THIS INDENTURE, made the .;n+ ~ day of June, 2001 BETWEEN
DOROTHY BROACH, residing at 2650 Stars Road, East Marion, New York, 11939
party of the first part,
DAVID BROACH, residing at 1620 King Street, P.O. Box 75, Orient, New York, 11957; and
STEVEN BROACH, residing at 103 Stirling Street, Greenport, New York, 11944
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money oflhe United States paid by the party ofthe second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York,
known and designated as Lot number 20 on a certain map entitled, "Map of Soundcrest Woods, Section I",
filed in the Office of the Clerk of the County of Suffolk on June 9,1969 as Map No. 5315.
TOGETHER WITH all right, title and interest of the seller, if any, of, in and to the right to use a parcel of
land for recreational purposes on Long Island Sound as set forth in Paragraph 9 of Covenants and
Restrictions contained in Liber 7051 page 366.
BEING AND INTENDED TO BE the same premise conveyed to the party of the first part by deed dated
May II, 1988 recorded in the Office of the Clerk of the County of Suffolk on June 30, 1988 in Liber 10635
page 313.
TI!E GRANTOR illlliEIN RESERVES the right to the exclusive use and occunancv ofth.. prpmi.... _
during the Grantor's lifetime, with the GrA!}w.to pay for all maintenance and repairs, water and sewer
charges, insurance charges, and taxes relating to said premises. Said life use shall be personal to the
Grantor, and shall not be subject to assignment or lease.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
