THIS INDENTURE, made the 11./-1, day of tMtt/, 2002
BETWEEN the COUNTY OF SUFFOLK, a municipal corporation of
the State of New York, having its principal office at the
Suffolk County Center, Center Drive, Riverhead, New York 11901,
party of the first part, and
THOMAS M. HUDGINS and SUSAN E. HUDGINS, 179 East 70'" Street,
New York, New York 10021, party of the second part,
WITNESSETH, that the party of the first part, pursuant to
Resolution Number 327-2002 adopted by the Suffolk County
Legislature on April 30,2002 and, thereafter, approved by the
County Executive on May 9,2002, in consideration of ten dollars
and other valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000" Se,cfion 128.00,
Block 02.00, Lot 023.000, and acquired by Tax Deed on February
19,1988, from Jean H. Tuthill, the County Treasurer of Suffolk
County, New York and recorded on February 19,1988, in Liber
10544, CP 113, and otherwise known as and by Town of Southold,
N x now or formally Rosin & Liguori, E x now or formally Great
Peconic Bay, S x now or formally Thomas M. and Susan E.
Hudgins, W x now or formally Great peconic Bay Blvd,
AND the premises described herein shall not be independently
improved by the erection of any structure, and can be merged
with grantee's adjoining parcel if applicable so as to form one
single lot. There can be no further subdivision of the merged
parcel unless it is consistent with local town and/or village
zoning codes and standards of the Suffolk County Department of
Health Services, applicable at the time application is made.
THIS restrictive covenant shall be enforceable by the County
of Suffolk by injunctive relief or by any other remedy, in
equity, or at law. The failure of the County of Suffolk or any
agency thereof to enforce this covenant, shall not be deemed to
impose any liability whatsoever upon the County of Suffolk or
any officer, employee or agent thereof.
THIS covenant and restriction shall run with the land and
shall be binding upon the grantee, its successor and assigns,
and upon all Oersons claiming under them.
TOGETHER with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
AND the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of
the total of the same for any other purpose:
THE WORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and year first above written.
