MULLEN, Jr. Southold, N.Y. 11971 TELEPHONE 765-1938 A meeting of the Southold Town Planning Board was held, Tuesday, May 3, 1983 at 2:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member William F. Mullen, Jr. Member G. Ritchie Latham, Jr. Briscoe Smith - No action was taken on this proposal as this meeting was scheduled for Fishers Island. Because of weather conditions this meeting was held at Town Hall. Phebe Bridge Estate Inspection Report ~285 - It was the concensus of the Board not to take any action regarding the approval of this right- of-way until said improvements comply with the recommendations of Inspector John W. Davis. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept Inspector John W. Davis' report ~286 for the approval of the access road within the subdivision known as Little Bay Estates (David Brawner) and said access road to be maintained at or above its present state~ Vote of the Board: Ayes: Raynor, Latham, Mullen, ~ pg. (2)' ~j 5/3/83 On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of James P. Horton & Daphne M. Horton, located at Cutckogue. An initial determination of nonsig- nificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve a set-off (106-13) as designated on the subdivision map of James P. Horton & Daphne M. Horto~, located at Cutchogue, dated February 19, 1980 and amended January 14, 1983, subject to completion of the State Environ- mental Quality Review Act. Vote of the Board: Ayes: Raynor, Latham, Mullen Anthony & Helen Drls - The Board reviewed correspondence from Mr. John Munzel, Esq. regarding further subdivision for this property. It was the concensus of the Board to request that covenants and restric- tions be filed with the Planning Board office stating that no more than four (4) lots would be crea~ed on the entire premises at any future date. The Secretary was instructed to advise Mr. Munzel that compliance with Article 6 of the Suffolk County Department of Health Services would be required prior to the scheduling of a public hear- ing. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept the professional services of Randall Woodard, P.E., on a predium basis, for final review of the proposed subdivision of Highpoint At East Marion~ Section ¥ and set a bond estimate for road improvements within this subdivision. Cost for services rendered to be $200. per day. Bay View Ventures, Ltd. - It was noted that the resolutions for sketch approval and declaration of lead agency was erroneously ommitted from the minutes of the Planning Board meeting held December 13, 1982. The ~-~ pg. (3) -- 5/3/83 following action was taken: On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to add the following resolutions to the minutes of the Plan- ning Board meeting held December 13, 1982. RESOLVED that the Southold Town Planning Board declare itself lead aqency in regard to the State Environmental Quality Review Act in the matter of the major subdivision to be known as Bay View Ventures, Ltd. located at Mattituck. RESOLVED that the Southold Town Planning Board approve the sketch map of the major subdivision to be known as Bay View Ventures~ Ltd.., located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen George Malis It was the concensus of those present that to proceed with this subdivision that a 50 foot'reserved area for road construc- tion for possible future dedication to the Town of Southold be placed at a 90© angle to Bight Road to the west of this property. Said 50 feet should extend to the easterly boundary. Fellinger-Ihar - The Board reviewed correspondence from the Suffolk County Planning Commission regarding the drainage within this four lot subdivision. It was the concensus of the Planning Board to have Mr. John W. Davis, Inspector, inspect the area and report to the Board his findings. Settler's at Oysterponds - As a result of much environmental input at the past public hearing and questions of the Board, it was the concensus of the Board to request the Town Attorney's guidance on the possibility of proceeding with a determination under Part 617, State Environmental Quality Review Act i~s authority as lead agency in the procedures for typing this subdivIsion. pg. (4) '~ 5/3/83 The following was introduced by Mr. Mullen, seconded by Mr. Latham, and carried. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Edward Zuhoski Estate is a three (3) lot subdivision located at Cutchogue. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. There is no record of an application to this Department and test well data is needed. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations- Further information can be obtained bY contacting Mrs. Susan E. (5) 5/3/83 The following was introduced by Mr. Latham, seconded by Mr. Mullen and carried: , Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Elizabeth Diefendorf is a two (2) lot subdivision located at New Suffolk. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The New York State Department of Environmental Conservation has responded to the lead agency designation. It appears that a permit is required from the NYSDED in accordance with the Environmental conservation Law, Article'S25' Tidal Wetlands Act. The Suffolk County Department of Health Services has in- dicated no objection to designation of lead agenby status. The application recieved by this department is incomplete. Test well data and test hole data is needed. Approval of the Department of Environmental Conservation ~a~ be re- quired. The project will meet all the requirements of the Code of the Town of Southold Subdivision-of Land Regulations. Further information can be obtained by contacting Mrs. Susan E. (6) ~ 5/3/83 Bay View Ventures, Ltd. - The Board will request from the Superin- tendent of Highways and the Highway Committee if they approve the road width variance for the roads within this subdivision. VFW Hall - It was the concensus of the Board that Mr. Markakis amend his site plan to reflect a diagonal parking arrangement of no less than five (5) cars on the north side of the building, allowing both ingress and egress for traffic flow. Also to be shown on the map is the proposed buffering for the surrounding property lines. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board grant a 90-da¥ ex- tension on the approval of the minor subdivision of John J. Miesnerr Jr-, located at Mattituck, for the completion of filing and record- ing the covenants and restrictions in the office of the County Clerk. Expiration date, July 17, 1983. Vote of the Board: Ayes: Raynor;, Mullen, Latham Cluster Development - It was the concensus of the Board to contact the Town Attorney that in the event that the Town upzones lot area to 80,000 square feet, should the current requirements for cluster development under the present Zoning Code of the Town of Southold be amended to 80,000 square feet for computing maximum number of ltos for a given area. Major Subdivisions - It was the concensus of the Board to ask the Town Attorney what consititues a reasonable length of time when a proposal has been given sketch approval and the applicant proceeding to the preliminary stage. pg. (7) ~ 5/3/83 Outstanding Performance Bonds - Pursuant to discussion with Mr. Robert Tasker, Town Attorney, and discussion of same, the following list of performance bonds should not be extended and the Town Board advised of same.
