Present were: Chairman Henry E. Raynor, Jr. Member G. Ritchie Latham, Jr. Member William F. On motion -made by Mr. Mullen, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board dispense with the reading of the metes and bounds on the property of Highpoint at East Marion, Section I. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Raynor: Lets review the file, and we are in receipt of a filing fee from the Town Clerk for the amount of $345 and we have a legal hotice both from the Suffolk Times and Long Island Traveler, copy_o~the description of property, correspondence from this board to Mr. Kapell approving the sketch plan, correspondence from this Board to ~he SubdiVision Review Section; the Suffolk County Department of Planning: In accordance with your request the staff has examined the proposed subdivision layout for a 58.336 acre tract reputedly owned by Herbert Mandel and offer the following comments on the map for your use. While the overall layout for the main part of the proposed subdivision ~s considered to be satisfactory the parcel labeled "future section" is of concern. The staff believes that the 138,000 square foot parcel should be part of the overall subdiv- ision and any proposal for subdividing the parcel in the future developed at this time. We are concerned about the access for this "future section", particularly since the fire house and post office are located nearby. Staff comments on the preliminary map do not constitute a review of the map by the Suffolk County Planning Com- mission. When the map has been finalized it should be referred ~o pg. (Negative) Is there anyone present this evening with regard to this subdivision who's comments and suggestions may be neither pro nor con but should come before this board at this time in helping us to make a determin- ation on this? (Negative) Hearing none, questions of the Board members; Mr. Mullen? (Negative) Mr. Latham? Mr. Latham: No, I'd just like to note the Suffolk County approved this water and sewerage. Is that right? Mr. Raynor: That is correct. That was in later correspondence to the office. Mr. Latham: Yes. Mr. Raynor: ~Mr. Orlowski? (Negative) The only' thing I can perceive that's missing from this file is the disclosure statement as to the actual owner of this property. We initially had a filing under Emar Farms, we have secondary amendment to that under Highpoint at East Marion. I can not find in the file a declarative statement as to the actual ownership of the property, whether it's a principal or a corp- oration. Mr. Kapell: No it's a principal and we will provide you with it. Mr. Raynor: It's a principal and that would be forthcoming. (10) .... 1/10/83 7:45 p.m. Public Hearing on the question of the approval of the minor subdivision of Richard J. Cron, located near Greenport, Mr. Raynor read the legal notice and presented proof of publication in the Suffolk Times and Long Island Traveler/Watchman. Mr. Raynor: We are in receipt of the filing fee in the amount of $100 from Richard J. Cron. In review of the file, we have a copy of the legal notice, resolution setting tonight for a public hearing, comments from the Suffolk County Department of Planning: At its regular meeting on December 1, 1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision-~Richard j. Cron", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map fo ~e fol- lowing reason: The proposed access by means of a right-of-way over two lots is considered to be poor planning and can result in conflict between lot owners over maintenance and use. The Commission also offers the following comment on the map for your use and consideration: It is suggested that the subdivision be redesigned using a road or a panhandle to provide access. Signed by Charles G. Lind. The Village of Greenport: The Greenport Water Supply can adequately supply water to the minor subdivision - Richard J. Cron - near Greenport comprising of four (4) building lots. It I can be of further service, please call and it's signed by James I. Monsell. The law office of Richard J. Cron a letter: The purpose of this letter is to indicate to the Board my complete disagreement with the ruling of the Suffolk County Planning Commission as indicated in the letter of Charles G. Lind, Chief Planner, dated December 3, 1982, in which it is indicated the Suffolk County Planning Commission disapproved the above minor sub- division map for the reason that a right of way running from Maple Lane to provide access to rear lots was considered to be poor plan- ning due to the fact that a conflict might arise between the owners of said lots. Needless to say~ I am utterly amazed at such reasoning in that on numerous occasions the Suffolk County Planning Commission has recommended common driveways-between adjacent.lot owners, tn those instances, at no time did the Suffolk County Planning Commission indicate that a conflict might arise between such owners. The Southold Town Planning Board has reviewed this minor subdiv- ision on numerous occasions and has seen fit to approve same as so indicated on the minor subdivison map. A review of all factors in- volved in this minor subdivision will, to the contrary, indicate that the layout of the right of way constitutes sound planning with respect to this specific minor subdivision. In this regard, the right- of-way comes directly off Maple Lane (a private road) in lieu of pro- viding access from the main highway to Lot ~1. Secondly, all of the lots on the proposed minor subdivision are furnished with public water from the Greenport Village Water District. Thirdly, the proposed right of way is not a public road but merely to provide ingress and egress for Lots 1 and 4. Finally, any possible conflict between lot owners relative to any right of way, remote or otherwise, is of no justifiable concern to the Suffolk County Planning Commission. pg. (11) .... 1/10/83 For all of the reasons above indicated, I would respectfully request that the Southold Town Planning Board override the recommendation of _~ the Suffolk County Planning Commission to disapprove the subject minor subdivision map; and it's s~gned by Richard J. Cron. There's correspondence in the' file to the applicant declaring this Board as Lead Agency with regard to this action, Approving the sketch plan on the date of September 20th, correspondence to the Suffolk County Planning Commission, correspondence under SEQURA to the Environmental Analysis Unit of the DEC, a short environmental assessment form signed by the applicant, metes and bounds description and correspon- dence, legal notice, description of premises, application for approval of plat in duplicate, also in duplicate a short environmental assess- ment form. That pretty much completes the file. As is the procedure of this hearing we will ask if there is anyone present this evening who would like to speak in opposition to the proposed minor subdivis- ion of Richard J. Cron, located near Greenport~ (Negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed minor subdivision? Jim Cron: Yes Mr. Chairman, I would like to just reiterate some of the comments of my father's letter of December 28th, and also add for the record that the letter of the Suffolk County Planning Commission as regards, in particular conflicts as to use and maintenance of what is a common driveway are substantially unfounded. Any conflicts which may arise would be taken care of by the seller, the grantor of the deed apportioning maintenance and use of the property to covenants and also maintenance agreements. I feel in many respects this letter is com- pletely incomprehensiable as it deals with private driveway from a private road. I see no way that the Suffolk County Planning Board, especially in light of this letter can any way see fit to usurp the judgement of this board who has reviewed this particular subdivision on numerous occasions. For that reason, gentlemen, I would ask that the board overrule the recommendations of denial Of the Suffolk County Planning Commission and approve this subdivision as this board has already approved it. Thank you. Mr. Raynor: Thank you. Is there anyone else this evening who would like to speak in favor of this proposed minor subdivision? (Negative) Is there anyone present this evening that has some information that should come before this board at this time pertaining to to this minor subdivision that may be neither pro nor con but should help this board in making a determination? (Negative) Hearing none, Questions from members of the Board? Mr. Orlowski? (Negative) Mr. Latham? (Negative) Mr. MuIlen? Mr. Mullen: Is it a matter of public notice we are to the Greenport Village Water District, have they assumed the responsibility for the water for this area, do you know? Mr. Raynor: To the best of my knowledge, based on a letter from Mr. Monsell, who's the head of the village public works, they have. And actually their pumping station, I believe it's number four, is about 1,000 feet north-northeast of this particular sector, so they pg. (12) 1/10/83 So they do have mains and acc~modations, there. Mr. Mullen: That was my only question. Mr. Ray,or: There on the east side of the tenth fairway, Bill, and they have a pumping station down there. Mr. Mullen: I see it. Mr. Orlowski: (inaudible) Mr. Raynor: Anybody with a slice, that's where they end up. I have one comment and that is I was not present at the Suffolk County Plan- ning Commission meeting and there is unfortunately quite a division of gpln~on on how minor subdivisions of this nature should be handled, and the Town.of Southo~d, Brookhaven, Islip, I would say with the ; , e o n o exception of~as~ ~amp~on and Southampton With regard the_use of this type, of common driveway as preferable the towns of East Hampton and Southampton regard the panhandle lots owned individually as preferable for their use. It's been a bone of contention up there for a couple of years and I'm not really sure how or if it's ever going to be re- solved and I thought I'd just pass that along to the Board. Alright there being no further discussion, we will deem this public hearing closed and thank you for coming down tohight. Mr. Frank Bear met with the Board to summarize the program on water studies-conducted by the League of Women Voters at their meeting of January 5, 1983. A copy of Mr. Bear's statement, along with minutes done by various representatives ~f different committees, was submitted to the Planning Board secretary for filing. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southo.ld Town Planning Board accept Inspector Davis' report ~267 regarding improvements to the access road within the minor subdivision of John Simon Estate, located at Peconic. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Peconic Knolls - R~'quest has been made for a release of the bond for improvements within this s~bdivision. The Board reviewed Inspector Davis' reports ~263 and #15. On motion made by Mr. Mullen, seconded by Mr.. Latham, it was RESOLVED that the Southold Town Planning Board accept Inspector Davis' report #263 and compliance of the recommendations in said report prior to releasing the bond on the subdivision known as Peconic Knolls, located at Peconic. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Jonathan Stern Minor SubdivisiQn - It was the concensus of the Board that a building permit-b~ issued for lot #3 on the filed sub- division map of Jonathan D. Stern, located at Orient, and that no CO is to be issued until the r~ght of way to said lot has been approved by the Planning Board. Prior to taking any action on Inspector Davis' report #268 an on site field inspection will be made on the property and the access road iH question. On motion made by Mr. Mullen, s~conded by Mr~ Latham, it was / RESOLVED that the Southold Town Planning Board forward a copy Of the Final Road & Drainage Plans for the subdivision' known as Gr~nd View Estates to Raymond ~. Dean; Superintendent of Highways, Lawrence Tuthill; Town Engineer and John Davis; Town Inspector for their review and comments regarding same to be submitted to the Planning Board. Kinq~ located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Latham reported, after an on site field inspection, a house and a large garage presently exists on the property in question. He also noted the right-of-way was graveled and in good condition. Mr. Edson requested that the Board approve of the Building Department issuing a building permit, subject to no CO being issued until the right of way to lot ~3 has been approved by the Planning Board. Mr. Edson referred to letter from George Fisher, Building Inspector, dated September 28, 1978, regarding the right-of-way and building permit for the property. Concensus of the board noted on page 13 of the minutes for January 10, 1983 regarding this right of way on the property of Jonathan Stern, located at Orient. Director's Seat at Mattituck - Mr. Mullen reported on the field inspec- tion made on this property. It was noted that there are two existing buildings in the rear of the property and they are not indicated on the maps filed in the office. Also noted was the site plan has no bufferIng along the front of the property. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the parking on the site plan of Director's Seat, located at Mattituck, subject to receipt of amended maps designating the two rear buildings will be removed and a planting schedule for the front of the property, and said maps being acceptable to the Board prior to signature. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Garrett Strang, representing the applicants stated there would be no problems in meeting the Board's conditions. pg. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Discussion on the question of moratorium within Southold Town - Mr.. Raynor opened discussion on the question of the status of those sub- divisions presently active before th~ board and tax abatements if a moratorium went into effect. Mr. Raynor polled the board for their comments regarding a moratorium within the Town. Mr. Mullen stated opposition to such aCtion and statedLif the Town entered into such, with knowledge that it was illegal, ~ndividuals could make personal suits, as well as the Town Board. H9 stated that the insurance 'policy would not cover individuals or board~members that knowingly support an illegal action. 'Mr. Latham stated he was not in favor of a mora- torium and information from Raymond, IParish, Pine & Weiner, Inc. would play a very important role in determining the need for one. Mr. Orlowski stated just the talk of a mgratorium has resulted in the loss of possible farmland sales, and~he was not in favor of one. Mr. Raynor noted it was the concensus of~the Board that all members had negative favor with the question of a moratorium within the Town and stated he would inform William R. PeI1, Town Supervisor, at their meeting January 11, 1983. (17) 1/10/83 On motion made by Mr~ Mullen, seconded by Mr, Latham, it was RESOLVED that the Southold Town Planning Board approve a set-off (106-13) as designated on the map of Andrew & Phyllis Catalano, dated June 19, 1970 and amended January 5, 1983, subject to receipt of a copy of filed and recorded covenants stating no further sub- division will be made on the parcel containing 3.7 acres in the future. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Prior to the above action, the Board reviewed correspondence from John E. Gillies, attorney for the applicant, in which the applicant states agreement to such covenants and restrictions. Also reviewed was a signed declaration on no further subdivision. Lute & Penny Minor Subdivision - The Board noted this minor subdiv- ision was approved in 1975, after which three of the four lots were sold. Upon application to the Building Department, it was discovered this subdivision was never]completed as it did not meet the conditions of approval. The Board reviewed correspondence from the Town Attorney regarding completion of this subdivision. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that approval be endorsed on the minor subdivision map of Flora S. Luce & George L. lenn¥, III subject to the following con- ditions: Certified funds to be held with the Town of Southold for the installation of leaching basins, in the amount of $25,000 subject to consideration of the Town Engineer's estimate. 2. Receipt of Department of Environmental Conservation permit for the meadow land area. Also noted was.Mr. Troy Gustavson declining from being a representative due to policy of the Suffolk Times. On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board, in an effort to re-eval- uate and upgrade agricultural values within Southold Town, forward a letter to all farmers listed in Farmland Phase II requesting them to contact the Supervisor of Southold Town and Suffolk County Legislature's office it they are in agreement with the Planning Board's efforts. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski The Board discussed the possibility of holding day meeting during the winter months. Each member stated there would be no problems with their schedules. pg. (19) ~ 1/10/83 North Fork Water Supply Plan - It was the concensus of the Board to forward the followin? report to the Suffolk County Department of Health Services for their review and consideration in the final stages, regarding the draft summary and recommendations which were distributed at the December 16~ 1982 meeting. The 1967 Malcolm Pirnie ~eports a total withdrawal in 1967 to be seven million gallons per day with population density of sixteen thousand people as a safe yield during a peak summer load leaving a minimum volume of three million gallons additional withdrawal available, provided we maintain twelve thousand acres in vegetable crop (primarily potato farms which acreage has deminished over 15 years) in addition 35,000 permanent residents and 45,000 seasonal. "Page 34 of the Malcolm Pirnie Report" - This indicates with- drawals of ten million gallons or three million gallons in excess of the 1966 withdrawals, may be safely made in the future under conditions of withdrawal designed to prevent salt water intrusion. Calling attention to nhe North Fork Water Study, page 1-3, table 1, utilizing zones three through five, plus 10% of zone two, this table indicates safe water withdrawal of 5,477,000 gallons per day for the Town of Southold which is in great variance to the above as indicated. In addition, agricultural listed in column 3,4 and 5 which show 3.19 gallons a day withdrawal estimated in the year 2000; this figure is in great variance of the Malcolm Pirnie Report of 1967. This section of the North Fork Water Study Plan leaves great reservation in our mind as to the availability of the fresh water without intrusion. We find great favor with analysis of ground water quality as the research done by the Suffolk County Depart- ment of Health Services and correlated by your committee is outstanding with regard to aldicarbs and other organics. pg. (20) ~ · 1/10/83 Regarding the water supply alternatives, as listed in varying levels, we feel this is a direct matter to be brought to the Town Board as it would require both public funding and legislature implementation of the water supply program. Your General Recommendation ~7 with re~gard to new sub- divisions in critical areas of insuring adequate 6apacity and supply, we will review this on Planning Board level to see if and when our Board would propose facility construc- tion by the developer during its bonding and construction period. Reference to Table ~! regarding zone 5, there appears to be, using your numbers, a wa~er withdrawal capacity of 460,000 gallons per day. Using an average quanity fiqure of 350,000 gallons per day, per dwelling, it should be adequate supply for 1,314 dwellings utilizing an average occupancy of 2.26 people per dwelling units. A population saturation in zone five would be 3,416 people. Given 1982 Long Island Lighting Company estimates, there are presently 1,497 people in the area. Also, the September 1981 school districts population report for 1980 shows the Oysterponds School District with 1,509 residents; both of these figures reflect a decrease in population from 1981 to 1982 of 1% and 1970 to 19S0 of 1.4%. Mrs. Ruth Oliva reported to the Board that major grading and clearing has been done on the major subdivision of Hill Crest Estates and questioned what action the board would take regarding the ~amages to the bluff. It was noted that a final hearing would be held on the subdivision at the next Planning Board meeting. The Board stated they would make an on site inspection of this area. pg.
