The Southold Town Planning Board held a regular meeting on
February 4, 1985 at 7:30 p.m. in the Southold Town Hall, Main
road, Southold.
Present were:

subdivision of Stephenson Beach located at Main Road, East Marion-
Orient. 3 lots on 13 acres.

by Pat Wood, notorized by Barbara Forbes, proof of publication in the

Is there any objection with dispensing with the reading of the
metes and bounds of this property. (none) We have approval from
Health Services, correspondence from Suffolk County Planning, and
everything in this file appears to be in order. Is there anyone
out there with any objection to this subdivision? Hearing none.

On a motion made by Mr. Mullen, seconded by Mr.Latham it was
RESOLVED that the Southold Town Planning Board set March 4, 1985
at 8:00 p.m. at the Southold Town Hall, Main Road, Southold as the
time and place for a public hearing on the question of approval of
the minor subdivision of Alexander Enterprlsgs located at Laurel,
4 lots on 28 acres.

W.B.W. Corm- The Board reviewed the site plan for 8 retail stores
located at Main Road, Cutchogue and noted that the plan had
recedved certification from the Building Department.
On a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board ~pprove the site
plan of W.B.W. Corp. ~for the construction of 8 retail stores
located at Cutchogue, as well as, the supplemental landscape
plan for the project, subject to a one=year review prior to the
issuance of a certificate of occupancy. Plan dated December 17,
1984.

On a motion made by Mr. Ward, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board approve the set-off
(106-13) of Henry Domalski located at Oregon, plans dated February
28, 1984 subject to the review of the Suffolk County Planning
Commission.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards
It was noted that this application receiVed 280-a and variances from
the Zoning Board of Appeals.
Thomas Mrowka-The Board reviewed the file and it was ~Qted that the
amended maps as requesting indicating the parcel to merge to the land
of Radziewicz had been submitted.
On a motion made by ~Mr. Latham, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board approve the sketch
map of the minor subdivision of the Estate of Thomas Mrowka located
at Peconic for 3 lots on 5.8 acres, plans dated as last amended
January 16, 1985.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
Winds Way Building Corp.- The Board reviewed the correspondence
from the Suffolk County Planning Commission regarding this set-off
which had been approve d by the Planning Boa.rd and the Zoning
Board of Appeals. The County denied the proposal on the basis.
that it was below the two-acre minimum zoning requirement.
The applicant's attorney had written correspondence requesting
that the County's denial be overriden by the Planning Board on
the grounds that it had received a variance from the Board of
Appeals, therefore, it was acceptable although not two acres.
On a motion made by Mr. Mullen, seconded by Mr. Ward it was

RESOLVED that the Southold Town Planning Board overrride the
resolution of the Suffolk County Planning Commission regarding
the set-off of Winds Way Building ~orp. located at Southold.

7:45 p.m. Public hearing on the question of approval of the minor
subdivision of Donnalee and Richard Relyea located at Laurel
for 4 lots on 9.6 acres.
Mr. Orlowski: We have proof of publication from the Long Island
Traveler-Watchman signed by Pat Woods and no%orized by Barbara
Forbes and also proof of publication from the Suffolk Times,
signed by Anna Lekas and notorized by Judith Chien~ Is there
anybody out there who has any problem with dispe~sing with the

The Following new proposal__s were set for field inspections:
Ann Saba- 2 lots on 1.274 acres at Stillwater Avenue, Cutchogue.
It was noted that an application has not been submitted to the
Zoning Board of Appeals for an area variance and the Board requested
that the applicant be directed to do this.
Emilia T.Pike-2 lots on 90,382 sq. ft. located at N. side of Main Road,
Mattituck, application is also before Zoning Board of Appeals.
Estate of Louis Wilson- 2 lots on 1.622 acres at N. side of Main Road,
Mattituck, application is also before Zoning Board of Appeals.
Victor Lessard noted that the lots were split by a will, however, he
recommended that a subdivision application also be filed.
Mr. Gerard Gralton was present for a pre-submission conference to
discuss his site plan for the construction of a storage building
behind his existing store "SoutholdFloor Covering" located at North
Road, Southold. Mr. Gralton s&id the present storage area is a
trailor which he intended to replace with the proposed 5,000 sq. ft.
storage building. The Board questioned if the building would
be for storage purposes only. Mr. Gralton said that it would
be only storage, constructed on a slab. It was the consensus of
the Board to make a field inspection of the premises prior to
any action or recommendations.

Sophia and Richard Greenfield-Minor subdivision to be known as
"Cabot's Woods: The Board reviewed the inspectors report regarding
the improvements to be made on the right-of-way within the subdivision.
It was noted in reviewing the report that Inspector Davis had
recommended widening the right-of-way to 10' due to the large
trees which would have to be removed. It was the consensus of
the Board that this would set a precedent for narrow roads with
similar subdivisions that were long and narrow lots up to the
Sound. The Board was in agreement that the width should be 16'
rather than 10'. Mr. Lessard said that 280-a only required that
roads be 15' however 16' was good, and Mr. Davis (who was present
in the audience) said that the road width in the report was only
a recommendation to the Board.
On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board accept and request
compliance with Inspector John W. Davis' report No. 420 regarding
the access road improvements within the minor subdd~ision of
"Cabot's Woods" located at Peoonic with an amendexnt to line No. 1
to read, "1~ Width 16 ft."
Vote of the Board: Ayes: Orlowski, Mullen,Latham, Ward, Edwards
Charles S. Gillispi~- Set-off located at Main Road, Orient. The
Board was not able to get out into the field, however, there was
recommendations. It was the consensus of the Board to request that
the strip of land along Main Road, labeled as Lot lB on the Estate
map, be incorporated into Lot No. 2 of the set-off. This is
recommended so as not to create a separate parcel of the 1022'
strip, since it is contiguous to other land of Charles S. Gillispie.
Alice Currie- This proposal is for a lot-line change for 3 lots on
1.118 acres located at N. Side of Soundview Avenue. These lots
were previously created by the Board of Appeals in 1957 and the
applicant proposed a re-configUration of the three lots. Since
the Board had not been able to make a field inspection, this proposal
will be held over.
Emil Conklin Estate- The Board reviewed the correspondence from
the Suffolk County Planning Commission regarding this~oposal for
4 lots on 7.5 ac~es located at Middle Road, Greenport. The County
Planning Commission had disapproved the subdivision for the following
reasons:
1. The configuration of the lot layout ddes not promote the
orderly development of the land.
2. A l~ndlocked parcel (no frontage on a public road) is proposed.
3. The layout of the subdivision will add to the great number of
access points (driveways) along this section of the County Road
thereby adding to the interference with traffic flow.

Mr. Luddecke, Jr., attorney for the applicant, was present. The
Board reviewed his correspondence regarding the County's denial
and requesting that the Board override the County. Mr. Ludecke
explained that they are proposmng a right-of-way and to avoid
any additional driveways onto the County Road, they could covenant
that all the~lots would have to use the right-of-way for the
access, new
The Board discussed changing the lot line for lot No. 2 and Lot No. 3
to avoid a flag lot. It was the consensus of the Board to request
new maps with this change and hold over the discussion on the
County's resolution until the new maps are submitted.

William Gillooly- Mr. William Gillooly and his brother Robert
Gillooly were present for the discussion on this major~ubdivision
of 6 lots on 13 acresat the West side of Tabor Road, Orient.
It was noted that the Town owns a recharge basin on Tabor Road
for drainage. Mr. W. Gillooly stated that they would be willing
to donate money to the Town in lieU of ~land~6r-pa~?anddplayground.
Mr. Gillooly stated that since he has owned the land the zoning
had changed and with the new master plan update, he was not sure
what new zoning the land would fall under.
On a motion made byMr. Latham, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board approve the sketch
map of the subdivision of William and Richard Gillool¥ located
at Orient for 6 lots on 13 acres, plan dated as last amended
October 28, 1984.

Mr. William Gillooly questioned if a narrower road could be put in
rather than the 28' road. He indicated that he would calculate
what the widereroad would cost, and place mature street trees
along the road. He explained that the road would only really
be serving three lots since all the other lots have access off
exdsting roads. Mr. Gillooly further explained that he would
be spending the same amount of money, however, he would be able
to put in nice improvements, for example, have belgian block
curbs and so forth. The Chairman requested that this be put
in writing. He also stated that a swale system could be used
for drainage which would also make it a little nicer.
Oregon Heights located at Mattituck-The Board reviewed this proposal
for 6 lots on 12 acres located at Reeve Avenue, Mattituck. It was
noted that this was previously subdivided into one acre lots and
was denied relief from the two-acre zoning. Mr. Parker, esq.
was present for the applicant. Mr. Parker indicated that there
was some question with the new application as to whether or not
there Should be a land reserve or money for park and playground.
The chairman said that if there is land reserved for park and
playground the maps would have to be revised to reflect this.
Mr. Parker said that money could be donated in lieu of land
reservation so as not to have to amend the maps. The Board
suggested radius curves on the corners for highways.

On a motion made by Mr. Ward, seconded by Mr.'~Latham it was
RESOLVED that the Southold Town Planning Board approve the sketch
map of the major subdivision of Edward and Charles Nalbantian to
be known as "Oregon Heights" located at Mattituck and dated October
29, 1984 for 6 lots on 12 acres subject to the following:
%. A dedication for highway purposes be made at the corners
of all four intersections.

On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board refer the site plan
for Melrose Marine Service to the Building Department for certification.
This site plan is for the construction of a business office for
marine contracting, with accessory use for storage and repair of
contractor's own vehicles and equipment. Plans dated September 13, 1984.
It was also noted that the Zoning Board of Appeals has given approval
for this use and for the set-back variances.

Robert Celic site plan for addition to existing building at Mattituck-
The Board made a field inspection of this property and made the
following recommendations: Narrow the size of the addition in the
east/west direction; in doing this, connect the two parking areas.
The Board noted that the configuration of the addition would change
slightly, however, the same square footage could be used. It was
the Board's main concerns that there be off-street parking, that
there be curbing to control the engrances and that there be no
backing out into Marlene Lane. The Board sent Mr. Celic
a copy of the plan with the above recommendations for use as a
guil~ to drawing the new survey.

On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the SoutholdTown Planning Board set March 6, 1985 at 7:30 p.m
at the Southold Town Hall, Main Road, Southold as the time and place
for a public hearing on the question of approval of the preliminary
maps for the major subdivision of Richard J. Cron, located at Laurel

containing 13.9 acres.

On a motion made by Mr. Ward, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board set March 4, 1985
at 7:45 p.m. at the Southold Town Hall, Main Road, Southold as the
time and place for a public hearing on the question of approval of
the minor subdivision of M.~ Dickinson Burns located at Southold,
containing 5.9 acres.

On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board approve the minutes
of the regular meeting of October 22, 1984.

On a motion made by Mr. Ward, seconded by Mr. Mulien it was
RESOLVED that the Southold Town Planning Board refer the site plan
for kllen Ovsianik for the construction of a gas stationlocated
at Peconic to the Building Department for certification. Plans
dated as last revised January 26, 1985.

Genevieve Richards- The Board reviewed this new proposal for a storage
building located in a B zone on Main Road, Arshamomaque. Mr. Lessard
stated that in this zone there are no requirements for set-back on
side yards. It was the consensus of the Board to set this for a field
inspection prior to any action or recommendations.
Local Law in Relation to Building setbacks- The Board reviwed the
proposed Local Law which the Town Attorney had drafted based on the
Planning Board's recommendations. The Board noted that based on
previous recommendations another Local Law had been proposed and
the Board had to refer the one they wanted adopted to the Town Board.
The Board agreed to recommend the more current proposal . There
was discussion, however, that ordinary high water should be changed
to mean high water. It was noted that there is different high
water on every parcel in the Town and that a set datum should be
established. Mr. Tuthill, Town Engineer, (who was present in th
audience) explianed that there is really no difference between
the term ordinary and mean, ~o~ver, "mean" is the term generally

used. Mr. Ward said that the ~atum should be from the USC and G
(US Coastal and Geological) since that was a good reference.
On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board concur with
the resolution of December 3, 1984 that the . ~cv~ proposed Local
Law in Rala~n~'tOLB~ding Setbacks to wit:
A. Lots adjacent to Long Island Sound.
(t) Ail building located on Dts adjacent toLong Island Sound,
and upon which there exists a bluff or bank landward of the shore or
beach, shall be set-back not less than 100 feet from the top of such
bluff of bank.
(2) Except as otherwise provided in subdivision A(1) hereof, all
buildings located on lots adjacent to Long Island Sound shall be
set-back not less than 100' from the ordinary high water mark of
Long Island Sound.
B. Ail buildings located on lots adjacent to tidal water bodies other
than Long Island Sound, shall be set-back not less than 75'
from the mean high water mark of such tidal water body, or not less
than 75' from the landward edge of the tidal wetland, whichever is
greater.
C. Ail buildings located on lots adjacent to any freshwater body shall
be set-back not less than 75' from the edge of such water body, or
nor less than 75' from the landward edge of the freshwater wetland,
whichever is greater.
be amended with the following revisions: 1. Change ordinary high
water to mean high%~ater which will have to be defined in the zoning
and wetland regulations (Chapter 97-Section 97-28). 2. Reference
what datum mean high water is to be plotted to, using one of the
datum that is acceptable, ie. US Coastal and Geological.

Mr. Garret Stran~ was present for a presubmission conference to discuss
the site plan fo Lynn Sciora for establishing a deli at the corner
of Main Road and Kerwin Blvd. at Greenport. The construction is
for an addition for handicapped bathroom facilities. Mr. Strang
said that theprevious deli was for take-out only, however, the
new proposal will include sit down, therefore, they have to add
the restroom facilities. Mr. Strang indicated that when an
application for a building permit was submitted in was noted that
the previous deli had never obtained a certificate of occupancy,
therefore a site plan was required. Mr. Latham questioned the
large builddng, Mr. Stran~ said at one time it was used for
boat .or automobile repair and part of the use still exists.
It was noted that the application is also before the zoning
Board of Appeals for special exception. Mr. ORlowski questioned
if the parking could be arranged so there is on backing out onto
Main Road. Mr. Strang said that the Main Road really does not
come up to the building and there is a graveled area for parking
and there is room to pull cars and trucks in Mr. Strang

estimated there was 30' between the building and the edge of the
pavement. Mr. Mullen questioned the number of stools. Mr. Strang
said there are 24 seats, some boot~ and some stools, there is a
lunch counter and some fixed booths. It was the consensus of the
Board to make a field inspection prior to any recommendations or
action, the Board expressed concern regarding the parking.
Mr. Richards (site plan of Genieve Richards) questioned when the
Board would make their field inspection. The Chairman said it
would be sometime before the next meeting which was March 4, 1985.
Breakers at Island End- Mr. Lawrence Tuthill, Town Enginee~was
present for the Board's review of this site plan. Mr. Tuthill
submitted a report, to the Board regarding the road and drainage
plans which were submitted for this project. Mr. WArd concured
with Mr. Tuthill's report, however, he felt there ~om~d be some
other way to protect the ponds rather than fencing. Mr. Tuthill
said there could be a liability problem if someone drowns in the
pond, even though ~e~a~ to remain private. Mr. Lessard said
that Mr. Tuthill war right because the main issue was safety and
the ponds are in a sense catch basins. Mr. Ward said the issue
may have to be addressed with the Town Attorney. Mr. Lessard
said there was the same situation with Grand View and he was
informed that because it is private property the developers
insurance covers the liability. Mr. Ward also questioned
if there had been any correspondence from the Village of Greenport
regarding t~e water and sewer hookups. Mr. Ortowski said that
this report could be accepted and referred to the applicant with
an indication that No. 4, regarding the fencing, will be checked
by the ~Town Attorney. Mr. Tuthill also questioned the inspections
and hb~tcompensation will be made since no inspect%on fee is paid
as in a major subdivision. Mr. Orlowskisaid there was nothing
in the ordinance now, however, they were working on a formula
for future projects.
On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold' Town Planning Board accept and request
compliance with the Town Engineer's report dated February 1, 1985
for the site plan for Breakers at Island's End located at Greenport.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
Sophia Greenfield questioned the Board's action on the access road
within the minor subdivision of "Cabot's Woods". The Chairman
indicated that the Board had accepted the report with a 16' width.
Mr. Wendell questioned the Board's action on the set-off for
Winds Way Building Corp. The Chairman said the Board overrode
the County Planning Commission.

Being no further business to come before the Board, on a motion
made by Mr. Mullen, seconded by Mr. Latham and ,carried, the meeting
was adjourned at 9:03 p.m.
