A regular meeting of the Southold Town Planning Board was held at
7:30 p.m., Monday, August 22, 1983 at the Town Hall, Main Road,
Southold, New York. Present were:
Chairman Henry E. Raynor, Jr.
Member G. Ritchie Latham, Jr.
Member William F. Mullen, Jr.
Member Bennett Orlowski, Jr.
Building Administrator Victor Lessard
7:30 p.m. Public Hearing on the question of the approval of the
minor subdivision of Elizabeth Diefendorf, located at New Suffolk.
Mr. Raynor presented proof of publication in the Suffolk Times and
Long Island Traveler-Watchman.
On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board despense with the
reading of the metes and bounds description of the property of
Elizabeth Diefendorf, located at New Suffolk.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Mr. Raynor: In review of the file we are in receipt of the filing
fee of '$50 from Elizabeth Diefendorf through the Town Clerk, legal
notice, notice of tonight's hearing,resolution from this board
setting this as the hearing day and time, negative declaration under
the State Environmental Quality Review Act, correspondence from
the Department of Health Services stating this department has no
objection to lead agency and at that time they had an incomplete
file on it which apparently has been corrected as we have a filed
copy signed by and approved by Robert Villa; Department of Health
Services, correspondence from the New York DEC in regard to Article
25 Wetlands, correspondence from the Suffolk County Planning Com-
mission: After study and deliberation it resolved to approve said
map subject to the following four conditions:

No lot shall be subdivided or its lot lines changed
in any manner at any future date unless authorized
by the Southold Town Planning Board.
No residential structure or sanitary disposal facil-
ity shall be installed or constructed within 100
feet of the upland edge of the tidal wetlands along
the shoreline of West Creek.

No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged
directly into the adjacent body of water and tidal
wetlands.
Conditions 1-3, inclusive, shall be filed as covenants
and restrictions in the office of the County Clerk on
or prior to the granting of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority
plus one of the Town Board of the Town of Southold after a public
hearing. The Commission also offers the following three comments:
1. It is suggested that the approval of this subdivision be
made subject to the Department of Health Services.
A short radius curve should be required at the north-
westerly corner of New Suffolk Avenue and Grathwohl Road
to facilitate the turning.
Since New Suffolk Avenue carries a considerable amount
of traffic, consideration should be given to restricting
vehicular access to Lot two to Grathwohl Road no closer
than 50 feet from the end of the short radius at the
corner. If access to New Suffolk Avenue is allowed then
a turnaround, such as a T-shapted shunt, should be re-
required so that a vehicle leaving the lot will not
have to back out into the traffic stream on the road.
Signed by Charles G. Lind. Correspondence from this office to the
applicant, correspondence to the New York State DEC, correspondence
from this office to the Suffolk County Department of Planning, a
copy of the covenants and restrictions, signed and noterized, cor-
respondence from this applicant back and forth, short environmental
assessment form, a statement to grading, roads and drainage signed
by the applicant, filing of the application for the approval of
plat, and a copy of the deed description. As is the procedure of
this hearing I will ask if there is anyone present this evening who
would like to speak in opposition to this proposed minor subdivision
of Elizabeth Diefendorf, located in New Suffolk? (Negative)

Mr. Raynor: Hearing none, Mr. Mullen do you have any questions?
(Negative) Mr. Orlowski? (Negative) Mr. Latham? (Negative)
There being no further questions from the Board then we will deem
this hearing closed.
On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board hold a public hearinq
on the subdivision to be known as Settler's at Oysterponds~ located
at Orient, subject to receipt of referrals made to appropriate
agencies involved.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Cutchogue Shopping Center - It was the concensus of the Board not
to take any action regarding correspondence from the New York State
Department of Transportation until a physical inspection of the
area is made by the Board with regard to the line of site for traffic.
7:45 p.m. Public Hearing on the question of the approval of the
final map of the major subdivision to be known as Highpoint at
East Marion, Section Ir located at East Marion. Mr. Raynor presented
proof of publication in the Suffolk Times and Long Island Traveler-
Watchman.
On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board despense with the
reading of the metes and bounds description on the property of High-
point at East Marion, Section I, located at East Marion.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Mr. Raynor: In review of the file we have in receipt of the filing
fee in the amount of $345 from the Town Clerk, notice of publication
signed by Joan Gustavson; Suffolk Times, noterized by Helen DeVoe.
The publication also ran in the Long Island Traveler for one week
commencing on August llth; signed by Pat Wood, noterized by Clement
Thompson. As this is a final hearing on this section most of the
factors involved have already been reviewed in the preliminary stage

Mr. Raynor: subsequent to that we are in receipt from our P.E.,
Randall Woodard, setting a bond amount for the roads and we are
in receipt from the Town Clerk's office a letter statinq the
Southold Town Board at its regular meeting on August 9, 1983
approved the amount of $370,753. for the performance bond for
Highpoint at East Marion, Section I, prepared by Mr. Woodard and
signed by Judith T. Terry. That was in response to a resolution
done by-this board recommending approval of that amount. The
rest of the correspondence and memorandums involve primarily the
engineering which has been worked out, pages and pages of it.
Copy of the legal notice; notice of hearing, copy of the resolution
setting tonight for a public hearing, copy of the resolution accept-
ing a report of Mr. Woodard and various reports subsequent and prior
to that with regard to the engineering as submitted. As is the
procedure with this board, we will ask if there is anyone present
this evening that would like to speak in opposition to this proposed
major subdivision known as Highpoint at East Marion, Section Iq
(Negative) Hearing none, is there anyone present this evening who
would like to speak in favor of this proposed ma3or subdivision of
Highpoint at East Marion, Section I? Mr. Young?
Mr. Howard Young: I would like to speak in favor on behalf of the
developer. The file is complete and the maps meets with your
board's requirements and if you would readily approve it so we can
get started on construction.
Mr. Raynor: Thank you. Is there anyone else present this evening
who would like to speak in favor of this proposed major subdivision?
(Negative) Is there anyone else present this evening that has some
information with regard to this proposed major subdivision of High-
point at East Marion that should be brought before this board at
this time? (Negative) Hearing none, Mr. Latham do you have any
questions? (Negative) Mr. Orlowski? (Negative) Mr. Mullen?
(Negative) There being no further questions from the board we will
declare this hearing closed and thank you for coming down Mr. Young.
Homestead Acres - Mr. Rudolph Bruer, Esq. advised the board that the
final maps will be forthcoming from the surveyor.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board accept Inspector
.John W. Davis' report #293 with regard to the access road within
the subdivision of Diana Day Latham, map of Ray Latham, located at
Orient.

Alfred E. & Claire Bouffard - Prior to preparing an official report
on the change of zone application from"B" Light Business District i
to "C" Light Industrial~District, the Members of the Board will make
a physical inspection of the property.
William Riley and Marco to Blake - The Board will request a determin-
ation from the Town Attorney regarding procedure of a proposed set-
off that does not meet the present zoning requirement of 80,000
square feet.
Old Town Park/James Bitses - It was the concensus of the board to
make an on site field inspection of this area prior to any action.
Windsway of Southold Associates - Mr. Robert Wendell met with the
board for a presubmission conference for a proposed medical center
at Southold. Mr. Wendell stated there would be interior circulation
for traffice throughout this property and the adjacent property to
the west. The Board asked that Mr. Wendell stake the location of
the proposed buildings for the board to inspect and notify the
secretary when this has been done.
Colonial Village - Mr. Dan Smith and Mr. Fred Rich met with the board
for a presubmission conference to discuss the construction of a
storage shed for lawnmowers and other equipment that contain gasoline,
for safety of~h~tenants.
On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the site plan
"Colonial Village at Southold" for the construction of a storage
building.

HUD project - The Board reviewed maps of property located on
Flint Street in Greenport. It is proposed that the three existing
lots "Greenport Driving Park" will be reduced to two lots to con-
tain a portion of a road which will be abandoned in the future.
This will create two 75' lots (width) from three 50' lots (width)
Mr. Lessard stated this would be no problem as it would be upzoning
the area. It is proposed that two houses will placed on the lots.
The Board stated they needed accurate maps to make a determination
and if necessary a special meeting would be held to meet the dead-
line of funding through a grant.
The following proposals will be held over until the board is able
to schedule field inspections:

Grand View Estates - After an on site field inspection by G. Ritchie
Latham, Jr., and discussion of same regarding the conditions of the
roads within this subdivision, it was the concensus of the Board
to accept the inspection report and allow building permits only~
subject to an inspection of the Building Inspector's office on this
property. Mr. Latham stated the roads were suitable for construction
vehicles to enter.
Woodbine Manor - Mr. and Mrs. John Fellinger Ihar were advised not to
attend this meeting to discuss the status of this major subdivision.
They were advised that the Town Board is setting up a review board to
determine what subdivisions would be exempt from the present two-acre
zoning.
Cranberry Acres - This item was removed from the agenda pending the
clear title of the area designated as dock area and computation on
the cluster proposal with regard to buildable property.

Being no further business to come before the board Mr. Orlowski
made a motion to adjourn, seconded by Mr. Latham, and carried.
