WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, '
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEG INNING at a point on the Northwesterly side of a right of way hereinafter described
where SaIIle is intersected by the Easterly line of land conveyed to Kenneth A. Therber and
Doris M. Therber, his wife, by deed recorded in Liber 8324 cp 43, said point being located
along the Northwesterly side of said right of way the following three (3) courees and
distances fro the Northeasterly side of We stphail a Road:
1. ) North 35 degrees 07 minutes 30 seconds East, 100.00 feet (along the Southeasterly line
ofland conveyed to Robert J. Munch and Isabel Munch, his wife, (by deed recorded in Libel'
5347 cp 259);
2.) North 52 degreee 37 minutes 30 seconds East, 100.00 feet; and
3.) North 59 degrees 37 minutes 30 seconds East, 30.0 feet, the last two (2) c.ourses being
along the Southeasterly line of said land of Kenneth A. Therber and Doris M. Therber;
RUNNING THENCE along the last mentioned land North 7 degrees 22 minutes 30
seconds West, 154.00 feet to the mean high water line of Darby's Branch of Mattituck
Creek;
RUNNING THENCE Easterly along said mean high water line a tie line course of North
50 degrees 15 minutes 10 seconds East, a distance of 176.69 feet to land now or formerly
of Rakowski;
RUNNING THENCE along said land of Rakowski South 1 degrees 07 minutes 30
seconds West, 200.00 feet to the Northwesterly side of said right of way; and
RUNNING THENCE along the Northwesterly side of said right of way South 59 degrees
37 minutes 30 seconds West, 130.00 feet to the point or place of BEGINNING.
TOGETHER with a right of way in common thirty feet in width from said Westphaila Road
along land of Peluso as above described for a distance of 100 feet; THENCE along the
Southwesterly boundary of premises herein described and being thirty feet in width at its
Southeasterly end tapering to twenty feet in width at 100 feet from Southwesterly end and
of a uniform width of twenty feet for 160 feet to the Easterly corner of premises.
THE GRANTOR herein is the SaIIle person as the grantee in a certain deed recorded in Liber
9079 cp 97.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anythlngwhereby the said premises have been encumbered in any way whatever , except as aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost ofthe improvement before using
any part of the total of the same for any other purpose.
The work "party" shall be construed as if it read 'parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
