A meeting of the Southold Town Planning Board to be held on Fishers
Island, May 24, was cancelled because of weather conditions. As a
result, the Planning Board held a meeting at the Southold Town Hall,
Main Road, Southold, New York May 24, 1982 at 10:45 a.m.
Present were:
Chairman Henry E. Raynor, Jr~
Member William F. Mullen, Jr.
Member G. Ritchie Latham, Jr.
Member Bennett Orlowski, Jr.
Mr. Raynor opened the meeting with a discussion on the status of the
wetlands mapping. The secretary was instructed to type and distribute
a copy of those areas liSted in the report , now in the planning board
office, for the board members.
The board reviewed the proposed amendments to the Zoning Code as sub-
mitted~by the Town Attorney. It was the concensus of the board that
the current density of 6-3/4 per acre be reduced to five units per
acre without public water and sewer regarding multiple use district
109-50 (A) (B). Further discussion was held on money in lieu of
park and playground 106-38 (E) (3), and the possibility of designating
a special escrow account for the retention of such funds, .It was the
concensus of the board to reserve any comments on the amendment of this
section until such time as the board could discuss this matter further.

RESOLVED that the Southold Town Planning Board hold its next meeting
at Fishers Island June 15, 1982 with a departure' ~lig~t ~rom Mattituck

WAIVER OF NOTICE OF PLANNING BOARD MEETING
WE, the undersigned, being members of the Planning Board
of the Town of Southold, Suffolk County, New York, do
hereby severally waive notice of time, place and purpose
of the meeting of the Planning Board to be held at Fishers
Island, New York on May 24, 1982 and do hereby consent that
the same be held on said date at the Town Hall, Main Road,
Southold, New York, for the transaction of any business
which may properly come before said meeting.

RESOLVED to set 7:30 p.m., June 28, 1982, at the T~n Hall, Main Road,
Southold, New York, as the time and place for a p~b.lic hearing on the
question of the approval of the minor subdivision of Pudge CorD, lo-
cated at Southold.

Gould, located at Nassau Point.

On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED to set 8:00 p.m., June 28, 1982, at the Town Hall, Main Road,
Southold, New York, as the time and place for a public hearing on the
question of the approval of the minor subdivision of Herodotus Damianos,
located at Southold, subject to receipt of necessary forms and filing
fee.

On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED to set 8:15 p.m., June 28, 1982, at the Town Hall, Main Road,
Southold, New York, as the time and place for a public hearing, on the
question of the approval of the minor subdivision of Sal & Benny Caiola,
located at Greenport.

On motion made by Mr. Mullen, seconded by, Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board override Suffolk
County Planning recommendation number five., subject to receipt of a
signed copy of the boundary agreement which was submitted to the
Planning Board Mr. Mr. Stanley Corwin, Esq. on April 26, 1982 regarding
the minor subdivision of ~oseph Krups~i, located at Southold.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board grant a set-off (106-13)
as designated on the minor subdivision ma~ of PEter Kujawski, dated
May 6, 1982 located at Cutchogue, subject to the following conditions
within six 16) months from date of resolution:
1. Receipt of the filing fee in the amount of $50
2. Applicant receiving approval from the Zoning
Board of Appeals
3. Covenants and restrictions filed with the
County Clerk stating that the ri~ht'of-way
designated on the map runs with the land

Long Island Cauliflower Association - The~board read correspondence
from Pierre ~'. Lundberg, dated May 20, 1982. It was the concensus of
the board to refer said letter to the Town Attorney for legal opinion
regarding this proposed minor subdivision..
On motion made by Mr. Orlowski, seconded bly Mr. Latham, it was
RESOLVED that the $outhold Town Planning Bloard declare itself lead
agency in regard to the State Envir0nmenta~ QualitY ReviEw A'ct in the
matter of the minor subdivision of Gertrud~ Reeves, located at orient.
.An initial determination of nonsignificance has been made.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board grant a set-off (106-13)
on the property of ~ertrude Reeves as indicated on the map entitled
Edwin H. King Estate~ dated March 5, 1982, located at Orient, subject
to the applicant receiving approval from the Zoning Board of Appeals
within slx (6) months from date of resolution.

On motion made by Mr. Orlowski, seconded.by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve the site plan
known as Gardiners Bay Condiminiums; containg 19 units, located at
East Marion.

On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board recommend approval on
on 'the application of Stephen Shilowitz for a change of zone fron "C"
Light Industrial District to "M" Light Multiple Residence District
based on the following reasons:
1. Would upgrade the area
2. Would upzone the area
3. The operation will be serviced by both
municipal water and sewerage
4. Recreational boating, along with other
amenities would be conducive to the area

Stephen Shilowitz site plan - It was the concensus of the board that
the applicant submit three (3) copies of the site plan reflecting
amendments on the lighting fixture schedule and screening and buffer-
ing of the parking area prior to the board before making a final
determination on this proposal.
On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "James W. Dawson" located at
Bayview was submitted to the Planning Board on October 6,.1981
and, a filing fee in the amount of $100 was paid December 7, 1981 and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on April 26, 1982 at
8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations Of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVE~D that the application of James W.
pawson for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated April 27, 1982 , be approved and the
chairman be authorized to endorse 'approval on said subdivision plat '
subject to the following conditions:
No approval shall be given to this subdivision until
the question of adequate access for Lot 4 is satisfactor-
ily resolved. A twenty f~ot wide panhandle could be
added to the parcel so that Lot 4 will have frontage on
and access to Main Bayview Road. The creation of the
panhandle will resolve the' access question.
2. No lot shall be subdivided or its lot lines changed
in any manner at any future date unless authorized
by the Southold Tow~ Planning Board.
3. No stormwater runoff resulting from the development
of the subdivision or any of the lots shall be dis-
charged directly into any of the adjacennt bodies of
water.
4. No Sanitary disposal fa¢ili~y shall be installed or con-
structed within 100 feet of the upland edge of the
shoreline of the boat basin or Corey Creek.

Conditions 2, 3 and 4 shall be filed as covenants and
restrictions in~ the office of the County Clerk on or
prior to the granting of approval to this subdivision.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Woodhol!ow Properties~ Inc., located at
Orient was submitted to the Planning Board on January 11, 1982
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southotd, New York, on April 26, 1982 at
7:45 p.m., and
WHEREAS, the requirements of the Suod~vlslon~ ~ ' ' Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Woodhollow Prop-
erties, Inc for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated February 10, 1982 , be approved .and the
chairman be authorized to endorse 'approval on said subdivision plat
subject to the following conditions:
No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the
Southotd Town Planning Board.

A short radius curve, preferably with a radius no greater
than 20 feet, shall be provided at each corner of each
intersection to facilitate turns.
There shall not be any vehicular ingress and egress oni
Main Road for Lot 1.
No driveway or entrance road on Plum Island Lane shall be
located within fifty feet of the northerly right-of-way
line of Main Road.
Consideration shall be given to restricting access to Lot
4 to one of the two existing driveways, preferably the one
with the greatest sight distance and least interference
with the entrance to the State Park.
Ail stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall
be retained on the site by adequate drainage structures
so that it will not. flow out into Plum Island Lane and
Main Road.

The above conditions shall be filed as covenants and re-
strictions in the office of the County Clerk on or prior
to the granting of approval to this subdivision.

On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RE~OLVED that whereas~ a formal application for the approval of.a
subdivision plat entitled "Reliable Associates" located at
Mattituck was submitted to the Planning Board on November 20, 1981
and, a filing fee in the amount of $75 was paid on January 7, i982 and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold New York, on April 26, 1982 at
7:30 p.m., and '
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southo!d have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED tha~ the application of Reliable
Associates for approval of said subdivision plat prepared by
Young and Young dated January 27, 1982 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following condition :
The parcel desiqnated as 3A, to be conveyed to the northerly
parcel now or formerly Vincent & Stella Bialeski, is a non-
buildable lot as this parcel is ~nder 40,000 square feet.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board amend their resolution
dated May 10, 1982 as follows:
RESOLVED that the Southold Town Planning Board accept John Davis'
~nspection report ~215, dated April 20, 1982, on the minor subdivision
of Baxter Properties, located at Mattituck, and all improvements on
this right-of-way are to comply with the recommendations stated on
said report.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board instruct John Davis
to inspect the property of Little Bay Estates, located at Orient, and
report his comments and/or recommendations for the construction of
the right-of-way as designated on the filed subdivision map.

RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in the
matter of the minor subdivision of Mary H. Lockwood, located at New
Suffolk. An initial determination of nonsignificance has been made.

On motion made by Mr. Orlowski, seconded bY Mr. Latham, it was
RESOLVED that the Southold Town Planning Board grant a set-off (106-13)
as designated on the subdivision map of Mary H. Lockwood, dated May 6,
1982, l~cated at New Suffolk with a stipu'lation that the portion of
property being set off becomes merged with the adjoining property of
Mary Baxter Benbow.~

Roy Kigambo-Magara - The board reviewed this new proposed minor, located
at Mattituck. It was the concensus of the board that they field inspect
this property prior to making a determination.
Joseph & Edwina Hataier - The board reviewed this new proposed minor,
located at Orient. It was the concensus of the board that they field
inspect this property prior to making a determination.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board override conditions
one and two as stated in the Suffolk County Planning resolution dated
May 6, 1982 regarding the ma]or subdivision entitled Grand View Estates,
located at Orient.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board amend condition number
seven of the Suffolk County Planning recommendations, as stated in
their resolution dated May 6, 1982 to read:
Clearing and cutting of vegetation within 100 feet of
the t6p edge of the bluff shall be limited to that
necessary for maintenance.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that whereas, a formal application for the approval of a
subdivision D ~

Christine & Harold Reese, Jr. was submitted to the Planning Board
on January 14, 1981, and an application fee was paid on March 26,
1981, and ~
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York on March 22, 1982 at
8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and applica-
tion,
NOW, therefore, be it RESOLVED that the application of Ronald,
Christine & Harold Reese, Jr. for approval of said subdivision plat
prepared by Roderick Van Tuyl dated February 22, 1982, ~e approved
and the chairman be authorized to endorse approval on said subdiv-
ision plat subject to the following conditions:
No lot shall be subdivided or its lot lines changed
in any manner at any future date unless authorized
by the Town of Southold Planning Board.
No grading shall be permitted within 50 feet of the
top edge of the bluff except that that may be neces-
sary to control or remedy erosion or to prevent storm-
water from flowing over the edge of the bluff.
No sanZtary disposal facility shall be installed or con-
structed within 100 feet of the top of the bluff.
No stormwater runoff resulting from the development and
improvement of the subdivision or any of its lots shall
be discharged down the face of the bluff or directly
into Long Island Sound in any manner.
Clearing and cutting of vegetation within 100 feet of
the top edge of the bluff shall be limited to that neces-
sary for maintenance.
Access to the beach shall be by means of a suitable struc-
ture designed and constructed ina manner that will result
in the least disturbance of the stability of the bluff.
Conditions 1-6, inclusive,~shall also be filed as covenants
and restrictions in the office of the County Clerk on or
prior to the granting of approval to this subdivision.

Hill Crest Estates - The board reviewed the file of this major subdiv-
ision and instructed the secretary to forward a letter to the applicant
requesting revised maps to reflect the Orient Fire Commissioner's
request and the Suffolk County Planning recommendations.
North Fork Bank & Trust - The board reviewed this site plan as requested
by the Zoning Board of Appeals. It was the concensus of the board that
prior to making any comments on the construction of the drive-in facil-
ity with a canopy they will field inspect this property.
Kontokosta Change of Zone - The Planning Board made a field inspection
on this property. It was the concensus of the board that the applicant
schedule an appointment to meet with the Planning Board to discuss this
matter further before submitting recommendations to the Town Board.
On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in the
matter of the major subdivision of Constantine P. Georgiopoulos~
located at Southold. An initial determination of nonsignificance has
been made.

It was the concensus of the board that prior to any further action,
the board should be in receipt of correspondence from the Conservation
Advisory Council stating their comments and/or recommendations on this
proposed subdivision.
D.J. Clause Enterprises - A field inspection was made on this property.
It was the concenus of the board that the subdivision maps should be
revised to reflect two (2) lots; lots numbered one and two should be
designated as lot number one and lots numbered three, four, and five
should be designated as lot number two.

Hodor/Staller - The board made a field inspection on this Property.
It was the concensus of the Planning Board durin~ a field review of
the above captioned property that Phase I and Phise II be revised to
Phase I being lots 13-32 inclusive, plus 30-32 with a park area.
Road construction to be east-west road, 470 feet at the South end of
section I and 1,150 feet north and south within section I.
Section II consists of lots 1-12 inclusive, plus 33-35 and drainage
area. East-west roadway to be 800 feet on the sou~h end of Section
II and 900 feet running north and south within Section II.
The 17 acres of farmland south of Section ! should be labeled as
Section III.
Bayview ventures Ltd. - The board made a field inspection on this property.
it was the concensus of the Planning Board during a field inspection
of the above captioned property that the flag lot configuration on
lot #34 be eliminated. Additional roadway to be construsted for
ingress and egress at the northwest corner of the property running
south approximately 700 feet, then in a southeast direction intersect-
lng between lots seven and eight with roadway shown. This will also
provide access to the drainage area and would eliminate the cul-de-sac
street to the west of the existing roadway between lots three and six.
It is the concensus of the board that no waiver be given for one in-
gress and egress as there are not excess of 40 potential families
utilizing this subdivision.
The southerly terminus between lots 21-24, inclusive, should be rounded
out, taking property from lot 21 to create circular and large turn~a--
round as opposed to D-shaped. Further, the board would like demonstrated
the ability of swale drainage on the existing riqht-of-wa~ as presently
it is plus or minus 26 feet in road width prior to this road being
considered for a waiver. '
On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the sketch map
of the minor subdivision of Winifred R. Ca,rise, dated November 7, 1969
and amended February 3, 1982, located~at Orient.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board grant a set-off (106-13)
as designated on the minor subdivision map of Winifred R. Caprise
located at Orient, dated November 7, 1969, and amended February 3, 1982.

Settlers at. Oysterponds - The board reviewed the status of this pro-
posed subdivision located at Orient. It was the concensus of the
board to forward a copy of the computations the board determines as
not suitable for building to Mr. John Raynor. It was noted that the
board is not in receipt of correspondence from the Conservation
Advisory Council or the Soil and Water Conservation with regard to
this proposal. The board also discussed the possibility of a loop
street from Platt Road to be revised on the map.
Comprehensive Plan for Southold Town - It was the concensus of the
Southold Town Planning Board Ghat the firm Raymond, Parish, Pine &
Weiner, Inc., along with Ward Associates, be given an opportunity to
submit a no-cost proposal for specifics in updating the master plan
for Southold Town.
Southold Shores Tarpon Drive - The board stated that when the roads
were ~mproved they would be given approval of access.
On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board accept John~Davis'
road report ~220 regarding the road "Tarpon Drive", located within
the subdivision of Southold Shores and said report be forwarded to the
Building Inspector.

Southland Corp. (7-Eleven)- It was the concensus of the board that
they reserve any actions on this proposal until such time as they are
in receipt of a revised site plan.

a motion, seconded by Mr. Mullen, and carried to adjourn. Meeting
adjourned at 12:40 p.m.
