December 20, 2003, May D. Barbes, residing at 555 Sound
Avenue, Mattituck, New York 11952 and Edward w. Harbes,
III, residing at 715 Hallock Lane, Mattituck, New York
11952, as Trustees; as to a 13.5' interest in the
premises:

September 7, 2006, May D. Harbes, residing at 555 Sound
Avenue, Mattituck, New York 11952; and Edward W. Harbes,
III, residing at 715 Ballock Lane, Mattituck, New York
11952, as Trustees: as to a 13.,5' interest in the
premises,
party of the second part,
WITNBSSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid 'by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of the
first part's interest in
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying
and being in the Hamlet of Mattituck, Town of Southold,
County of Suffolk, State of New York, bounded and
described as follows::
BEGINNING at a concrete monument set on the northerly side
of North Road (Sound Avenue) at the southwest corner of
the premises herein described adjoining land of Ladsal
Realty Corp. on the west: RUNNING THENCE along said land
of Ledsal Realty Corp., North 22 degrees 12 minutes 30
seconds West, 1958.56 fee~ to land of Herbert M. Reeve:
RUNNING THENCE along said land of Herbert M. Reeve, two
courses and distances as follows:
1. North 69 degrees 36 minutes 30 seconds East 293.44
feet:
2) South 22 degrees 20 minutes 00 seconds East 2044.07
feet to the northerly side of North Road (Sound
Avenue): RUNNING THENCE along the northerly side of
North Road (Sound Avenue) South 85 degrees 38 minutes
30 seconds West 302.59 feet: THENCE South 83 degrees
45 minutes 30 seconds West 8.40 feet to the point or
place of BEGINNING.
BBING AND IIITBHDBD TO BB the same premises conveyed to the
Grantor by Deed dated December 20, 2003 and recorded in
the Suffolk County Clerk's Office on August 23, 2004 in
Liber 000012338 page 975 (as to a 4.5' interest), by Deed
dated January 10, 2004 and recorded in the Suffolk County
Clerk's Office on August 23, 2004 in Liber D00012338 page
976 (as to an additional 4.5' interest), and by Deed dated
January 3, 2005 and recorded in the Suffolk County Clerk's
Office on January 20, 2006 in Liber D00012431 page 865 (as
to an additional 4.5' interest), the Grantor being the
same person described as the Grantee in said Deeds.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the center
lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply
the same first to the payment of the cost of the
improvement before using any part of the total of the same
for any other purpose. The word "party" shall be
construed as if it read 'parties. whenever the sense of
this indenture so requires.
In Witness Whereof, the party of the first part has duly
executed this Deed the day and year first above written.
