GRIMES as to fifty (50%) percent, tenants in common, residing at 1700 Hyatt Road, Southhold, New York 11971 party of the second part, WITNESSETH, that the party of the first part, in consideration of 0.00 dollars, lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying and being in the Village and Town of South hold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a concrete monument set on the Northwesterly line of a 50 foot strip of land hereinafter described as a right of way, at the southerly comer ofland now or formerly ofWamer; RUNNING THENCE along said Northwesterly line of the above mentioned 50 foot strip of land South 23 degrees 35 minutes 20 seconds West 100.03 feet; THENCE along land now or formerly of Walter E. Hyatt North 64 degrees 50 minutes West 470 feet, more or less, to Long Island Sound; THENCE Northeasterly along said Long Island South 100 feet or more; THENCE along said land now or formerly of Warner South 64 degrees 50 minutes East 460 feet, more or less, to the point or place of BEGINNING. TOGETHER with a right of way over said 50 foot strip ofland along the first courses above described and thence in a general Southwesterly direction about 630 feet to a certain 20 foot strip of land; thence over said 20 foot strip of land, in a general Southeasterly direction, about 500 feet to the Southeasterly boundary of land now or formerly of said Walter E. Hyatt; THENCE over the existing roadway in a general Southerly direction to Sound View Avenue. RESERVING a right of way over a strip of land 20 feet in width, the Southwesterly end of which begins at the Northeasterly end of the last described right of way and runs Northeasterly across the premises to land now or formerly of said Wamer. Subject to rights of others to use said rights of way. BEING AND INTENDED TO BE the same premises conveyed to the grantor herein by Deed dated 02/21/2001 recorded 03/09/2001 in Liber DOOOl2106 Page 791, and intended to correct the manner of ownership. TOGETHER with all right, title and interest, ifany, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. lbe word "party" shall be construed as ifit read "parties" whenever the sense of this indenture so reqUIres.
