WITNESSETH, that the pany of the first pan, in consideration of Ten Dollars and other valuable
considerdtion paid by the party of the second part. does hereby grant and release unto the party of
the second pan. the heirs or successors and assigns of the party of the second part forever,
ALL that cenain plot, piece or parcel of land, with the buildings and improvements thereon
erected. situate, lying and being in the Town of Southold, County oC SufColk and State of New
York. known and designated as Lot No.5 on a cer18in map cntitled. "Map of Bennett's Pond",
filed in the Office of the County Clerk of Suffolk on June 12. 1970, as Map No. 5483, said lot
being bounded and described as follows:
BEGINNING at a point on the southcrly side oC Bennett's Pond Lane where same is intctSl.'ctcd
by the division line of Lots 6 and 5 on the above captioned Map;
RUNNING THENCE along the southerly side of Bennett's Pond Lane the following three (3)
courses and distances.'
1) North 60 degrees 37 minutes 10 SI.'Conds East, 21.38 feet;
2) Along an arc of a curve bearing to r1ie right, having a radius of 50.00 feet. a distance
along said curve of 88.98 feet;
3) North 27 degrees 33 minutes 30 seconds East, 43.83 feet;
THENCE South 29 degrees 32 minutes 00 seconds East, 242.13 feet;
THENCE South 74 degrees 41 minutes 10 seconds West, 136.21 fct:t to the first above
mentioned division line;
THENCE North 29 degrees 32 minutes 00 seconds West. 209.04 feet to the southerly side of
Bennett's Pond Lane and the point or place of BEGINNING.
TOGETHER with an undivided one-tenth (1/10) interest in two strips of land shown and
designated as HParkH on the HMap of Bennell'S POndH, filed in the Suffolk County Clerk's
Office on June 12, 1970 as Map No. 5483.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dllt\.-d 9/1212000. and ft.'corded 9119/2000, in the Office of the Suffolk County Clerk in
Liber 12071, Page 952.
TOGETHER with all right, title and interest, if any. of the patty of the first patt in and to any
streets and roads abutting the above described premises to the center lines thereof: TOGETHER
with the appurtenances and all the estate and rights of the party of the first pan in and to said
premises: TO HA VE AND TO HOLD the premises herein gnmted unto the pany of the second
patt, the heirs or successors and assigns of the patty of the second pan forever.
AND the patty of the first patt covenants that the pany of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whalever, except as
afol'l-said.
AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants that
the pany of the first part will receive the consideration for this conveyance aDd will hold the right
to receive such consideration as a truSt fund to be applied first for the purpose of paying the cost
of the improveml'llt and willllpply the same: first to tbe payment of the cost of the improvement
before using any pan of the lotal of the same for any other purpose.
The word "pany" shall be constrD\.'d as if it read "patti\.'S. whenever the sense of this indenture so
requires.
