NY 10020 as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. • James F. Box 2003 Bridgehampton, NY 11932-2003 RE: LLOYD KAPLAN 105 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 50-2-3 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 16, 2008 regarding the above matter: WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of LLOYD KAPLAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 19, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, in accordance with Chapter 268, said application was found to be Exempt from the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 16, 2008, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 • WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of LLOYD KAPLAN to construct a swimming pool with a surrounding patio and attendant pool equipment, pool drywell and pool fencing, landscaping, landscape retaining wall and entrance gate, and as depicted on the survey prepared by John C. One of Hie joys of living here is the natty al glory of the bluff, which leads to the shore of Long Island Sound. "Che bluff' is a fragile tattdscape, susceptible to erosion. Happily the community has acted to protect it against incursion by negligent owners or careless developers. I am writing to report what 1 observed regarding the. cutting of trees on the bluff at the property one house west of my prnnrrry, pp t~,larch 5, ?008- On drat day I observed hvo men and a large truck from Ver Der Ber Landscaping at the residence one. house west of mine. 1'he men were hauling 8"-10" diameter tree trunks into the truck They told me that these hunks had been cut from the bluff I advised them that it was illegal [o cut trees from the bluff at any time and that a Permit from the "Trustees was necessary in any event. They could net pro: uce a Permit. I asked them to desist and to leave the n-unks. I reported the incident to Elizabeth Cantrell at the Tovm Hall Annex. She took all the information necessary from one and stated that the Harbor Master would investigate the next day. When [returned to my home Hte rren had ieiC and had taken the large trunks with them. Only smaller 2"-3" cut limbs remained- On March 6, Ms. Cantrell advised me that the Harbor Master had concluded that only "hanming" had taken place on the bluff. Because of the discrepancy in observations Ms.Cantrell told me that the Trustees would visit the site for an additional look. I wautad to investigate store thoroughly the type and amount/ kind of cutting, that had taken puce. As a result of a thorough inspection, I am convinced that what happened on Hte bluff indicates an event more serious than "tree trimming". Ou the afternoon of March 6, I went down the steps to the beach and observed four or five 8"-10" freshly cut tree trunks visible to the west side of tPte steps. I also obser~ ed six-eight 3"-4" young saplings which were cut beneath their limb height malting it impossible for them to photosynthesize and continue growing. 1 bring this rnatler to your attention `o verify what 1 have observed and to voice my concern regarding actions, which have, occurred, that stay compromise the integrity of the bluff in the future, creating erosion is this vulnerable area. ht October of 2007, I wrote a note b.t the new owners mentioning the fragile nature of the bluff and stating that the Trustees must be consulted before any work could start there. It is clear that this procedure l:as not been foliowed and that mu:grity of the bluff has been weakened. As a re>a-door neighbor whose property' is compromised by These actions, and as a citizen of Southold who is concerned for fire preservation of the bluff I am distressed by this disregard of the law and damage to the frag;ie environment.
