EABEL AGREEMENT
AGREEMENT, made this 1- day of O't-u-~, 2001, by and between
~ ALISON B. REILLY (hereinafter referred to as" antor") and CHRISTOPHER J.
'*'*' REILLY and ALISON B. REILLY (hereinafter referred to as "Grantee").
WHEREAS, the Grantor is the owner of certain real property more particularly
described as follows (hereinafter referred to as "Parcel I"):
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Nassau Point, Town of Southold, County of
Suffolk and State of New York being bounded and described as follows:
BEGINNING at a point on the Southwesterly terminus of Smith Road; said point being
the following three (3) courses and distances from the extreme Westerly terminus of
curve which curve connects the Southerly side of Nassau Point Road with the Westerly

RUNNING THENCE from said point of beginning North 54043' 00" East 7.67 feet;
RUNNING THENCE North 78042' 10" East 196.70 feet to a point on a tie line along a
wood bulkhead and the mean high water mark of Little Peconic Bay;
RUNNING THENCE along a tie line along a wood bulkhead along the mean high water
mark of Little Peconic Bay the following three (3) courses and distances:
(I) South 30 09' 00" West 23.98 feet;
(2) South 70 39' 30" East 324.60 feet;
(3) South 70 58' 00" East 41.49 feet;
RUNNING THENCE South 780 42' 10" West 106.45 feet;
RUNNING THENCE South 540 43' 00" West 188.50 feet to the tie line along the mean
high water mark of Great Peconic Bay;
RUNNING THENCE along a tie line along the mean high water mark of Great Peconic
Bay the following two (2) courses and distances:
(I) North 320 21' 50" West 164.16 feet;
(2) North 350 29' 40" West 215.98 feet to Lot 83A;

RUNNING THENCE along Lot 83A North 540 43' 00" East 275.55 feet to a monument
on the Westerly side of Smith Road at the Southwesterly terminus of Smith Road and the
point or place of BEGINNING; and
WHEREAS, the Grantee is the owner of certain real property more particularly described
as follows (hereinafter referred to as "Parcel II"):
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Nassau Point, Town of Southold, County of
Suffolk and State of New York being bounded and described as follows:
BEGINNING at a point on the mean high water mark of Little Peconic Bay; said point
being the following eight (8) courses and distances from the extreme Westerly terminus
of curve which curve connects the Southerly side of Nassau Point Road with the Westerly
side of Smith Road:
(I) South 61027' 26" East 18.77 feet;
(2) South 16054' 00" East 99.25 feet;
(3) South 110 17' 00" East 101.90 feet to a monument;
(4) North 540 43' 00" East 7.67 feeet;
(5) North 780 42' 10" East 196.70 feet to a point on a tie line along a wood bulkhead
and the mean high water mark of Little Peconic Bay;
(6) South 030 09' 00" West 23.98 feet;
(7) South 070 39' 30" East 324.60 feet;
(8) South 070 58' 00" East 41.49 feet to the point of beginning;
RUNNING THENCE from said point of beginning along a tie line along the mean high
water mark of Little Peconic Bay the following eleven (11) courses and distances:

(4) North 85045' 40" East 3.80 feet;

(11) South 120 05' 28" West 229.26 feet to the mean high water line of Great Peconic
Bay;

RUNNING THENCE along the mean high water mark of Great Peconic Bay the
following six (6) courses and distances:
(I) North 080 23' 56" West 192.98 feet;
(2) North 08012' 06" West 286.57 feet;
(3) North 11042' 40" West 306.22 feet;
(4) North 18021' 00" West 273.75 feet;
(5) North 240 49' 50" West 209.98 feet;
(6) North 320 27' 50" West 56.28 feet;
RUNNING THENCE North 54043' 00" East 188.50 feet;
RUNNING THENCE North 780 42' 10" East 106.45 feet to the mean high water mark of
Little Peconic Bay and the point and place of BEGINNING; and
WHEREAS, the Grantor and the Grantee are desirous to establish a utility easement
across Parcel I, where the existing water service pipe now exists.
NOW, THEREFORE, in consideration of the sum of Ten ($10.00) Dollars and other
good and valuable consideration, the grantor does hereby grant unto the Grantee an
easement for the purpose of the installation and maintenance of any and all utilities,
including, but not limited to, water supply, electrical supply, and telephone, over the
following described strip ofland:
ALL that certain plot, piece or parcel of land situate lying and being in the Town of
Southold, County of Suffolk, and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point on the southerly terminus of Smith Road at the centerline of a
10' utility easement, said point and place of beginning being South 78 degrees 42
minutes 10 seconds West, a distance of 5.08 feet from the intersection formed by the
southerly line of Lot 82B with the southerly line of South Road as shown on a certain
map entitled "Amended Map A of Nassau Point," filed in the Office of the Suffolk
County Clerk as Map #156, and "Map of Section B of Nassau Point," filed in the Office
of the Suffolk County Clerk as Map #745;
RUNNING THENCE from said point and place of beginning South 08 degrees 42
minutes 10 seconds East along the centerline of said 10' utility easement a distance of
20.00 feet to a point;
THENCE South 16 degrees 16 minutes 50 seconds East a distance of 179.89 feet to a
point;
THENCE South 29 degrees 49 minutes 10 seconds East a distance of 258.00 feet to a
point;

THENCE South 22 degrees 04 minutes 00 seconds West a distance of 88.00 feet to a
point;
THENCE South 02 degrees 45 minutes 20 seconds East a distance of 58.39 feet to a
point;
THENCE South 74 degrees 14 minutes 00 seconds East a distance of 45.56 feet to a
point;
THENCE South 75 degrees 40 minutes 00 seconds West a distance of 8.0 feet, more or
less, to the dwelling and termination of 10' utility easement.
