MULLEN, Jr. Southold, N.Y. 11971 TELEPHONE 765-1938 A meeting of the Southold Town Planning Board was called to order June 15, 1982, 11:10 a.m. at the Fishers Island Firehouse, Fishers Island, New York. Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Multen, Jr. Member Bennett Orlowski, Jr. Member James Wall Building Administrator Victor Lassard Allerton Cushman - The Planning Board inspected this property prior to the meeting noting the applicant's request to split the property into two sites. The board requested James Wall to supply them With a letter from the applicant stating no further subdivisions will be made on this property before taking any action. On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board accept those maps of the east end of Fishers Island with a condition that the areas that are '~designated will fall under the present subdivision regulations. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Annette Zabohonski - The Planning Board ~nspected this propert3 prior to the meeting. James Wall was asked to supply the board with stipu- lations as to the improvements of t'he right-of-way and width. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act' in the matter of the minor subdivision of Annette Zabohonskit located at Fishers Island. An initial determination of nonsignificance has been made~ Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Abstained James Wall (interested party) pg. (2) 6/15/82 On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planninq Board approve the sketch map of the minor subdivision of Annette Zab6honski, dated September l, 1981 and amended October 14, 1981, located at Fishers Island. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Abstained James Wall (interested party) Walter Andrews - The board inspected this property prior to the meeting. It was noted this subdivision needs DEC approval. On motion made by Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Walter Andrews, located at Fishers Island. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve a set-off (106-13) on the minor subdivision map of Walter Andrewsf located at Fishers Island, dated February 5, 1982 and amended March 3, 1982 upon completion of the State Environmental Quality Review Act and obtaining necessary permits. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The following was introduced by Mr. Orlowski, seconded by Mr. Wall and carried: Pursuant to Article 8 of the Environmental Conservation Law State Enviornmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Baord as lead agency for the action described below has determined that the project will not have a significant effect on the environment. pg. (3) 6/15/82 DESCRIPTION OF ACTION The minor subdivision of Ernest Witsberg, Jr~ is a two-lot minor subdivision located at Mattituck. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that'ino significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Because there has been no response in the allotted time from the~Suffolk County~Department of Health Services it is assumed that there is no objection nor comments by that agency. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Mrs. Susan E. Pursuant to Aritcle 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdiwision of Jerome E. & M. Dorothy Bloom is a two- lot subdivision located at East Marion. The project has been determined not to have a significant effect on the environment for the following reasons: pg. Long, Secretary, Southold Town Planning Board, Main Road, Southold, New York 11971 On motion made by Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED that the Building Inspector be notified to place a sto~ work order on the property of Long Pond Estates based on John Davis' r--~r~ ~-~1 and ~223 and the attorney or the applicant be requested to meet with the Planning Board to discuss this matter further. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The secretary was instructed to forward a copy of the resolution and report #221 and #223 to the Building Department and same to be for- warded to the applicant. Soundview Acres at Orient - The board read a letter from Marilyn N0rkelun inquiring about the possible sale of property for-which the Town holds passbooks in the amount of $77,000 for road improvements dating back to 1976. Upon request of ~the Planning Board, the Town Attorney supplied the Planning Board with the legal status of this subdivision, in his letter of June 11, 1982. It was the concensus of the Planning Board to refer such information to the Town board and request their determination on the passbooks and what conditions the Town would place Qn this property. At this time the Planning Board pg. (5) 6/15/82 would like to reiterate their feelings that those bonds which have expired will not cover the costs for improvements made today. On motion ma'de by Mr. Latham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board deny the oriqinal subdivision map of Nicholas Fontana, dated June 30, 1979 and amended May 12, 1981 on which approval was endorsed by the Chairman September 14, 1981. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Wall, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the amended subdivision map of Nicholas Fontana, dated June 30, 1979 and amended May 12, 1981 and May 24, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the preliminary map entitled Richmond Creek Farms, located' at Peconic, with agreement of the Suffolk County Planning recommendations number two and three as stated in their letter of May 12, 1982. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The secretary was instructed to forward a copy of the road profiles to the Suffolk County Planning Commission to give them a better under- standing of the 60 foot wide street and to advise the attorney for the applicant to draw final maps. pg. (6) 6/15/82 On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the parking on the map of Southland Corp. which was certified by the Building Inspector June 5, 1982 for the proposed 7-Eleven store to be located at Southold. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the major subdivision known as Herbert R. Mandel~ Section I~ dated April 6, 1982 and amended May 14, 1982 with a condition that the section of the road to be stabilized for access of emergency vehicles to Section I be included in the bond. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowsk~ Wall On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the major subdivision known as Herbert R. Mandel, Section I, located at East Marion. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The secretary was instructed to request the filing fee for this pro- posal and have the applicant proceed with Chapter A106-13. On motion made by Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED that the two-lot subdivision map entitled Vincent Annabel be amended by extending lot number one east to west; south 20 feet and a copy of resolution to be forwarded to the Zoning Board of Appeals. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Pg. (7) 6/15/82 On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Baord declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Henry Tacar Et al, located at Laurel. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve a set-off 106-13 on the minor subdivision map of Henr~.Taca~ Etal, located at Laurel, dated May 14, 1982 with a condition that covenants be filed with the County Clerk's Office stating no further subdivision will be made on the parcel being set-off and receipt of the filing fee in the amount of $50. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the SouthOld Town Planning Board approve the sketch map of the manor subdivision of James Manos, located at Mattituck, dated July 1, 1981 and amended April 29, 1982 and a restrictive covenant to be placed on this property stating no further subdivision in ths future. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Frank W. ~brams~ Jr. - The Planning Board"will field inspect this property prior to taring any action on this minor subdivision. Robert & Jean Lenzner - The Planning Board will field inspect this property prior to taking any action on this minor subdivision. pg. (8) 6/15/82 Peconic Bay Cove - It was the concensus of the Southold Town Planning Board that the maps should be revised to reflect those recommendations stated in the Superintendent of Highway's letter dated May 19, 1982 concerning the leaching pools for this subdivision. Angel Shore Estates It was the concensus of the Planning Board that prior to taking any action on this proposal, that Lawrence Tuthill review this major subdivision and compute the runoff as the board questions the adequacy of the drainage areas. Cove Beach Associates - It was the concensus of the Planning Board to release lot 918 for the use of park and playground area within this major subdivision. Sea Aire Estates - It was the concensus of the Planning Board that no approval be given on said access until all the recommendations stated in John Davis' report #203 are met. To date, emergency turn- a-round has not been completed. On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept John Davis' report #222 for the improvement of the access road within the subdivision of Little Bay Estates, located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Wall, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board withdraw their resolution dated May 24~ 19.82 regarding the subdivision of Joseph Krupski, located at Southold. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall pg. (9) 6/15/82 On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board override Suffolk County Planning recommendation number five on the minor subdivision of Joseph Krupski, and the Planning Board to receive an executed copy of the boundary agreement within 30 days after the maps have been signed. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the preliminary map of the major subdivision known as Hill Crest Estates, located at Orient, subject to the maps being revised to reflect the Orient Fire Commissioner's request for firewells and the Suffolk County Planning recommendations. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall George Wells Estate - As a result of the board being advised of an error on the filed subdivision map, the board instructed the secretary to forward a letter to the applicant or agent advising them that amended maps reflecting correct boundary lines are to be submitted to the Planning Board office. Greenbriar Acres - The board reviewed correspondence from the Mattituck Fire Commissioners, stating there was no need to place fire wells with- in this abandoned subdivision. The board will review the files and compute the amount of money to be given to the town in lieu of park and playground. pg. (10) 6/15/82 Baxter Properties - The board made a field inspection on this property and noted corrections have been made on the violations on the bluff. Robert Wendell, builder, advised the board that he would be willing to place $1,000 in an escrow account to assure the board that he will plant the beach grass in the fall of 1982. Mr. Wendell estimated the cost to be approximately $500. On motion made by Mr. Latham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board recommend to the Building Inspector a release of the stop work order on the property of Baxter Properties~ located at Mattituck, subject to a one year review by the Planning Board. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall North Fork Bank & Trust~ Co. - The Planning Board inspected this property and as a result would suggest the use of the southeast corner of the proposed site plan, incorporating the bank into the south end of the existing block building on site, with additional curbing as this site distance at this juncture is best. An alternate location is to use the west boundary as initially proposed by the North Fork Bank. The objection to the proposed location on site is its proximity to both ingress and egress; the board feels this is not a position to block and congest these ingress' and egress'. The board also feels there is poor site distance from the west and the traffic flow pattern from the proposed site would be an additional burden on the site of the shopping center. The secretary was instructed to send such findings to the Zoning Board of Appeals. Joseph & Edwina Hataier - It was the concensus of the Planning Board that the maps be revised by moving each lot line in a northerly direc- tion making lot number four 60,000 square feet, lot number three, 60,000 square feet, lot number two 65,000 square feet and lot number one, approx- imately two acres, due to the contours of this property. ~igambO/Ma~ara - It was the concensus of the Board that prior to taking any action, the application, short environmental assessment form, no grading statement, and filing fee should be submitted.
