Quogue. New York 11959, as to an undivided 25% interest, DONALD W. SUTER, residing at
Dean Drive, Cutchogue, New York 11935, as to an undivided 24% interest, and ANNE SUTER
ZIMMER, residing at 11152 Conestoga Court, Oakton, Virginia 22124, as to an undivided 26%
interest, as Tenants in Common, parties of the second part,
WITNESSETH, that the party of the IIrst part, in consideration of TEN and 001100--

valuable consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or succeasors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, situate, lying arid being at Cutchogue, In the Town of Southald,
County of Suffolk and State of New York, and being part of and lying within a certain map entitled "Map of
Meadowland of W. G. Schelker and H.G. Palmer, situate at CUtx:hogue, Suffolk County, New York" surveyed
January 12, 1927 by Otto. W. Van Tuyl, LIcensed Surveyor, and flied In the omce of the County Oerk of
Suffolk County, New York on Mard112, 1927 as Map No, 819, which plot Is more particularly bounded and
described as follows:
BEGINNING at the northwest mmer of land formerly of Palmer, being a point which bears South 89 degrees
58 minutes 30 seconds west and Is distant 214.49 feet from the northeasterly comer of the lands described in
said map;
RUNNING THENCE South 89 degrees 58 minutes 30 seconds West a distance of 99.67 feet to a point;
THENCE South 68 degrees 46 minutes 20 seconds west a distance of 27.17 feet to the easterly sIcIe of a
private road known as Creek Road;
THENCE South 0 degrees 11 minutes 30 seconds East along the easterly side of said Creek Road a distance of
182.76 feet to the northerly side of B private road known as Beachwood Road;
RUNNING THENCE South 60 degrees 28 minutes 40 seconds east along the northerly side of said Beachwood
Road a distance of 57.49 feet lxl a point;
THENCE North 78 degrees 38 minutes 00 seconds East and still along the northerly side of said Beachwood
Road a distance of 76.5 feet lxl B point;
THENCE North 00 degrees 01 minutes 30 seconds West a distance of 205.92 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by deed dated
September 13, 1976 and recorded In the Off'1a! of the Clerk of the County of Suffolk in Liller 8110, page 125.
TOGETHER with rights of way, rights and grants conveyed lxl the party of the first part by deed recorded in
Liller 8110, page 125.
TOGETHER with all right, IitIe and interest, if any, of the party of the first part in and lxl any streets and roads
abutting the above described premises lxl the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part In and to said premises: TO HAVE AND TO HOLD the
premises herein granted unlxl the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AN 0 the party of the first part covenants that the party of the first part has not done or suffered anylhing
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the nrst part, In compliance with Section 13 of the Lien Law, covenants that the party of the
nrst part will recelve the consideration for this conveyance and will hold the right to receive such considllflltion
as a trust fund to be applied nrst for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if ~ read "parties" when ever the sense of this indenture so
requires.
