Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Member Bennett Orlowski, Jr. Building Administrator Victor Lessard 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of Eleftherios & Theano Pappas, Gregory & Alexandra Athanasopoylos, located at Greenport. On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board dispense with the reading of the metes and bounds on the property of the minor subdiv- ision of Eleftherlos & Theano Papp_~s, Gregory & Alexandra Athanas0poy~ ~los, located at Greenport. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor presented proof of publication in the Long Island Traveler- Watchman. Mr. Raynor: In review of the file we have correspondence to the appli- cant's attorney Mr. Price setting tonight as Public Hearing at this time and we are in receipt from the Town Clerk of the filing fee in the amount of $50 for this two lot minor subdivision. Further review of the file we have from the Suffolk County Planning Commission the following: At its regular meeting on March 2, 1983, reviewed the proposed subdivision plat above~ referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study_and deliberation it resolved to approve said map subject to Re following seven Condit- ions deemed necessary to help preserve the traffic safety and carrying capacity of Middle Road, a county road: pg. (2) 3/7/83 1. An easement shall be created for a common driveway access within the right-of-way. 2. There shall not be any ingress or egress to Lot 2 along Middle Road except by the common driveway access. 3. The driveway ~hall make an angle of at least 70° and preferably 90 with the county road. Each lot shall have a turnaround provision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. Ail stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out into the right-of-way of Middle Road. No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the $outhold Town Planning Board. Conditions 2-6 inclusive, shall be filed as covenants and restirictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restriction's can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board of the Town of Southold after a public hearing. Adjoininq property owners shall be entitled to notice of such public-hearing but their consent to such modification shall not be required. The Commission also offers the following two comments on the map for your use and consideration: It is suggested that the approval of this subdivision be made subject to the subdivision's meeting the requirements and standards of the Suffolk County Department of Health Services~. The creation of the landlocked parcel ( in this case Lot 1 ) is beleived to be contrary to state law. Your attention is called to Section 280-A paragraph 5, of TQwn Law as one of laws that may pertain to this matter. It is suggested that you have your attorney look into the legality of creating a landlocke~parcel, signed by Charles G. Lind. Further correspondence to the applicant's attorney declaring the Southold Town Planning Board as lead agency under the State Environmental Quality Review Act and approving the sketch plan on October 7th. As is the procedure with this Board we will ask this evening if there is any- one present who would like to speak in opposition of this proposed minor subdivision? Price, Jr. - Mr. Chairman, members of the Board, I represent the applicant. My name is Irving L. Price, Jr., Attorney at Law. My office is at 828 Main Street, Greenport, New York. I would like to point out two things I believe you haven't covered. The lot for each resulting lot would be more than an acre. The area being 1.G68 and the other being 1.139 acres and I don't know who the gentleman was who prepared the letter from the Suffolk Planning Board, but I respect- fully disagree with his interpretation of this as a landlocked lot. I believe the law says this is not a landlocked lot. Mr. Raynor: I think the Board agrees with your interpretation also Mr. Price. We've gone through this a number of times with the Suffolk County Department of Planning. Is there anyone else present who would like to speak in favor of this proposed minor subdivision? (Negative) Hearing none, is there anyone present this evening who has some infor- mation pertaining to this subdivision that should come before this Board at this time that maybe neither pro nor con but would help this Board in making a determination? (Negative) Hearing none, Mr. Orlowski? (Negative) Mr. Latham? Mr. Latham: Just that we don~t take their recommendation on the right- of-way. Mr. Raynor: Okay. We'll put that comment into the minutes. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the minutes of the Planning Board meeting held February. 7, 1983. Vote of the Board: Ayes: Raynor, Latham, Mullen, Ortowski Robert Rinqold Car Wash (Mattituck Holding Co.) Mr. Irving L. Price, Jr., Esq. and Robert Rinqold met with the Board to discuss the proposed carwash to be located in Mattituck. The Chairman stated the Board would listen but would not make a decision or take any action on the proposed site as the covenants and restrictions for the property would be forwarded to the Town Attorney for his review. The Board requested maps designating the proposed curb cuts, a planting and lighting sched- ule, type of material used for the area to be dust free and the buffering and planting schedule. The Board noted the parking easement was designa- ted on the map. It was the concensus of the Board to make an on site field inspection on the property and stated the ingress and egress was a serious consideration of the Board due to the line of site from this area. The Board asked that the Southeast corner of the property be staked and asked to be notified when such was done. Mr. Raynor referred to the elements of site plan in the Code of Southold Town regarding any questions Mr. Price might have. pg. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Richard J. Cron is a four lot subdiv- ision located near Greenport. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no _objection nor comments by that agency._ Because there has been no response in the allotted time from the Suffolk County Department of--Health Services it is assumed that there is no object~on nor comments by that agency. DESCRIPTION OF ACTION The minor subdivision of Richard L. Sadick & Murray Schlussel, is a two lot subdivision located at Cutchogue. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands. The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. The installation of subsurface sewage disposal systems will require the removal of any impervious materials and the re- placement with clean sand and gravel. Information on private wells in the area indicate a sufficient quanity of potable water. Prior to occupancY of the proposed h~uses, a complete water analyses will be required. It was noted that the attorney for the applicant Mr. Richard Cron, indicated the applicant's would be willing to work out an amenable lot layout and configuration of the roads within this subdiv- ision. On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the ma3or subdivision to be known as Angel Shore Estates, dated December 30, 1982, and compliance with Article 6 prior to the scheduling of a public hearing. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town P'lanning Board accept Inspector Davis' report 9281 regarding the improvements to the access roads within the subdivision of Flora S. Luce and George L. Penny III, located at Cutchogue. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski The Chairman referred the file of Tut's Acres to Bennett Orlowski, Jr. On motion made by MR. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board accept Inspector Davis' report and compliance with recommendations so stated for the improve- ments to the right-of-way within the subdivision known as Tut's Acres, located at Mattituck. Vote of the Board: Latham, Mutlen, Orlowski Abstained: Raynor Mr. Cross addressed the Planning Board stating the recommendations were not satisfactory as the Building Inspector Howard Terry approved the access when the subdivision was approved, as stated in the letter dated 1975. Mr. Lessard stated that the right,of-way had deteriorated over the last five or six years due to no maintenance. ~r. Lessard stated that the road should be brought up to specification so that emergency vehicles can pass in this area. Mr. Mullen stated there had been no turn-a-round provided for the area. It was the concensus of the Board to make an onsite field inspection of the area prior to the next meeting and Mr. Orlowski advised Mr. Cross to discuss this further with the Building Administrator. pg. (9) - _ 3/7/83 On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board rescind their motion for acceptance of Inspector Davis' report ~281 for improvements to the right-of-way within the subdivision known as Tut's Acres, located at Mattituck and the Planning Board will make an on site field inspection of the area prior to the next meeting of the Board.. Vote of the Board: Ayes: Latham, Mullen, Orlowski Abstained: Raynor Mr. Raynor, Chairman continued with the remainder of the meeting. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board accept Inspector John Davis' report ~279 and compliance with the recommendation for the addition of loam on the top surface to consolidate the gravel for the access road within the minor subdivision of Little Bay Estates, located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion mads by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planninq Board accept Inspector John Davis' report ~278 and compliance with %he recommendation that the surface should be reshaped on the access road within the subdivision of David L. Gillispie, located at East Marion. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board accept Inspector John Davis' report ~274 and compliance with recommendations for the improve- ment to the access road within the subdivision of Joseph & Edwina Hataier, located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski pg.. (10) 3/7/83 It was the concensus of the Board to make an onsite field inspection on the properties of Leon Marcus~ James P. Horton and George Malis prior to the next meeting of the Board. The Board reviewed the petition referred from the Town Clerk's Office of Lawrence Bruno requesting a change of zone from "A" Residentia.1 and Agricultural District to "M-l" General Multiple Residence District on certain property near Greenport'. It was the concensus of the Board to make an on site field inspection of the property prior to the next meeting of the Board. It was note,d this property has previously been before the Board under the name ofl Maidstone. Lynn San Andres/Kigambo-Magara - Mr. Rudolph Bruer, Esq. met with the Board to discuss the status of thi!s subdiVision. Mr. Raynor advised Mr. Bruer that.the Board was not i~ a position to-proceed with this application as a duplicate applicaition is on file in the Planning Board office. Mr. Bruer stated he would forward a copy of the title to the office and would also have Mr. Magara's attorney forward a letter disclaiming the applicationi. Mr. Raynor said all information would be referred to the Town Attorney for his legal advise. On motion made by Mr. Orlowski, seconded by Mr. Mullen,-it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Marion ISadick and Murra¥'Schlussel located at Cutchogue was submitted to th~ Planning Board on October 4, 1982 and, a filing fee in the amount cf $50 was paid on ~ecember 7, 1982, and, WHEREAS, a public hearing~was he~d on-sai~subdivision application and plat at the Town Hall, South~ld, New York on ~ebruary 7, 1983 at 7:30 p.m., and WHEREAS, the requirements of the_ Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of Marion Sadtck and Murray Schlussel for aPp~ova~ of said ~ubdivision plat prepared 'by Roderick Van Tuyl, P.C~ dated_ September ~, 1981 and-amended No¥- -~mber 10, ~982, be approved and ~he Chairm&n be authorized ~o endorse approval on said subdivision pla~ subject to approval b~ ~he ~oning - Board of Appeals and Department Of Environme'n~al_Conservation permit if_ necessary. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Plsnning Board set March 28, 1983 at 7:30 p.m. at the Town Hall, Mai~ Road, Southold, New York as the time and place to hold a public he~ring on the question of the approval of the minor subdivision to be known as Greenbriar Homes~ located at Mattitucko Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board accept Inspector John Davis' memorandum dated February 1~, 1983 regarding approval of using stqn__e b~end as an alternate materi~l for the access road, where gravel had been recommended, within the subdivision known as Jonathan D. Stern at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski It was noted that a field inspection had not been made on James Manos property as the property had not b_en~ staked to date. The Board will inspect the property when they are notified when the r~ght-of-way has been staked. As the Board was unable to inspect the property of Northwind Village prior to this meeting, they will inspect it prior to the March 28, 1983 meeting. pg. (12) 3/7/83 Cutchoque Shopping Center/Suffolk County National Bank - The Board reviewed correspondence from Gary J. Arzt in which he requested the Board to approve the issuance of a building permit prior to getting approval for a central curb cut from the Department of Transportation. The Board noted the location of the proposed bank would create a very critical situation if the curb cut was not approved by the state. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED to reiterate Planning Board resolution of February 7, 1983 regarding approval of the site plan and location for the Suffolk County National BaRk, to be located at Cutchogue Shopping Center, subject to the applicant receiving approval from the Department of Transportation for a central curb cut for ingress and egress. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. DonatdTuthill addressed the Board regarding the 8:00 appointment for Gary Flanner Olsen, Esq to discuss the proposed subdivision of Donald & Lorna Tuthill. Mr. Raynor advised Mr. Tuthill that his attorney did not appear and the appointment would have to be rescheduled with the Secretary. It was noted that the policy of the Board is to discuss matters with the acting attorney when one has been appointed to represent a client. On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board refer the site plan of the Port of Egypt to the Building Department for certification. Vote of the Board: kyes: Raynor, Latham, Mullen, Orlowski Mr. Raynor asked the members of the Board to review Inspector John Davis' draft report regardinq improvements to access roads. This report will be discussed further when the Zoning Board of Appeals and Building Administrator submit comments and/Or recommendations to the Planning Board. pg. Mullent Jr.,_ dated February 7, 1983 as follows: TO: FROM: DATE: SUBJECT: Southold Planning Board William F. Mutlen, Jr. February 7, 1983 Moratorium on all Najor Subdivisions Your will recall, at our last meeting of January 10th, our Board once again stated our reluctance, for various reasons, in a moratorium at that time. I, realizing that the purpose was water conservation, decided to research the books and records of the Assessor's Office, Building Department and Planning Board with, I believe, startling but constructive results. The records for _the Building Department for the past decade - 1973 to 1982 inclusive, reflect toted permits of 4653, of which 1490 were for new dwellings, or an annual average of 149. I, therefore, reviewed the records in depth from 1977 to 1982 and arrived at g-figure of 717~new dwellings. In checking further, found 201 involved Najor Subdivisions, or 28% of all new private dwellings. Using the average of 28% for the past ten years, produces-417 units with an annual average of 42. ' The assessment roll and levy module indicafes ~812 residential units for the y~ar 1981 an~ 9894 for 1982 - an annual increase of 7E units-. I must, therefore, cdnclude that a moratorium, regardless of'.the period, would not be an effective tool to assist-in the ultimate desire to restric% water consumption. p~. (14) ~ - 3/7/'83 I am attaching hereto, information for the areas in Southold Township for the past quarter of a century which shows that for that period there are a total of llO Sub- divisions filed for, involving 2503 acres for 3034 plots on which 1286 units were built, for an average of 42%. Your further review of the enclosures, I ~ sure, will provide some unusual statistics which should be taken into consideration for future planning. For the past three years, there have been 6 Major Sub- divisions approved, involving 140 acres, lll plots on which, effective Nay 31, 1982, 13 units have been built. For the next 26 years, the following information might be of interest:- 1950's 4 194 109 56% 1960's 53 1619 823 51% 1970's 42 1024 327 32% 1980's 6 lll 13 12~% It is my belief that the focus of attention on the moratorium started in April of last year generated a con- siderable influx of filings. For the first thirty days of this year, we have ll submissions of Minor Subdivisions and, in addition, have received requests for applications for 15 more. Kindly note that, for the period starting 1981, there were 443 acres involving 344 plots for Major Sub- divisions and, for the first six months of 1982, there were 277 acres proposed having 235 plots. This is contrary to the report forwarded to the Town Board, dated June 22, 1982 by the Southold Moratorium Committee. I would be interested to research the accuracy of these figures. Thus, the application of a moratorium on Major Subdivisions, as requested, would have a minimal effect if, indeed, there is a water problem. Mr. Raynor-asked that the report be studied prior_to the next meeting of-the Board. pg. (25) ~r~ 3/7/83 Petition for a Moratorium - Mr. Raynor advised the Boaud members that he had contacted Mr. Howard Weissmen, ERM, to see if they could further define the water quanity and quality outside the budget areas. Mr. Weissman stated ~his could be done for a cost of $1,500, not to exceed $2,500. It was the concensus of the Board to hold the local law for a moratorium until further studies are made on the quanity and quality of water outside the budget areas in zones 2-5 before making a deter- mination. The time frame for said studies to be 3-5 working days. On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve a set-off (106-13) for a lot line change as designated on the map of John P.' & Linda F. Kowalski, formerly filed as Christine King Minor Subdivision ~117, subject to the applicant receiving approval for a variance re- garding road frontage from the Zoning Board of Appeals. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board grant a 90 day extention on the approval of the minor subdivision of New York Telephone/Kavanaugh for completion of conditions placed on the approval of said subdivision. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Richard Lark met with the Board to discuss Sebastian's Cove. Road profiles and drainage plans were submitted by Howard Young stating they conformed with Inspector Davis' recommendations in report 9247. Mr. Raynor stated they would be forwarded to the Superintendent of Highways, Town Engineer and Inspector Davis for comments and/or rec- ommendations. M~. Richard Lark, Esq. inquired about the status of James P. Horton minor subdivision. The Board advised Mr. Lark that an on site field inspection of the property would be made prior to the next meeting of the Board. It was noted that this property is not part of the County Farmland Preservation as it is too small. pg.
