BARGAIN AND SALE DEED
THIS INDENTURE, made as of November 30, 2004, between Joseph
J.FmlabeUa, having an address ml 99 Sheraden Avenue. Stalen Isiand, New York 10314
("Grantor"), and Joseph Falabella, Jr., having an address 31 99 Sheraden Avenue, StaIen Island,
New York 10314 ("Grantee").
WITNF.SSETH, that Granlor, in consideration ofTen Dollars and other valuable
consideration, the receipt and sufficiency of which hereby are acknowledged, does hereby grant
and release unto Grantee and his heirs. executors, administrB1ors, successors and assigns forever,

improvements thereon erected, situate. lying and being in Town of Southold, the
County of Suffolk, and the State of New York, being more particularly described
in Exhibit A attachcd hereto and made a pan hereof,

streets and roads abutting said premises to the center lines thereof,
TOGETHER with the appunenances and all the e~1ate and rights of Grantor in

TO HA Vii: AND TO HOLD the premises herein granted unto Grantee and his

Grantor is the owner of said premises. Said premises is not located in an

Grantor covenants that Grantor has not done or suffered anything whereby said
premises have been encumbered in any way whatever. except a.~ set forth herein.
Grantor, in compliance with Section \3 of the Lien Law, covenants that he will
receive the consideration for this conveyance and will hold the right to receive such
c~nsideration as a trust' fund to be applied first for the purpose of paying the cost of the
improvement before using any part of the total of the same for any other putpOSe.
RESERVING, unto the Grantor herein a life estate, entitling him to all of the
rents prolits and enjoyment" of the subject real property and burdening him with all of the cosl
