THIS INDENTURE, made the 31st day of May, 2002.
BETWEEN THOMAS H. WITSCHI, as to an undivided 50% interest, and AUDREY B.
WITSCHI, as to an undivided 50% interest, both residing at 1695 Meadow Beach Lane, Mattituck,
NY 11952, Party of the first part,
and
JAMES P. MARTIN and DENISE N. MARTIN, his wife, both residing at 145 East 81" Street,
New York, NY 10028, Party of the second part,
WITNESSETH, that the party of the first part, in consideration of
Ten ($10.00) and no/100 Dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying, and being in the Town of Southold, County of Suffolk, and State of New York, more particularly
described on the attached Schedule A.
Subject to and together with rights of way of record, and subject to covenants, restrictions and agreements of
record.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party ofthe first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party ofthe first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
tile same for any other purpose. The word "party" shall be constmed as if it read "parties" when ever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.

SCHEDULE A - DESCRIPTION
AMENDED 05/31/02
ALL that certain plot, piece or parcel of land, situate, lying and being in the Hamlet of Mattituck, Town of
Southold, County of Suffolk and State of New York, more particularly bounded and described as follows;
BEGINNING at a monument at the southerly end of the easterly side of a 50 foot right of way, which runs
from the northerly side of the premises about to be described northerly to the southerly side of New Suffolk
Avenue;
RUNNING THENCE from said point or place of beginning, along the northeasterly side of a 20 foot right of way
the following three (3) courses and distances;
1. South 51 degrees 01 minutes 10 seconds East, 17.26 feet
2. South 62 degrees 32 minutes 50 seconds East, 69.37 feet
3. South 51 degrees 45 minutes 40 seconds East, 26.85 feet to the westerly side of lands now or
formerly of Paust;
THENCE along said westerly side of lands now or formerly of Paust and lands now or formerly of Alvin Smith,
the following five (5) courses and distances;
1. South 0 degrees 38 minutes 50 seconds West, 122.0 feet
2. South 4 degrees 20 minutes 00 seconds West, 120.00 feet
3. South 0 degrees 30 minutes 00 seconds East, 120.00 feet
4. South 6 degrees 05 minutes 30 seconds East, 195.63 feet
5. South 15 degrees 06 minutes 20 seconds East, 200.53 feet to the Average high water mark of Great
Peconic Bay, the last five Course sand distances being also the center line of a 20 foot right of way as
shown on survey by Van Tuyl & Son, licensed surveyors, dated July 31, 1972;
THENCE along the Average high water mark of Great Peconlc Bay, the tie line of which is South 74 degrees 54
minutes 37 seconds West, a distance of 159.94 feet to the lands now or formerly of Suter;
THENCE along said lands now or formerly of Suter, North 15 degrees 06 minutes 20 seconds West, 763.55
feet to lands now or formerly of Smith and Suter;
THENCE along said lands now or formerly of Smith and Suter, and along the southerly side of said 50 foot
right of way, first above mentioned, the following two (2) courses and distances;
1. North 74 degrees 53 minutes 40 seconds East, 119.14 feet
2. North 43 degrees 36 minutes 00 seconds East, 114.12 feet to the point or place of BEGINNING.
