estate and rights of the party of the first pan in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the parly of the second part. the heirs or successors and assigns of the party of the second part forever.
AND the party of the finn pari covenants that the party of Ihe first part has nO( done or suffered anything wherehy
Ihe said premises have been encumbered in any way whatever. excepl as aforesaid.
AND the parly of the first part. in compliance with Seclion 13 of the Lien Law. covenanls Ihat the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any pan of the total of the same for

SCHEDULE A - DESCRIPTION
ALL that certain plot, piece or parcel of land situate,
lying and being at Cutchogue, in the Town of Southold, County of
Suffolk and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point which is North 76 degrees 58 minutes 20
seconds West a distance of 100.0 feet from the intersection of
the westerly line of Meadow Lane and the northerly line of Case
Road; RUNNING THENCE from said point of beginning along the
northerly line of Case Road, North 76 degrees 58 minutes 20
seconds West, a distance of 125 feet to land now or formerly of
Lynch; RUNNING THENCE along said last mentioned land North 13
degrees 01 minute 40 seconds East, a distance of 230.40 feet to
the southerly line of land of the North Fork Country Club;
RUNNING THENCE along said last mentioned land north 89 degrees 42
minutes 10 seconds East, a distance of 128.15 feet to land now or
formerly of Beardsley; RUNNING THENCE along said last mentioned
land and land now or formerly of Godoff, South 13 degrees 01
minute 40 seconds West a distance of 258.65 feet to the northerly
line of Case Road at the point or place of BEGINNING.
TOGETHER with a free and unobstructed use in common with
other owners of a right-af-way for passage on foot over a certain
Private Road two rods in width running from New Suffolk Avenue in
a southerly direction to Peconic Bay. Said right-of-way being
bounded on the North by New Suffolk Avenue; on the East by land
now or formerly of Beverly King; on the south by peconic Bay and
on the West by land now or formerly of the Estate of George H.
Case, deceased.
BEING AND INTENDED TO BE the westerly portion of PARCEL III
as conveyed by deed dated June 5, 1952, from Ruth B. Case and
Corinne B. Case to Clifford T. Case and Marion T. Case, and which
deed was recorded in the Suffolk County Clerk1s Office on June 9,
1952 in Liber 3363, page 288.
The party of the first part, Clifford T. Case, acquired his
one-third (V3l interest under the Last Will and Testament of
Marion T. Case, wherein he was named as Clifford T. Case, Jr.
The party of the first part, David Terry Case, acquired his
one-third (V3l interest under the Last Will and Testament of
Marion T. Case, wherein he was named as David T. Case.
