AND the party of the first part covenants thut the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever. except as aforesaid.
AND the party of the first part. in compliance with Section I J of the Lien Law. \-'ovenants that the parly of lhe
first part will receive the L'onsideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund 10 be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land situate,
lying and being at Cutchogue, in the Town of Southold, County of
Suffolk and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point on the easterly line of Meadow Lane
(which point is North 13 degrees 01 minutes 40 seconds East, a
dis,tance of 340.00 feet from the intersection of the easterly
line of Meadow Lane with the northerly line of New Suffolk
Ave.nue); RUNNING THENCE North 13 degrees 01 minute 40 seconds
East, a distance of 120.23 feet to land now or formerly of Mary
Karen Land; THENCE along said last mentioned land and land now
or formerly of Wickham, North 89 degrees 56 minutes 40 seconds
East, a distance of approximately 370 feet to the westerly side
of West Creek; THENCE in a southerly direction along the westerly
side of West Creek 214 feet, more or less, to the northerly line
of land of Ernest W. Case and Janet P. Case; THENCE along said
last mentioned land South 76 degrees 58 minutes 20 seconds West a
distance of approximately 365 feet, to the easterly line of
Me2ldow Lane at the point or place of beginning.
TOGETHER with all the right, title and interest, if any, of
the parties of the first part in and to the meadow, waters, and
lands under water of West Creek in front of an abutting said
premises, to the center line thereof.
TOGETHER with a free and unobstructed use in common with
other owners of a right-af-way for passage on foot over a certain
Pri.vate Road two (2) rods in width running from New Suffolk
AVEmue in a southerly direction to Peconic Bay. Said right-of-
way being bounded on the North by New Suffolk Avenue; on the East
by land now or formerly of Beverly King; on the South by peconic
Bay and on the West by land now or formerly of the Estate of
George H. Case, deceased a
BEING AND INTENDED TO BE the same premises described as
PAHCEL IV in a deed dated June 5, 1952 from Clifford T. Case and
Marion T. Case, his wife, and Corinne B. Case to Ruth B. Case,
and which deed was recorded in the Suffolk County Clerk's Office
on June 9, 1952 in Liber 3363 page 282.
The party of the first part herein, David Terry Case (a/k/a
David T. Case) acquired his one-third (%) interest under the
Last Will and Testament of his aunt, Ruth B. Case, deceased, who
died a resident of Suffolk County, New York on 5/25/1971
(Surrogate's Court File No. 1134 P 1971), in which will he was
incorrectly named as decedentls nephew, David T. Case, Sr.
The party of the second part, Clifford T. Case, previously
acquired a one-third (Vo) interest under the Last Will and
Testament: of his aunt, Ruth B. Case, deceased, who died a
resident of Suffolk County, New York, May 25, 1971 (Surrogate's
Court File No: 1134 P 1971) in which will he was incorrectly
named as decedent's nephew, Clifford T. Case, Sr.
