field inspec- tion will be made on this property and same will be discussed at the July 19 meeting. North Fork Bank & Trust Co. - Abigail Wickham, Esq. met with the board to discuss the site plan for the dri~e-in-window facility. She stated this plan to be modified by relocating the easterly entrance and exit to the east. The board stated such a site, in this location, would create backup problems on the traffic flow on both ingress and egress on the Main Road. It was requested that the site be relocated pg. (16) 6/28/82 to the south end of the existing block building on the southeast corner of the property, or to use the west boundary as initially proposed by the North Fork Bank. Ms. Wickham stated the block build- ing was no longer available and the west bpundary would result in poor security for night deposits, e%c. Th~.board questioned the neces- sity of the third drive-in window as they ~elt it was seldom used for transactions. Mr. Mullen reported being oh site for a fi~e minute period (2:05 - 2:10) and counting 62 cars traveling east and west. The proposed banking hoUrs would be 8:30-4:30 Monday - Thursday and 8:00 p.m. on Fridays. The board, will field inspect this property prior to the next meeting, Glover/Ressler - Abigail Wickham was asked about a right-of way on the proposed set-off. She stated there was a traveled dirt road on the property designated on the map as W.C. B©lenius and access could be provided to the property to be conveyed to Ressler. The board requested that the maps be amended to show the right-of-way and the application to be revised to read 5.778 acres rather than the 23.5 acres being set off. Moebius Associates - Gertrude Ally appeared before the board to dis- cuss the revissd maps as Richard Lark, Esq_'was out of town. The board advised her that the maps did not re,elect those changes requested by the board. The map was to be renamed a~ Section I or Section II and to eliminate the flag lot configuratioN on lot number two. Ms. Ally saidr to subdivide the property in ahother fashion would create a problem with a garden located on.this parcel. The board advised her to see Mr. Lark as this matter was diScussed with him at a previous meeting. The board will review this proposal when revised maps are submitted. Long Island Cauliflower Association -Abigalil Wickham was advised that in order to qualify for approval of this proposed set-off; the curb cut in question is to be located 250 feet from the Southwest corner of the property with a condition that if alt any future time this prop- erty is to be subdivided, the Planning Board will examine a single access on interior design for circulation of parking. pg.~ (~17) 6/28/82 Theodore & Suzanne Swick - Irving L. Price, Jr., Esq. discussed this proposal with the'board. Mr. Price advised the board that the prop- erty to the west was single and separate. The board asked if the right-of way could be widened to the required 25 feet. Mr. Price stated there was no such requirement. The board will field inspect this property prior to the next meeting July 19, 1982. Settlers at 9ysterp©nds - The board will table this proposal until such time as the long environmental assessment form has been dis- tributed to all members of the board for their review. It was noted the Conservation Advisory Council's recommendations have not been received nor the recommendations from the Soil and Water Conservation. Southqld Shores, Tarpon Drive The board was advised by the Associ- ation of this subdivision their plans to improve this street at such time as the heavy construction equipment has left the area. Forquer, Jr. "should be included as part of the proposed subdivision and labeled as lot ~4.
