The So~thotd Tov~'Board mos at the office of Supervisor S. Went-
worth Horton at Greenport, on Friday, June 21, 194~, The meet-
ing was called to order at 1:30 P.M. with the following=present:
Supervisor Horton~ Justices Terry, Hawkins and Klipp; Town Supt.
of Highways Price, Town attorney Terry and Town Clerk Booth.
The minutes of the previous meeting were read and duly approved
as read.
Moved by justice Hawkins, seconded by Justice Terry;
RESOLVE~. That Monroe L. Biggs of Greenpcrt be and hereby is ap-
pointed Special Constable while employed on the~property of Char-
les Sage to serve without pay and at the pleasmre of the Town
Board.

Moved by Justice Terry, seconded by Justice Hawkins;
RESOLVED: ~hat Lyle F. TUthill of Orient be ~ud he is hereby ap-
pointed as Trustee of the Town of South~ld to fill out the unexpir-
ed term of the late Frederick Tabor, said Lyle F. Tuthill to as-
sume the duties of said office as of this day.

RESOLVED: That the resolution on the East~est Greenport Fire
Protectio~ Distri¢~ which was duly adopted by this Board at a
regular Town Board Meeting which was held on ~ay 17, 1946, be ~
rescinded. ~

WHEREAS, There has been duly established in this Town a fire pro
tection District, ~ow~ as "East-West Greenport~ Fire Protec$ion Dis-
trier, Town of Southold, N.T." embracing territory in said Town
A~jacent to the Village of Greenport, New York, as such termitory is
more fully described in the resolution establishing such district
and duly adopted by this Board on the 14th day of November, 1945
and
~S, it was proposed that contracts be entered into with the
Villa. ge of Oreenpor~ for the furnishing of fire protection to such
district, and for the furnishing of water for fire protection pur-
poses through the said district, and
~REAS, due notice has been given ~ a public hearing to be
held at this Village on the 2nd day of April, ~946, at 8o'clock
P.M., ~o consider s~h a contract, the notice duly specifying the
tim~ and place of the hearing, as aforesaid, and giving in general
terms the proposed contracts, and all persons interest and appearing
having been heard, it is hereby
RESOLVED, that this Town B~ard enter into agreeE'ents with said
Village of Greenport for the furnishing of fire pre~ection and of
water for fire protection purposes, in such district, in substan-
tially the following form, and that these contract~ be executed o~
behalf of-this Board by the Supervisor of the Tows of Southotd:-
This Agreement, made this first day of July, 1946, between
the Town B~rd of the Tows of Southotd, Suffolk ~o~t~, New York,
hereinafter designated as Town, and the Village of Greenport, Suf-
folk County, New Y~rk, hereinafter designated as the Village,
WITNESSETH, WHEREAS, there has been duly established in the
S~&d Town a fire protection district known as "East-West Greenport
Fire Protection District, Town of Southold, N.Y~", hereinafter
designated as the District, embracing ~erritory in said Town adjacent
tO the said Village as such territory is more f~lty described in the
resolution establishing such District and duly adopted by the Town
Board of the Town on the 14th day of November, 1945, and
~WHEREAS, folloWing a public hearing duly called of the sa~d
~oard duly authorizing a contract with the Village for fire pro-
%~$%i~ %othe Distric~ upon the terms and provisions herein set
W3~REAS , this contract has ~2LSO been duly authorized
the Board of Trustees and the Mayor of the Village,
NOW, ~EFORE, the Town does engage the Village to furnish
such proteetion in the manner following, to wit.:-
i, The fi~e department cf the Village shall at alt times
during the per&od of this A-greenest be subject to call for at-
tendanc~ upon any fire o~curin~ ih said District, and when notified
by alarm or telephone call from any person within a distance of the
fire within the District, such department shall respond and attend
upon the fire without delay with one or more companies, and with
suitable ladder~ pumping and hose apparatus of the Village, as ~ol-
lows:-

~Upon arriving at the scene of the fire the firemen of the Village
attending shall proceed diligently and in every way reasonably
suggested to the exti[~guishment of the fi~e and the saving of life
and property in connection therewith.
It is understood and agmeed by the p-~ies hereto that the furni-
shing of ti~e apparatus of the Village ~ire Repartment and the re,
s~omse by the firemen shall be ~ubjeot to t~e order of the Chief of
the Fire Department ~f the Village, or his subordinates in aUthomity~
who, in their dis~etion in the event of any emergency~ as, for
example, another fire a~ the same time in the said Dist~i~t or in
the Village, may designate such men and apparat?s to any ~part, ie~tar
fire as they may deem nec~essary. Furtherm~e, the said Chief, or
his subordinates in authority, shall have a~sotute discre~io~ as
to the sending in of additional atar~ and ~a~i~g i~ response
to a fire the 'departments of other ~is~ricts;
~ ~neo~sideration of the furnishing aid and the use df
the apparatus as aforesaid, the Village shall receive the sum of
Thirty-six Hundre~ $~600) Dollars per year during the perio~ of
this Agreement.
3. All monies to be Daid under this Agreement shall be a
charge~mrthe said District, to be assessed and levied upon the
~axable property in said District and collected ~rith the Townl Ta~es,
an~ shall be ~ayahle as follows: $~,~00~ ~n the first day of Fe~-
ruary~ 15~?; $~80G. on the first day of February, t~; $~,~00~ on
the first day of February, t~; $3,800. on the first day of Feb-

4.~ This ~reement shall continue for a period of ~ive (5~
years from the date hereof.

Board of the Town on the 14th day of November, 1945, and

Board duly authorizing a contract with the Villege for.:the f~rnish-
ing of Water for fire protection purposes through the sai~ District,
upon 'the terms and provisions herein set forth, and
~REAS, this contract has also been duly a~thorized by the Board

NOW, ~,REMOHE, in consideration of the amount to 'be paid and
of ~the mutual covenants and agreements as hereinafter set forth,
lhe parties hereto a~ree as follows:-

hydrants per mite.

protection purposes the inctallatidn of hydrants at ~ rate of exceed-
ing ten hydrants per mit$is indicated in any portion of the district,
~he parties will agree upo~ ~he location of such hydrants, and, sho~d
they be unable ~o agree as between themselves as ~o the proper locatio~
of such hydrants, such hydrants will he instaZZed in accordance ~ith
the recommendations made by-th~ engineers or other representatives
of the Board of ~uburban Instance Underwriters or other appropriate
Board having authority ~o fix rates and 'establish rules for fire
insurance p~rposes,
4. In consideration for the installation of ~the hydrants and the
furnishing of water for fire protection purposes, the Tow~n shall pay
to the Village the sum of Forty ($40)Dollars per hydrant pgr year
for a term of five (5) years; The Village undertakes ~ furnish and
maintai~ sufficient water pressure to me~t the requirements of Board
~f Suburban Insurance Underwriters, or such other Board as has auth-
ority to establish specifications as to required pressure, for war-
ranting reduced fire insurance premium~ and the payments indicated
above shall be paid for those hydrants which meet such specifications
and requirements.
The liability of tee ~Towa for such payments shall commence when
notice to the effect that such hydrants have bee~ installed and ap-
proved has been given to the Town Clerk or To~n Supervisor by the
Village~ All payments due to the Village by the Town pursuant to
this agreement shall be made on the first day of February of every
year during the term of this agreement, at which time the Town shall
pay to the Village the amounts owing ~o and including the tkirty-
first day of De~ember of the preceeding year. In the event that
this contract is not remewed at the expiration thereof, the Tow~ ~hall
pay to the Vi~tage such amo.~nt as may be due at the termination of
this agreement within si~y (60) days after s~ch expiration.
5. Ali moneys to be paid under this agreement shall be a charge
upon the district to be assessed and levied upon the taxable property
therein and collected with the town taxes.
6. This agreement shall continue for a period of five (5) years
from the date hereof.
