party of the first part by deed dated June 5. 200 I and recorded in the Office of the
Clerk of Suffolk County on June 6, 2001 in "'iber 12122 at page 384.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part. the h~rs or successors and assigns of the party of the second J!Brl forever.
AND the party of the second party. its successors andlor assigns covenant and agree thut
the within premises is and shall remain parkland in perpetuity and in compliance with
the covenants placed upon this subdivision by the Planning Board of the Town of
Southold for the benefit; !I5C and enjoyment of all of Ihe members of the party of the
second part. Any action laken by the party of the second part relevant 10 the subject
park land shall be made'only upon the unanimous consent of all of the members of tbe
party of the second pan. Any notice made by the party of the second part regarding a

mail return receipt requested to each owner of property within the subdivision. whelher
the owner is a current member in good standing of the party of the second pan. or nol.

covenants that tbe party of the first part will rcecive the consideralion for this
conveyance and will hold the righl to receive such consideration as a trust fund 10 be
applied first for the purpose of paying the eost of the improvemenl and will apply the
same first to the payment of the cost of the improvement bef9re using any part of the
total of the same for any other purpose.
