BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
'by Executor's Deed dated 10-26-1971 and filed in the Office of the Clerk of Suffolk
County on 11-3-71 in Liber of Deeds 7039 at Page 232.
TOGETHER with all right, title and interest, if any, of the party of the fimt part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all
tht; estate which the said decedent had at the time of decedent's death in said premises, and also the estaie therein,
which the party of the first part has or has power to conveyor dispose of, whether individually, or by virtue of said
will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heim or successom and assigns of the party of the second part forever.
AND the party of the first part covenants that the party ofthe fimt part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaid.
AND the party ofthe fimt part, in compliance with Section 13 of the Lien Law, covenants that the party of the fimt
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied fimt for the purpose of paying the cost of the improvemenl and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot piece or parcel ofland, with the buildings and
improvements thereon erected, situate, lying and being at Bayview, in the
Town of South old, County of Suffolk and State of New York bounded and
described as follows:
BEGINNfNG at a point on the ordinary high water mark of long Island
Sound al: the northeasterly comer of the premises hereby conveyed and
adjoining land now or formerly of MaIm; running thence along said land
now or formerly Maim South 22 degrees 31' 10" East 1 004.92 feet; running
thence along land of Joseph Wierbicke and Elizabeth N. Wierbicke, his wife,
South 84 degrees 10' 30" West 243.25 feet; running thence along other land
of Joseph Wierbicke and Elizabeth N. Wierbicke, his wife, and parallel with
the first-described boundary North 22 degrees 31' 10" West 935.00 feet
more or less to said ordinary high water mark of long Island Sound; running
thence along said ordinary high water mark of long Island Sound North 67
degrees 28' 50" East 233.49 feet to the point or place of beginning.
Containing 5.188 acres. ALSO a right-of-way one rod in width over land of
Joseph Wierbicke and Elizabeth N. Wierbicke, his wife, abutting the easterly
boundary of said land and running from the southerly boundary line of the
