MULLEN, Jr. Southold, N.Y. 1 1971 TELEPHONE 765-1938 A regular meeting of the Southo~d Town Planning Board was held July 11, 1983, at 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member William F. Mullen, Jr. Member G. Ritchie Latham, Jr. Member Bennett Orlowski, Jr. Building Administrator Victor Lessard 7:30 p.m. Public Hearing on the question of the approval of the ~. minor subdivision of Anthony and Helen Dris, located at Mattituck. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southcld Town Planning Board dispense with the reading of the metes and bounds description for the property of Anthony and Helen Dris, located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor presented proof of publication in the Suffolk Times and the Long Island Traveler-Watchman. Mr. Raynor advised Jeff Miller that the noterization of Joan W. Gustavson was not sufficient as she is not a corporate officer of the Suffolk Times. Mr. Raynor: Receipt from the Town Clerk's Office in the amount of $100, a copy of the legal notice, correspondence from this Board to the applicant setting tonight as a public hearing, correspondence from this Board to the Suffolk County Planning Commission, correspon- dence back: pursuant to Section 1333, Article XIII, they have no jurisdiction, correspondence from this Board to the New York State DEC, the Environmental Analysis Unit with regard to the state en- vironmental Quality Review Act, correspondence declaring this Board as the lead agency under the SEQRA, correspondence to the applicant's attorney and from his office in return. We have a copy of the declar- ation of covenants and restriction with regard to this premises stating pg. (2) 7/11/83 it would contain no more than four lots or parcels. At this point it is an unexecuted copy. Correspondence from the applicant's surveyor forwarding copies, application for plot approval, short environmental assessment form, metes and bounds description, the map we have is affixed with the Department of Health Services approval, signed by Robert Villa. As is the procedure with this hearing for a four lot minor situated in Mattituck, we will ask if there is any- one present that would like to speak in opposition to this proposed subdivision? (Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor sub- division? Yes? Helen Dris: I'm Mrs. Dris. The only thing is in the letter, the correspondence from Mr. Munzel that those lot lines could be changed at any time, the only thing is we always will leave it four. Mr. Raynor: That's correct. Yes. Mrs. Dris: I just wanted to make sure that you understood that. Mr. Raynor: Yes, in addition to Mr. Munzel's letter we would also note that it would not fall below the minimum requirements of the zoning ordinance. Mrs. Dris: Excuse me? Mr. Raynor: The lot line change would not be in a position to fall below the minimum requirements of zoning. Mrs. Dris: Yes, Oh Yes. It could%.nt be more than four but the lines could be changed at any time. Mr. Raynor: That's correct. That would be done through an amendment through this Board. Is there anyone else that would like to speak in favor of this proposed minor subdivision? Anyone present this evening that has some information that should come before this Board before it makes a decision, that may be neither pro nor con but would help this Board in reaching a determination? (Negative) Hearing none, Mr. Latham do you have any questiQns? (Negative) Mr. Orlowski? (Negative) Mr. Mullen? (Negative) Alright, there being no further questions or comments we will declare this-hearing closed and thank you for coming in this evening. Kathrine Farr Site Plan - Stanley Corwin, Mr. and Mrs. Farr met with the Board for a presubmission conference for a site plan proposing the construction of a building for a yacht rental station and office building for marine brokerage. This property is located in the Village of Greenport, not in the incorporated area. The building pro- pg. (3) -- 7/11/83 posed would be used for an office building and storage of equipment used to service the boats. Mr. Corwin stated they do not propose the use of more than four sailboats and one motor boat for the area and stated that customers do not generally leave their cars there during rentals because of inadequate protection. Mr. and Mrs. Farr~will operate this business. It was noted that five parking spaces are proposed for this area. The Board will inspect this area prior to the~next meeting of the Board. Mr. William Smith met with the Board to discuss Cranberry Acres at Bayview and Andrew Krupski. The Board reviewed revised maps of Cran- berry Acres noting the meadow land area as mapped by Roderick Van Tuyl. Also submitted was correspondence regarding nature conservancy for the~eadow lands and arial photographs of the area. On motion made by Mr. Orlowsk±, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board refer the sketch plan of Cranberry Acres at Bayview to the Southold Town Board for their approval regarding the location of this proposed cluster development. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Andrew Krupski - The Board advised Mr. Smith that the Zoning Board of Appeals has already granted approval for the undersized lots and re- quested that he submit the filing fee to the office and revised maps designating lot numbers one and two. Highpoint at East Marion, Section I - Mr. Howard Young met with the Board to discuss this proposal. It was noted that a meeting was held in the Superintendent of Highway's office regarding construction of the emergency access road within section II of the overall plan. The Board reviewed correspondence from Mr. Raymond C. Dean, Superintendent of Highways, dated July 11, 1983, regarding recommendations for the improvements to this portion of Road "B". The Board had no objections to Mr. Dean's recommendations and advised Mr. Young to amend the maps to reflect the necessary changes for referral to Mr. Randall Woodard, P.E. for a bond estimate and scheduling a date.~for a final hearing on the map. Mr. Young stated that mountable curbs were used in Southamton Town and are not very satisfactory. The Board asked for specific areas where they had been used so they could inspect them at a later date. pg. (4) -_J 7/11/83 John Simicich - Mr. Philip O'Frias, Attorney for Mr. and Mrs. Dolomite was present as the Board reviewed Inspector Davis' report #308 regard- ing access to the lots within this subdivision. Mr. O'F~ias stated the cost for the recommended improvements would be very costly to the present landowners and requested that another contractor submit differ- ent road specifications for the area that would reduce the estimated cost from $4,000 to $1,500. Question was raised as to who has the responsibility of cost for such improvements; the present landowner or the developer. It was agreed by the Board members that the Town Attorney advise the Board who is responsible. The Board did not take action on Inspector John W. Davis' report ~308. Sullivan/Preston Site Plan - An inspection of this property was made prior to the meeting. The Board noted there was ample parking (public) in the rear of the building and recommended that the applicants con- tact the Southold Town Board for permission for a "walk'~ through" access from this parking area. Mr. Preston and Mr. Sullivan stated they would propose to use red brick walkway. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town,Planning Board refer the site plan of Sullivan/Preston to the Building Department for certification. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Northwind Village - Mr. Kontokosta was present as the Board reviewed certification from the Building Inspector's Office. It was noted that no drainage plans have been placed on the proposed plan and parking relative to the dwellings are not shown. Mr. Kontokosta stated there will be garages for the dwelling units; the size of the units encompass the garages. Mr. KontoRosta stated this would be done when plans are submitted to the Building Inspector's Office. Mr. Lessard stated no objection to this and stated no objection to determining adequate drainage for the area with possible assistance from Inspector John Davis. Mr. Raynor'advised Mr. Kontokosta that the Suffolk County Planning Commission would have to review the pro- posed site plan. On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the site plan "Northwind Village" dated May 11, 1982, and certified by the Build- ing Inspector June 17, 1983. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (5) ~ 7/11/83 D.J. Clause Ent. - Mr. John Clause was present. After an on site field inspection it was noted that the subdivision map has been revised to reflect two (2) lots as requested'by the Board May 24, 1982. The lots proposed do not meet the requirements of the cur- rent zoning and would require approval from the Zoning Board of Appeals. The Board requesed a~disclosure statement listing all parties involved and a determination from the Zoning Board of Appeals. On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the SoUthold Town Planning Board declare itself lead agency with regard to the State Environmental Quality Review Act in the matter of the minor subdivision of D.J. Clause Ent. located at Mattituck. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept Inspector John W. Davis' report 9303 regarding satisfactory construction pf tje access road to lot 93 within the subdivision of Baxter Properties, I~c., located at Mattituck and said access road to be maintained at or above its present state. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold ToWn Planning Board accept Inspector John W. Davis' report ~300 regarding satisfactory construction of the access road within the subdivision of Phebe Bridge Estate, lo- cated at Southold, and Said access to be maintained at or above its present state. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (6) 7/11/83 Grand View Estates - The Board reviewed Inspector Davis' report 9292. Question was raised regarding comment number three/ drainage pond verses conventional fenced recharge basin, in which reference is made to designer's letter of December 21, 1982. It was the con- census of the Board to contact the Town Attorney for a legal opinion regarding liability. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southotd Town Planning Board approve the minutes of the meeting June 1~ 1983 at Fishers Island. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Robert Ringold/East End Car Wash Corp.~ - After review of Building Inspector's certification, the following action was taken: Applicant to amend site plan to reflect the following: (1) Section, Block and Lot Number (2) Zoning District (3) Parking Provisions (4) Proposed Drainage (No topo shown on plan) VFW Hall Site Plan - Mr. Andreas Markakis was present as the Board reviewed certification from the Building Inspector's Office. Prior to the meeting, the board inspected the area and stated no problems or objections to the number of parking spaces on the site. The Board requested Mr. Markakis to supply the Board with a survey des- ignating the widths of access (apron) and a letter regarding the drainage on the property for referral to the Building Inspector. pg. He stated this lot should not exist. Mr Latham expressed coi~cern for saltwater intrusion and also noted this area has not received Department of Health Approval. Re- viewing the large parcels, it Was n~ted that covenants and restric- tions would have to be placed Qn the property regarding one-family dwellings. The majority of thC Board agreed that this proposal is workable and to deny the density of 6-3/4 acre per unit could possibly lead to legal problems in the future. pg. (8) ~ On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the sketch map of Settler's at Oysterponds, dated June 18, 1983, with a request that the applicant give consideration to the option of moving the building envelopes as far north as possible. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board recommend approval for a change of zone from "A" Residential and Agricultural District to "M-l" Light Multiple Residence District on certain property located at Greenport in regard to the petition of Brecknock Assoc- iates with a condition that the density for this area be restricted to no more than 350 units. Vote of the Board: Ayes: Raynor, Multen, Orlowski Opposed: Latham The following new proposals were scheduled for an on site field in- spection: Elizabeth Schweiger at Southold~ Catherine Heins at Orient~ Charlotte Gadomski at Southold and Leon Marcus at Orient. The sec- retary was instructed to search the Planning Board files for records of a prior submission and ZBA approval regarding Leon Marcus. Hallock E. Tuthill - Prior to any action by the Board it is requested that the applicant submit six (6) copies of an updated survey to the office, as the maps submitted are dated May 13, 1937. On motion made by Mr. Latham,seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board approve a set-off (106-13) as designated on the surveyed map of Lawrence Dorman, Joseph Townsend, Jr., John A. & Anne MacKay & Alison Millis~: , located at Orient, dated May 12, 1983 with a condition that the 25' right-of-way be maintained and any future application to subdivide said property to contain no more than four (4) lots. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (9) 7/11/83 Russell and Joan Mann - Following an on site field inspection and discussion of same the following action was taken: On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Russell E. & Joan A. Mann, located at Southold. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Rayn~r, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the minor subdivision of Russell E. & Joan A. Mann~ located at Southold, dated July 9, 1982 and revised June 16, 1953. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Director's Seat/Razmataz- Following an on site field inspection and discussion of same the following action was taken: On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town PlanNing Board approve the site plan "Razmataz", dated June 20, 1983, subject to the following conditions: (1) The area leased from Joseph Crenshaw to be fenced or guarded off so that ingress and egress will not be from the westerly access and solely on the easterly portion of applicant's property. (2) Existing sign to be removed. (3) Approval from the Zoning Board of Appeals. (4) One year review by the Planning Board. (5) Site plan approval expires when lease ex- pires. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg. (10) '- 7/11/83 Future Machines Site Plan - After an on site field inspection to this property and discussion of same, it was the concensus of the Board that the site plan be amended by increasing the easterly side yard to a minimum of six (6) feet and the westerly driveway to a minimum of 12 feet. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board recommend approval of the proposed Local Law to Amend Chapter 100 (Zoning) of the Southold Town Code in Relation to Area and Yard Regulations. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Goose Bay Estates~ Access to lot #21 - Following an on site field inspection and discussion of same, it was noted that both access roads to lot ~21 are inadequate at the present time. It was noted that from Birch Avenue traffic can not be seen from the west due to a 1200+ turn. It was also noted that the slope on this road was approximately 12© - 15©. It was the concenus Of the inspection team that the access be brought up to specifications recommended in Inspector John Davis' reports 4304 or #256. The following action was taken: On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED ~hat the Southold Town Planning Board accept Inspector John W. Davis' report ~304 with regard to an alternate access to Lot #21 in the subdivision known as Goose Bay Estates.
