AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
February 27, 2008, and in consideration of application fee in the sum of $250.00 paid by Isabelle Houlbteaue
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to remove 56' of existing bulkhead and 52' of existing 3.5' wide
wooden walkway and replace same in-place using C-Loc vinytsheathing for bulkhead,
with the condition of a 10' non-turf buffer encompassing the gazebo, use of a siltboom,
use of non-treated lumber wherever possible, and as depicted on the site plan prepared
by Costello Marine Contracting Corp., last dated February 20, 2008, and received on
March 10, 2008.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Petmittee Isabelle Houlbregue, residing at 1230 South Oeden Street. Denver, CO 80210 as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originafing application maybe cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Boazd of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Pernuttee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction fo the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 27, 2008 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of ISABELLE HOULBREQUE
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 30, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Watertront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 27, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of ISABELLE
HOULBREQUE to remove 56' of existing bulkhead and 52' of existing 3.5' wide wooden
walkway and replace same in-place using C-Loc vinyl sheathing for bulkhead, with the
condition of a 10' non-turf buffer encompassing the gazebo, use of a siltboom, use of

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

- The plans note that the existing drains will be removed.
- Sections "D"and "E"will have low profile bulkhead beneath dock.
- Dock will be constructed with Flow-Thru grate style decking.

ISABELLE HOULBREQUE requests a Wetland Permit to remove 56' of existing bulkhead
and 52' of existing 3.5' wide wooden walkway and replace same in-place using C-Loc vinyl
sheathing for bulkhead. Located: 210 Knoll Circle, East Marion. SCTM#37-5-16
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP, with the condition that the following Best Management
Practices be followed to further the below listed policies:
Policy 5. Protect and improve water quality arzd supply in the Town of SoutllolrL
1. Minimize the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to § 275-11. B,1 (f) Construction and operation standards below.
(~ In order to prevent the release of metals and other contaminants into the wetlands
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
known as "CCA'), creosote, penta products or homemade wood preservatives is
prohibited for use in sheathing and decking. Preservatives of any type, including but riot
limited to those listed above cannot be applied to any bulkheads, retaining walls or
revetments after installation. Encapsulated pilings or native nonchemically treated
(untreated) lumber only should be used in sensitive areas.
2. Require the installation of a silt boom (where feasible) pursuant to § 275-11. (2) Construction
and operation standards below.
2) Erosion control. Installation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales, wood
chip berm and silt booms. The placement of the erosion control structure(s) shall be
determined by the Trustees or their designee. All intertidal construction and excavation
requires the installation of a silt boom that will retain all suspended sediments within the
immediate project area.
In addition to also further Policies 5, Protect and improve water quality in the Town of Southold
and 6.3 Protect and restore tidal and freshwater wetlands, item D (below). It is recommended
that a minimum 15 foot non-turf buffer be required landward of the bulkhead.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in
order to ensure protection of the wetland's character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of developmerrt in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. There will be no increased development and our proposal is an effort to
maintain existing structures.
Policy 2 Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. Anew bulkhead is just an attempt of the
upland property owner to maintain her property. The visual quality and scenic resources will remain
the same.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland properly. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase Flooding or erosion in this area.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact on the water quality and supply of the Town of Southold.
Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem.
This proposal will not have any impact on the Town of Southold's ecosystem. The project site is
located in a homeowners association where most of the waterfront is bulkheaded.

Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. There is a bulkhead presently existing and we are proposing for in-place construction,
WORIQNG COAST POLICIES
Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and
is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely
approach this waterfront.
Policy 11 Promote susta'mable use of living marine resour~in the Town of Southold.
This proposal will have no impact on the marine resources in the Town of Southold. There are no
vegetative wetlands in this area.
Policy 12 Protect agricultural lands in the Town of Southold.
