The meeting began at 7:10 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from February 26, 2008 MOTION made by John Sepenoski, seconded by Michelle Zaloom, to approve the Land Preservation Committee meeting minutes from February 26, 2008. HOLD: Eric Keil abstained from voting. Chris Baiz requested motion be held until next LPC meeting. Applications and Inquiries: ?? PARADISE POINT HOLDING CORP. & Vj DEVELOPMENT CORP. PROPERTIES (Tall Pines subdivision) SCTM #: 1000-81-2-5 Zoned: A-C Location: 695 Paradise Pt Rd, Southold CPF: Yes Total Acreage: 19.95 acres Subdividable: Yes Fwet: 3.83 acres SCTM #: 1000-79-8-16 Zoned: A-C Location: 10250 N. Bayview Rd, Southold CPF: Yes Total Acreage: 2.08 acres (GIS 2.15 acres) Subdividable: NZ Reviewed status of offer [executive session]. – Melissa Spiro has recused herself from this project. Jim Miller, one of the landowners, and his attorney, William Goggins, Esq., discussed possibility of sale of fee title to Town for both parcels providing Town consider their counter-offer raising the purchase price to a value set by their independently obtained appraisal. The subdivision is nearing final approval and Mr. Miller has indicated he will consider option to sell to Town, or proceed with subdivision. The members entered into EXECUTIVE SESSION. Town and landowners’ appraisals reviewed by committee members and lengthy discussion ensued as to raising previously offered purchase price to the top of Town’s existing appraisal or higher if an appraisal update letter supported a higher offer. MOTION made by Lillian Ball, seconded by Eric Keil, to request an appraisal update letter from Town appraiser regarding his report on land valued as of October 2007. Proposed counter-offer to landowners will be discussed via e-mail between LPC members. John Sepenoski will bring project status before Town Board at their executive work session scheduled for Tuesday, April 8, 2008. Motion carried: 5/0 ?? Melissa reviewed updated appraisal with LPC members for their opinions on how to proceed with this project. Melissa will meet with Stephen Searl and Tim Caufield of Peconic Land Trust on Wednesday, April 2, 2008, to discuss options available. ?? Discussed County offer for part of the property [executive session]. Melissa went over history of different percentages of purchase Town Board had discussed. It was suggested that Melissa Spiro attend the next work session of the Southold Town Board on April 8, 2008, to provide a chronological order of the status of this project and for Town Board to provide direction on how to proceed. Tim Caufield, PLT, presented proposed project as discussed with 3 generation of landowners who would like to see some of the land remain in agricultural uses. A conservation subdivision concept for all or part of the properties was discussed. Tim will proceed with further discussions with family members since LPC members are favorable to preservation in this area in Orient that already has an expanse of adjoining preserved farmland parcels. ?? HEANEY PROPERTIES SCTM #: 1000-34-1-7 Zoned: R-40 Location: 69200 CR 48, Greenport CPF: Yes Total Acreage: 8.0 acres (GIS 7.8 acres) Subdividable: NZ Fwet: 7.4 acres SCTM #: 1000-41-1-1 Zoned: R-40 Location: 555 Madison St, Greenport CPF: No Total Acreage: 0.62 acre (GIS 0.58 acre) Subdividable: NZ Fwet: 0.45 acre Reviewed inquiry. Landowner contacted both Melissa Spiro and Tim Caufield in January 2006 as to the Heaney Family’s intention of donating to Town these properties that contain significant wetlands. Landowner recently contacted Town when she realized that property had never been officially donated. Landowner’s son also contacted Melissa as to status of donation. MOTION made by John Sepenoski, seconded by Michelle Zaloom, to accept donation of SCTM #1000-34-1-7 (8.0 acres) and SCTM #1000-41-1-1 (0.62 acre), both parcels being located in Greenport, provided this donation is acceptable to Southold Town Board by resolution adoption. Melissa Spiro met with Ms. Pekunka on March 31, 2008, to discuss LPC application. Landowners would like to set-off the area where the residential home is located and sell fee title to the rest of the property to the Town. This parcel is surrounded by preserved open space parcels within the Pipes Cove target area. Landowner gave Melissa a suggested purchase offer that would be acceptable to the family members. Number was high compared to other Town/County purchases in area. Melissa will proceed with ordering an appraisal as directed by a previous LPC adopted motion. Tim Caufield suggested that LPC obtain all three landowners’ signatures on any purchase acceptance letter that may be offered on this property. General Land Preservation Items: ?? AgPDD: annual purchase price for AgPDD [executive session]. HOLD due to time constraints. Hand-out (comps) distributed and will be discussed during next LPC meeting. ?? Community Preservation Fund: Update re: recent CPF meetings. Melissa gave brief update on proposed CPF amended legislation as discussed at Community Preservation Fund Policy Task Force meetings that she has been attending in recent weeks. The members re-entered into EXECUTIVE SESSION. ?? Melissa Spiro’s status report [executive session re: status of offers] Melissa gave oral status report on several projects.
