lbe premises described herein arc translerred subject to the following additional
restrictions, to which the party of the second part covenants and agrees:
1) The property will remain undeveloped in perpetuity for use as open space, a nature
preserve and/or a pwisive recreational area with trolils. which uses may include limited
parking for access purposes. An infonnation kiosk may be constructed. Use of the
property shall also be conducted in accordance with applicable regulations governing
open space in the Town of South old (Chapter S9 of the Town Code of the Town of
Southold and any successor chapter, now or as it may be amended).
2) The interest acquired by the Town of Southold shall not hereafter be alienated
except upon the affinnative vote ofa majority ofthc Town Board aRer a public hearing
thereon and upon thc approval by the electors of the to\\l1 voti ng on a proposi tion
submitted at a special or bienniul town election. N~l subsequent anlcndment of the
provisions of the subsection shall alter the limitation imposed upon the alienation of the
It'll or any lesser interest or right acquired by the town prior to any such amendment.
