I received this email from my neighbor Mike Bendik. The Fresh Water stream that feeds Autumn Pond flows through his property before it crosses under Henry's Lane to the property known as 2870 Henry's Lane. Mike has some interesting input as regards how the stream flow will be affected and how it has already been affected. Respectfully yours, Frederick R. Kedenburg Dear Rick and Linda, Michelle and I both agree that the area/surrounding areas should be protected and researched further as to the obvious depletion that has taken place in just the last couple of years. My direct concerns would be the setbacks and spot location of the dwelling (how poured foundation/concrete and other materials in the short and long term will be effecting water source that runs in the direct path? ( one cannot possibly get below a frost line let alone a couple of feet in that area as we all know from our own properties, and not be fighting water). The septic/sanitary system (what happened with the perk test)? The last I looked the water is standing in that area and many of the areas surrounding. The estuary is "free flowing "all year long (though at times I wonder for how much longer as I personally study the flow on my own property). Don't think for a minute that there wouldn't be some sort of change to take place on the proposed building lot and surrounding areas. I feel for sure there would be! Start to screw with the ecosystem in a major way again (as did my new neighbors to the South). Everybody needs a poured concrete patio and buried stone and sod, etc. I felt compelled to go off tonight on stupidity?, or is it just pure nativity?, or worst yet...Greed! SCTTM#74-1-1 These permits were granted at a Trustee public hearing Wednesday, February 27, 2008. I still have trouble understanding how any construction could be allowed on these wetlands that feed into an important Fresh Water Pond - Autumn Pond (Lake) - just west of Goldsmith's Inlet. As you can see from the below photos I took today Sunday December 27th 2009, the area is under much standing water. Many of the trees were taken down last spring and the place now looks totally devastated. It was a healthy woodland with streams and kettle pond areas. In addition the area of the proposed Sanitary System is mired in silty standing water. This water is flowing toward Autumn Pond that is itself already in danger of silting up. I kindly invite any one or more of The Town Trustees to come to the site and look around. We and many of our fellow year round neighbors agree that this area needs more protection. That of course is up to The Trustees, but perhaps a second look would help us all to understand the needs of this critical area. I will be home this week and live to the north of the property. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and Iow water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suf~blk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. That the said Board will be notified by the Permittee of the completion of the work authorized. Moore, Esq. on behalf of GREGORY K.
