bounded and described as set forth in Schedule "A" annexed hereto,
hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of
the Board of Trustees of the Town of Southold (hereinafter the "Trustees")
pursuant to Chapter 275 of the Town Code of the Town of Southold or its
successor, and various activities conducted upon the property may thus be
subject to the regulation and approval of the Trustees prior to being
conducted;
WHEREAS, the DECLARANT(S) therefore made application to the Trustees
for a permit pursuant to the Wetlands Law of the Town of Southold to
undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to
undertake such regulated activities, the Trustees required that a 50' non-
disturbance buffer area seaward of the retaining wall with a 4' wid~
trimmed path to the beach, and re-vegetate any areas in the non-disturbance
buffer area disturbed by construction.~

Dear Mr. Strang,
I have reviewed the Declaration of Covenants draft you submitted to this office with
respect to the above referenced applicant concerning the fit~y foot wide non disturbance
buffer to be established and maimained seaward of the retaining wall with a four foot
wide trimmed path to the beach.
The covenants and restrictions document must be executed and filed with the County
pursuant to §275-10(K) of the Southold Town Code. Please note that a copy &this
document or, in the alternative, a sworn statement attesting to the filing is to be presented
to the Office of the Board of Trustees within 90 days of issuance of the permit.

1 have enclosed herewith four (4) copies of an amended map dated April 27, 2011 for your review and
records in the above referenced matter, which will replace the map upon which your permit #6836 was
granted and previously amended. In addition, 1 have included a check in the amount of $50.00 as
payment of the fee.
The extent of the modifications are as follows and are circled in red on the plan:
Relocation of the northerly landscape wall adjacent to the swimming pool terrace so as to be 4'
from Crabbers Road although the pool will remain in the same location as previously approved.
Addition of a new landscape wall 4' to the west of the pool terrace wall with steps to grade.
This new wall will create a planter area at an elevation halfway between the pool terrace and
adjacent grade and will be 71' minimum from the edge of wetlands and behind the 50' non
disturbance buffer wall previously approved.
I respectfully request a modification to the permit as outlined above. Thank you for your consideration in

Dear Mr. King and Members of the Board:
[ have enclosed herewith four (4) copies of an amended map dated January 13, 2010 for your review and
records in the above referenced matter, which will replace the map upon which your permit #6836 was
granted and previously amended.
Please note that subsequent to your issuance of the above referenced amendment, my client has consulted
with his pool contractor and landscape designer and has proposed the following changes as shown on the
submitted drawings.
Relocation of the swimming pool further back from the edge of the wetlands
although the pool terrace will remain in the same location as previously approved.
Modification to the retaining wall along the 50' non-disturbance buffer.
The nature of the retaining wall modification is to extend the wall toward the south where it will intersect
the southerly property line and terminate at the same natural grade elevation as the top of the wall
(el. 14'). This will allow for the deletion of the return leg of the wall toward the house and keep more of
the existing natural grade undisturbed. This modified wall will be no higher than the original and will
maintain the 50' non disturbance buffer for its entire length.
In addition, inasmuch as the permit is to expire in March I respectfully request a one year extension to the
permit as the work will most likely not start until April but should be completed by June.

I have enclosed herewith a check in the amount of $50.00 together with four (4) copies of an amended
map for your review and records in the above referenced matter, which will replace the map upon which
your permit #6836 was granted.
Please note that subsequent to your issuance of the above referenced permit, the New York State DEC
denied our application for the pool location which you approved and required us to relocate the pool to the
North yard in place of the existing deck and hot tub. This necessitated our filing for a variance from the
Southold Town ZBA which recently granted a conditional approval which is reflected in the amended
map now being submitted. The extent of the amendment basically keeps the retaining wall and lawn area
as shown on the map you approved but relocates the pool and terrace to the North yard keeping it a
minimum of 75' from the edge of wetlands and maintaining the 50' non disturbance buffer requirement.
In addition we will have to relocate the existing sanitary system as now shown on the enclosed map.
You will also find enclosed for your records is a cop~/of both the DEC documents and ZBA
determination.
I am hopeful you will find this modification acceptable and will grant an administrative amendment to
your permit. If, you have any questions regarding this matter, please feel free to contact my office.

RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6836 to relocate the proposed pool and terrace to the north keeping it
a minimum of 75' from the edge of the wetlands and maintaining the 50' Non-
Disturbance Buffer requirement, and to relocate the existing sanitary system, and as
depicted on the revised site plan prepared by Garrett A. Strang, Architect last dated
August 14, 2009, and received on August 14, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falb under the Type Il category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODF: Th~ aAd~cation was referred as required under the Suffolk County
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating
that this application is considered a matter for local determination as there appears to be no significant county-wide
or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 31,915 sq. ft. non-conforming, irregularly shaped lot
in the Residential R-40 District. It fronts on Crabbers Road (an unopened paper dght.-of-way) and on Broadwaters
Cove Road, and is adjacent to wetlands and Haywaters Cove. It is improved with a single- family dwelling and raised
wood deck and hot tub..

~: This application has been reviewed under Chapter 268, Waterfront Consistency review of
he Town of Southold T~.Wn Code andthe Local Waterfront Revitalization Program (LWRP) Policy Standards. A letter
dated June t9, 2009 w.as received from lhe LWRP C,(x:)rdinator Mark Terry, stating that based upon the informalion
provided on the LWRP Consistency Assessment Form submitted to this depanlment, as well as the records available
to us, it is our recommendation that the proposed action is coNSISTENT with LWRP policy standards and therefore
is CONSISTENT with the LWRP
RELIEF REQUESTED: The applicant proposes to construct a raise terrace at a 7 ft. front yard setback from
Crabbers Road, an in ground swimming pool at a 12 ft. front yard setback from Crabbers Road right-of-way where
the code requires a minimum 40 foot front yard setback. In addilion, the applicant proposes to construct extensive
perimeter retaining wal~s with re-grading around the proposed terrace and pool area, seaward of the existing
dwelling, and in the existing front yards parallel to Crabbers Road and Broadwaters Road.

ADDITIONAL INFORMATION: The applicant submilted an altemate site plan for the proposed raised terrace and
pool to the NYS DEC which located theconslmctlon on'the seaward side of the existing dwelling at 50 feet from the
wetlands along Haywatem Cove. (See site plan by Garrelt A. Slrang, Architect, dated 3-21.88 labc~'~-'d drawing No.
SP-1). This alternate site plan would not have required a front yard .setback variance from the Board of Appeals.
This plan received approval from the Southold Town Board of Trustees (See latter dated March 19, 2008). However
it was denied by the NYS DEC because it failed to meet Ar'acle 25 Section 661.9(b)(1)~ and (iv) of the
Environmental Conservation Law. The DEC recommended ~e placement of a proposed raised terrace and in ground
pool in place of the aPl:~S as built non-conforming raised wood deck on the northeasteriy side of tbe house, for
which a variance for a 14 fl setback from Cmbbem Road was granted by the Board of Appeals on November 6,
2003 (No. 5400). (See letter from the DEC dated May 14, 2~). The applicant's revised site plan is tbe subject of
the relief in this variance application.
REASONS FOR BOARD ACTION: On the basis of ~asi~y presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Town Law .~267-b{3}{b)~3)H). Grant of alternative relief will not produce an undesirable change in the character
of the neighborhood or a datdment to nearby pmpertias. There is an existing raised wood deck and hot tub on the
subject property with anon-conforming 14 It. front yard sethack from Crabbers Road, wtiich is a narrow paper mad
that is unopened. The applicant has a driveway over Cmbbem Road right-of-way for access to his property from
Bmadwaters Cove Road ~ the adjacent land on the opposite side of the paper road which the applicant also owns.
There are significant slopes on the subject property which require re-grading for tbe proposed raised temace, pool,
and lawn areas that are not typical of olber slmctums in the front yards of neighboring propertlas. The Board, in
granting altemalJve rer~ef, seeks to minimize the visual impact that the proposed conslructlon will have on
Breadwaters Cove Road as wall as Crabbem Road right-of-way from both front yards on tbe subject property.
2. ~ The behest sought by {he apprmant canno~ be achieved by some method, feasible for
the applicant to pursue, other than an area variance because tbe existing dwalling is selback 39 feet +/- from
Crabbers Road right-of-way, and the NYS DEC required tbe applicant to conslruct the proposed raised terrace and
pool in the front yard facing Crabbers Read i~ ptece of a non-confofl~ag as-built.deck and hot tub structure.
3. Town Law .~267-b(3)~b}(3[. The variance as applied for is substantial. 'l'he code requires a minimum front yard
setback of 40 f. The pre-exislJng non-conforming setback of tbe as bu~ ra~ wood deck and hot tub is 14 feet
which is a 65% variance from the code. Since the proposed conslructlon involves the demolition of the existing wood
deck, and Crabbers Road is an unopened paper right-of-way, the Board of Appeals seeks to reduce the proposed
new non-conformity by granting ~ Sethack Relief from Crabbem Road right-of-way for a minimum of 15
feet, which is a 62.5% variance from tbe code.
4. ~ The difrmutly has been self-c~'eated, however, Ihepmpesedlocatlon ls themsuit of
the NYS DEC denial of a request to place a raised terrace and pool in a locelbn that would not have required a front
yard setback variance.
5. Town Law .~267-b(3)(b){4). No evidence has been submitted to suggest that a variance in this residential
community will have an edveme impact on the physical or environmantel conditions in the neighborhood. A letter
dated June 23, 2009 from Nicole Spinelli of the County of Suffolk Soil and Water Consenralton District indicated that
no natural resources concerns were observed on the ~ propaly with regard to the proposed consl)'uction of a
raised temace, in ground swimming pool and retaining walls. The property is heavily vegelated and the shoreline

applicant to enjoy lhe benefit of a raised terrace, swimming pool and relaining walls, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of Ihe above factors and applying lhe balancing test under New
York Town Law 267-B, molion was offered by Member Weisman, seconded by Chairman Goehringer, and duly

The Department objects to the proposed project at the Geroulanos property as this proposal fails to meet
Article 25 section 661.9(b)(1)(i)and (iv) of the Environmental Conservation Law. The limit of
jurisdiction remains at the 20' contour line and the construction as proposed does not meet development
restrictions. Reasonable alternatives should be considered.
The Department recommends project to be modified to show pool on east side of house or in place of the
existing wood deck with a small deck on the west side 75' from the tidal wetland boundary. Please send

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized Which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
2. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Garrett A. Strang, last revised 8/26/08.
3. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification form certit}Ang that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
4. Sanitary Systems above Groundwater Sanitary system (bottom of tank and leaching pools) shall
be located a minimum of 2 feet above seasonal high groundwater.
5. No Pool Discharges to Wetland There shall be no draining of swimming pool water directly or
indirectly into wetlands or protected buffer areas.
6. No Drywells in or near Wetland Dry wells for pool filter backwash shall be located a minimum of
70 linear feet landward of the tidal wetland boundary.
7. Straw Bales A row of staked straw bales or approvable erosion control devices shall be placed as
per the NYSDEC-approved plan, prior to commencement of any regulated activities and remain in place
and in good, functional condition until the project is completed and all disturbed areas are stabilized with
vegetation.
8. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 75 linear feet from the tidal
wetland boundary.

9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be
stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior
to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours
or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or
jute matting until weather conditions favor germination.
10. No Disturbance to Vegetated Tidal Wet/ands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
11. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
12. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
13. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein author/zed, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any potion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
14. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
12. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore the site to its former
condition. No claim shall be made against the State of New York on account of any such removal or
alteration.

GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation (the Depm hnent) to determine whether the permittee is comply/ng with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Deptutment's representative during an inspection
to the permit area when requested by thc Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Depa~hnent, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transfer are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or
revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;

noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York, its representatives, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with, or operation and maintenance of, the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of~
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the
riparian fights of others in order to perform the permitted work nor does it authorize the impairment of
any rights, title, or interest in real or personal property held or vested in a person not a party to the
permit.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
March 19, 2008, and in consideration of application fee in the sum of $250.00 paid by Spiro Geroulanos and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to install an in-ground swimming pool, terrace, retaining wall,
and new lawn area, with the condition of a line of stakes hay bales along the 9' contour
line, a 50' non-disturbance buffer area seaward of the retaining wall with a 4' wide
trimmed path to the beach, re-vegetate any areas in the non-disturbance buffer area
disturbed by construction, a pool drywell installed to contain run-off, and as depicted
on the site plan prepared by Garrett A. Strang, Architect, last dated March 21, 2008,
and received on March 25, 2008.
1N WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Spiro Geroulanos, residing at 2130 Broadwaters Road, Cutchogue, NY as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation perlbrmed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Pennittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restrictiou to the deed of the subject parcel. Such evidence shall be
provided withiu ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Strang:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 19, 2008 regarding the above matter:
WHEREAS, Garrett A. Strang, Architect on behalf of SPIRO GEROULANOS applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated January 22, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 19, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of SPIRO
GEROULANOS to install an in-ground swimming pool, terrace, retaining wall, and new
lawn area, with the condition of a line of stakes hay bales along the 9' contour line, a 50'

At the conclusion of yesterday's field inspection, it was my understanding that a Trustees Staffmember
would visit the site to delineate the wetlands boundary for our mutual benefit in reviewing the application
and proper setbacks.
Inasmuch as my client will be making an application for a new home on the adjacent lot to the north of
Crabbers road (1000-104-09-12), would it be possible for the wetlands boundary to be delineated on that
lot at the same time? This would simplify the application process for that lot as well as alleviate the need
for the staff member to make another trip to the same location.

Cutchogue Harbor Wetlands is a Critical Environmental Area and a Significant Fish and
Wildlife Area.
SPIRO GEROULANOS requests a Wetland Permit to install an in-ground swimming pool,
terrace, retaining wall, and new lawn area. Located: 2130 Broadwaters Rd., Cutchogue.
SCTM# 104-9-13.
On February 21, 2008 the applicant agent verbally indicated that a pool de-watering drywell will
be added to the site plan.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my reconunendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following recommendation is
implemented:
To meet § 275-11. Construction and operation standards of the Southold Town Code (below)

Critical environmental areas. At the discretion of the Board of Trustees, any
operations proposed in critical environmental areas (§ 275-2) ma,/be subiect to more
stringent requirements than detailed in this section. Such requirements may include,
but are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width of non-disturbance buffers.
And to further Policies 5, Protect and improve water quality in the Town of Southold and 6.3
Protect and restore tidal and freshwater wetlands, item D which states (Provide adequate buffers
between wetlands and adjacent or nearby uses and activities in order to ensure protection of the
wetland's character, quality, values, and functions) it is recommended that the Board:
1. Require a minimum 50' non-disturbance, vegetated buffer landward of the edge
of wetlands with consideration for the boat storage area and access path.
2. Determine the drainage in relation to the patio, retaining walls and site
topography and require on-site improvements (if necessary) pursuant to Chapter
236 Stormwater Management.
3. Require the installation of erosion control structures during construction activities.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
