Extend the landward end of the two eastern jetties up to 18', 6" below existing elevation, plant native grasses, and insta113' wide star for public access, and as depicted on the plan prepared by Sea Level Mapping last dated February 3, 2008. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. ~~vV -~COG~ » ~ O TERMS AND CONDITIONS The Permittee, Andrew McGowan Jr residi~ at 13350 New Suffolk Ave Cutchogue, NY, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation perfornted pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. To: Trustees Dave Bergen, Peg Dickerson, Jill Doherty, Bob Ghosio and Jim King Re: McGowan Application First, general observations. The application contains the words "in an attempt to" slow down erosion. The Conservation Advisory Council recommends that this project not be undertaken. The question in the application's "environmental technician review" is "Are jetties functional?" Basically, I believe that at least in this case they are NOT functional because there is a jetty to the east of the two proposed repair sites that is not functional. Further, are all of you aware that the horseshoe crabs whose numbers are in drastic decline along our shorelines congregate in great abundance there in May/June?? Has anyone explored the possibility that altering the currents/water flow and disturbing the shoreline and bottom in that area which is just west of the marsh might impact negatively on the crabs? Second, a specific observation. Policy 9 requires that land owners provide for public access between the high and low water marks. I walk the beach every day and, believe me, there is no access. One has to go around one of the jetties both because of its height and because of the erosion. Going around the jetty probably requires walking on private property. Nobody has ever objected to my walking there, but that is not an answer. I think that if the Trustees approve the application, at a minimum they should require that public access over them be provided. I looked at the plans and did not see any provisions for compliance with Policy 9. To summarize: first, I do not believe jetties will improve the situation and, second, the proposed repairs do not provide for compliance with Policy 9. I am opposed to the application. The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than SO linear feet from the tidal wetland boundary. 2. The authorized jetties shall not exceed 18" in height over the existing grade of the downdrift beach and shall not extend seaward of apparent low water. 3. No permanent structures shall be installed on the authorized jetties without first obtaining written Departinent approval (permit, modification, amendment), 4. The portions of the jetties to be removed must be removed within 30 days of the commencement of project activities. 5, All fill shall consist of "clean" sand, gravel or soil (not asphalt, slag, flyash, broken concrete or demolition debris). 6. No excavation of the beach is authorized for the purpose of obtaining fill or stone material. 7: All areas of soil disturbance resulting from the approved project shall be stabilized as per the specifications of the approved plans immedrately following project completion or permit expiration, whichever comes first. If the pro ect site ismains inactive for more than 48 hours or planting is impractical due to the season, then t~e area shall be stabilized with straw or hay mulch or j ute matting until weather conditions favor germination. 8. Ifplanting/seeding is impracticablcdue tothetime ofyear, atemporarymulch shall be applied and final seeding performed at the earliest opportunity when weather favors germination and growth, but not more than six months after project completion. 9. All disturbed areas where soil will be teemmppoiatily exposed or stockpiled for ]on er than 48 horns shall be contained by a continuous line of stzlced haybales /silt curtains (or other NYSDEC approved devices) placed on the seaward side between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 10. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved by the Department for use m wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with tidal waters. l 1. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmrntal Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Deparhnent of Envrronmrntal Conservation tray require, remove all or any portion of the uncompleted stmcpac or fill and restore to its former condition the navigable and flood capacity of the watercourse.
