Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. Mullen, Jr. Member Bennett Orlowski, Jr. Building Administrator Victor Lessard 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of Marion Sadick & Murray Schlussel~ located at Cutchogue. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board dispense with the reading of the metes and bounds on the property of the minor subdiv- ision of Marion Sadick & Murray Schlussel. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor: We should make notice that there is a incorrect state- ment in the legal notice in this particular proposed subdivision and that is the fact that the area contains .50 acres which in fact is not the case. The area contains one and three quarters. The original transcript that came down from ~. ~ to this office was in error. We have a copy of the proof of publication from the Suffolk Times which ran one week commencing on the 27th day of January 1983. (proof of publication was from the Long Island Traveler-Watchman as the Suffolk Times affidavit had not been received) signed by Pat Wood and noterized by Clement Thompson. And on review of the file from the Suffolk County Planning Commission: The Suffolk County Planning Commission at its regular meeting on February 2, 1983, reviewed the proposed subdivision plat entitled, "Minor Subdivision-~arion Sadick and~Murray Schlussel", referred to it pursuant to Section 1333 of the Suffolk County Charter. pg. (2) ~ 2/7/83 After due study and deliberation it resolved to approve said map subject to the following four conditions deemed necessary to help preserve the natural and aesthetic attributes of the shoreline of Eugene's Creek: 1. No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Town of Southold Planning Board. 2. No stormwater runoff resulting from the development-of the subdivision or any of the lots shall be discharged directly into the adjacent body of water. 3. No sanitary disposal facility shall be installed or con- structed within 100 feet of the upland edge of the tidal wetlands along the shoreline of the dredge canal. 4. Conditions 1-3, inclusive, shall be filed as covenants and restirctions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. The Commission also offers the following comment on the map for your use and consideration: It is s~gested that the approval of this subdivision be made subject to the subdivision's meeting the requirement s and standards of the Suffolk County Department of Health Services. Very truly yours, Charles G. Lind; Chief Planner Subdivision Review Section. And in reviewing this file, we have correspondence from this Board to the Planning Commission referrals, correspondence setting toniqht as a public hearing, copy of the legal notice, corres- pondence fro~ this Board to the New York State DEC with regard to the State Environmental Quality Review Act, correspondence back from the Department of Health Services: This Department is in agreement with your designation of lead agency. The installation of subsurface sewage disposal systems will require the removal of any impervious materials and the replacement with clean sand and gravel. Information on private wells in the area indicate a sufficient quanity of potable water. However, prior to occupancy of the proposed houses, a complete water analysis will be required, signed by Royal R. Reynolds. Correspondence from this office to the applicant's attorney's office with regard to the approval of the sketch plan. More correspondence on same. Here's a new one that came in today. Correspondence from the Southotd Town Board of Appeals: RESOLVED that the matter of Sadick & Schlussel, be and is held in abeyance pending written receipts of approval from the New York State Department of Environmental Conservation and the Suffolk County Department of Health Services. This resolution was adopted so the Board of Appeals has put this on hold. That pretty much completes the file, outside of some additional correspondence and Pg. (3) ~ 2/7/83 the filing fee received and the receipt here from the Town Clerk. As is the custom, we will ask if there is anyone present this evening who would like to speak in opposition to this proposed minor subdiv- ision? (Negative) Hearing none, is there anyone present this evening that would like to speak in favor of this proposed minor subdivision? Shepard Scheinberg, Esq.: I would just like to say that the application sets forth all of the background as to the particular subdivision. As to the Health Department, we already had obtained Health Department approval for this particular subdivision. I believe a copy of the survey with their approval has been included. Mr. Raynor: Yes, we have that. The Board of Appeals should have a copy of it. Mr. Scheinberg: I think we had sent along a copy to them as well. So I would ask the approval of this Board. Mr. Raynor: Okay, Thank you counsel. Is there anyone else present this evening who would like to speak in favor of this proposed minor subdivision? (Negative) Hearing none, is there anyone present this evening that may be neither pro nor con but should have some information with regard to this minor subdivision that should come before this Board? (Negative) Hearing none, members of the Board? Mr. Mullen? (Negative) Mr. Latham? (Negative) Mr. Orlowski? (Negative) Okay, the only thing I would notice is one that I brought up already, that the legal notice was in error and that the. . again I want to reiterate that the total area is an acre and three quarters as opposed to a half an acre as is indicated in the legal notice. And nurmber two back in 1974 there were DEC permits granted for three lots, permits have long since expired, so that will be a new ball game. Alright, there being nothing further then we will declare this hearing closed. Thank you for coming down. Highpoint at East Mari.on, Section I The Chairman noted that Mr. David Kapell, agent for the applicant filed correspondence regarding a disclosure statement which states: With respect to the application "Highpoint at East Marion" for a major subdivision, fee to the subject parcel is vested in Herbert R. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor presented proof of publication in the Long Island Traveler- Watchman. (Publication also ran in the Suffolk Times, but affidavits were.not yet received by the Board.) Mr. Raynosi~This is a final hearing. The Board is in receipt of the filing fe~zu~ the preliminary already and this is on section I. There have been very little in the way of changes since the preliminary hear- ing. Mr. Howard Young: Mr. Raynor, could I interupt, I have the final maps. Mr. Raynor: Just hang on to them. Fine Howard, you can file them with the secretary tonight . that's one . alright we'll take them. Let's have them. Sooner or later we're going to need them anyhow, right? I knew they would be forthcoming, I just didn't know from where. Mr. Young: That makes both of us. Mr. Raynor: Okay, we have reviewed this file once already in the pre- liminary hearing and outside of some engineering data that has been corrected and meets the approval as shown in the construction plans that were submitted to this Board on the 13th of December. It has the approval from the engineer, the Department of Public Works and the Department of Highways. This appears to be in good shape. We will ask, as is the procedure, if there is anyone present this evening who would like to speak in opposition to this proposed first section of Hill Crest Estates situated in Orient? [Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed major subdivision? (Negative) Hearing none, is there anyone present this evening that has some information regarding this particular sub- division that should come before this Board at this time wh'ich may be neither pro nor con but would help this Board in making a determination? (Negative) Hearing none, members of the Board? Mr. Orlowski? (Negative) Mr. Latham? (Negative) Mr. Mullen? (Negative) I should say that this Board has been to the field again with regard to this particular subdivision on a complaint thst the debris has been pushed over the bank and on inspection of the property we find that that is not the case. There has been some clearing done but we can find no pg. (5) ~.~ 2/7/83 signs in any place of any materials being pushed over the bank or anything that would in any way incur additional erosion on the site of the bluff or on the face of the bluff. Whatever consideration this Board would give within its 45 days would be subjeCt to the final recommendations and comments as applicable through th~ Suffolk County Planning Commission. Alright, there being no further comments then we will call this hearing closed. Senior Citizen Community - The Board discussed recent correspondence regarding this site plan. Consideration as to the location of the wells or hydrant would be made after the plans have been finalized by the Village of Greenport. The Board noted the traffic pattern to be good and also reviewed cer- tification from the Building Inspector's Office. Mr. Raynor asked Mr. Victor Lessard, Building Adminis- trator if this would pose a problem, as it is the Building Department that issues the Building permits. Mr. Lessard stated that his deter- mination regarding the improvements to a right-of-way should go to the edge of the property line and that area is to be designated as front yard rather that previous requirements of the right-of-way going 25' into the property for establishing a front yard. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board rescind Condition ~1 on the resolution of approval, dated May 24, 1982, for the minor subdivision of James W. Mr. Raynor stated the~BoardL would contact Mr. Davis and ask for his comments regarding this request. PG. (13) 2/7/83 The Board discussed with Councilman John Nickles the question of Planning Board determination regarding access roads outside the perimeter of the subdivison. I% was noted that this could be changed by the passage of a local law. Country Club Estates - The Board discussed Mr. Gary Flanner Olsen's letter of January 20, 1983 regarding the condition placed on the sketch approval regarding access to the lots. DESCRIPTION OF ACTION The minor subdivision of Robert & Jean Lenzner is a four lot subdivision located at Mattituck. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Con- servation it is assumed that there is no objection nor co~ents by that agency. It appears that a permit is required in accordance with the Environmental Conservation Law, Article 25, Tidal Wetlands Act. The Suffolk County Department of Health Services has stated no objection to lead agency designation. A precursory review of the subdivision indicated conditions are suitable for in- dividual sewage disposal systems; however, problems may be encountered with obtaining potable water due to the effects of agriculture on the groundwater supply. The project will meet ali the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Mrs. Susan E. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor co~ents by that agency° The Suffolk County Department of Health Services has stated no objection to the designation of lead agency. A precursory review of the subdivision indicates con- ditions are suitable for individual sewage disposal systems; however, problems may be encountered with ob- taining potable water due to the effects of agriculture on the groundwater supply. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations° Further information can be obtained by contacting Mrs. Susan E.
