Orient CTM 27-4-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued a reply dated February 5, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP EXEMPT: This application is exempt under Town Code, LWRP Chapter 268, since no natural resource feature was found within 100 feet of the sheds requested under this zoning variance. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 13,967 square feet with frontage along Harbor Road and Orient Harbor, and is improved with a single-family dwelling, accessory garage and two storage sheds. BASIS OF APPLICATION: Request for a Variance under Sections 280-15C and 280- 124, based on the Building Inspector's January 11, 2008 Notice of Disapproval concerning two accessory sheds (as-built) at less than 35 feet from the front yard lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 28, 2008 at which time written and oral evidence were presented. Based upon all Page 2— March 13, 2007 ZBA#6132—Application by Hans eger CTM No. 27-4-6 testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The relief that is being requested concerns two small accessory sheds, as built and used by the owner for storage. The sheds are located in a front yard which does not meet the code-required 35 ft. minimum from the front yard lot line adjacent to the road. ADDITIONAL INFORMATION: This property and the immediate area fronting on Orient Harbor consist of nonconforming lots with less than 20,000 square feet, in addition to a one acre parcel, each improved with a single-family home. The applicant submitted copies of Certificates of Occupancy concerning the home and building permit which increased the height of the existing accessory garage. The process with the expansion appears to be an on-going over the last several years, still uncompleted. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the fallowing'findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant testified that the sheds were placed in this location because it seemed convenient for access of his storage needs. However, it was apparent at the hearing that the rear yard or waterfront side of the applicant's property was not suitable for this location, based on information that the beach in front of several of the area homes were apparently the subject of increasing beach erosion. The home is 66 feet from Harbor Road. Between the road and the house are a trellis and two-car garage, and these two 6' by 12' accessory storage sheds set back 18 and 19 feet from the front lot line. These have existing for more than 15 years (without building permits issued at the time of placement). The Board finds that the location chosen for the sheds is probably the only location on this site. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because of the placement of the garage and driveway access into the garage. The property has only the front yard area available to locate accessory storage buildings. The applicant testified that storage is necessary outside of the main dwelling. 3. Town Law 6267-b(3)(b)(3). The variance requested herein is not substantial. Although accessory structures are permitted in front yard areas with conforming setbacks, the owner is not able to meet these setbacks due to the location of the home Page 3— March 13, 2007 • ZBA#6132—Application by Hans ieger CTM No. 27-4-6 and the garage on this property. Therefore, the present setbacks will meet approximately 52% of present code required setback. 4. Town Law 4267-b(3)(b)(5). The difficulty has been self created. 5. Town Law 4267-b(3)(b)(4). Evidence was submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood because they were unsightly. However, with the existing screening and additional screening from the road, this will be mitigated and there will not be an effect on the physical or environmental characters of the district. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy two storage sheds on this property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Simon, and duly carried, to GRANT the variance as applied for, as shown on the site survey prepared 10/21/07 by John C. Ehlers, L.S. and 1/15/08 elevation photo, subject to the following conditions: 1. The sheds shall remain in their present location. 2. The sheds shall remain without utilities as (as per applicant's testimony). 3. The existing screening shall remain and shall be enhanced with evergreens beginning at the 3.5 ft. location on the easterly side of the front yard, in front of the existing sheds. 4. The evergreens noted in #3 above shall be a minimum of five feet in height, placed four to five feet apart for a distance of 25 feet in front of the existing sheds. 5. The evergreens noted in #4 above and the existing screening shall be continuously maintained at all times. The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. The garage is proposed to be set back from the existing one-family dwelling structure 30 feet.
