All that certain plot, piece or parcel of land. situate, lying and being at Laurel. in the Town of Southald,
County of Suffolk and state of New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as Distrid 1000, Section 128.00, Block 02.00. Lot 023.000 and being
bounded and described as follows:
BEGINNING at a point on the southerly side of Peconic Bay Boulevard at a point where the division
line of Lots 012.000 and 023.000 intersect the said southerly side of Peconic Bay Boulevard;
RUNNING THENCE South 20 degrees 37 minutes 40 seconds East, 485.94 feet;
THENCE North 32 degrees 53 minutes 49 seconds East, 9.95 feet;
THENCE North 20 degrees 37 minutes 40 seconds West, 483.56 feet to the southerly side of Peconic
Bay Boulevard;
THENCE along the southerly'side of Peconic Bay Boulevard, South 45 degrees 30 minutes 00
seconds West, 8.75 feet to the point or place of BEGINNING.
TOGETHER with all right, title and interest of the party of the first part, in and to the land lying in the
street in front of and adjoining said premises.
TOGETHER with right of way to use driveway over pramises to east as ilet forth in Driveway Right of
Way Agreement recorded in Liber 12363 page 399.
TOGETHER with all right, title and interest of the party of the first part, if any, of, in and to the land
lying under the waters of Peconic Bay in front of and adjoining the pramises hereinabove described.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part herein and
Lauris G.L. Rail by deed dated 10127104, recorded 1/14/05 in Liber 12366 page 132.
SUBJECT TO the mortgage of record held by CitiMortgage, Inc., or its successors and assigns.
TOGETHER with all right, title and Interest if any, of the party of the first part in and to any streets and roads
abutting the abova described premises to the centar lines thereof; TOGETHER with the appurtenances and all
the estata and rights of the party of the first part in and to said pramises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whataver, except as aforesaid.
AND the party of the first part, in compliance with Saclion 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this convayance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word 'party' shall be construed as if it read 'parties' when ever the sense of this indenture so
requires.
